Comments In the first year of operation, the Circus has been a very orderly amusement center and has had a good working relationship with the Maplewood Police Department. Recommendation Approval of the resolution on pages 6 . and 6 renewing the conditional use permit - for the Circus since it has been a very orderly facility during the first year of operation. Approval is subject to the following conditions 1. This permit may be renewed after five years of operation provided there have been no problems caused by the facility. 2. Adequate policing must be continued to ensure order, as determined by the Director of Public Safety. 3. Curfew regulations shall continue to be enforced. PAST ACTION 11 -5 -81: Council approved a conditional use permit for the circus subject to the following conditions: 1. Any exterior signage shall be approved by the Community Design Review Board. 2. The applicant shall provide written approval from Homart Development. 3. All required licenses for operation shall be obtained from the City. 4. This permit may be renewed after one year of operation provided there have been no problems caused by the facility. • 5. The bumper cars must be equipped with safety devices to guard users from possible injury. 6. Adequate policing must be provided to assure order, as determined by the Public Safety Department. 7. Bike racks and exterior lighting to be installed as required by the Public Safety Department. 8. Applicant should be aware of and enforce Maplewood curfew regulations. 9.. The owner and appl i cant. shal 1 agree to the above conditions in writing. 6-8-82:. The Board approved an exterior wall sign for the Circus, subject to the holes from the previous sign being patched to blend i n with the exterior of the building. All conditions of approval have been met. CODE CONSIDERATIONS Section 36 -442 (e) requires that 'all conditional use permits shall be reviewed by the council within one year of the date of initial approval. At that review the council may specify an indefinite term or specific term, not to exceed five years, for subsequent reviews. The council may impose new or additional conditions upon the permit at the time of the initial or subsequent reviews. A conditional use peri t shall remain in effect as long as the conditions agreed upon are observed, but nothing in this section shall prevent the city from enacting or amending official controls to change the status of conditional uses. The tunnel was on finally proposed by the applicant because the congregate dining, craft room( s health and wellness program facilities for the cooperative were to. have been located in the community service center. The applicant has chosen to provide room for these facilities within the cooperative to receive a Federal Housing Administration (FHA) mortgage commitment. If these facilities were to be located in the community center, FHA would require a permanent commitment to the cooperative residents for access to these facilities. The applicant found this requirement to be too restrictive in the event there _ ! was a need to sell or reorganize the community service center. Until such a situation would arise, the center's programs and facilities would be available to the cooperative residents on an as- needed basis. Since the tunnel was proposed in July 1982, market studies have 3thown that seniors do not like to use tunnels. The applicant feels that the cost of $150,000 or $2,000 for each unit would be excessive. for the limited benefit. The buyers would prefer a lower unit price to construction of the tunnel. Condition 3: Condition 3 of the 4 -11 -83 PUD approval (page 4) is confusing. councilman Bastian has indicated that his motion was not intended to restrict Parcel A to only recreational uses. As always happens during the process of detailing and cost refinement, issues that require.plan changes surface that seemed not to be critical during.the concept development stage. Usually, these are insignificant and warrant no public discussion. Occasionally, one or more factors are considered significant enough to require further .public con - sideration because they are part of an approved PUD. The tunnel which we proposed to connect Hazel Ridge with the Health Resource Community Service Center (HRCSC) is that kind of commitment and one from which we now wish to depart. It was a good idea that, after more study, we now feel will be an impediment to the marketing of units and will provide con- siderably less service than the cost warrants. -Our request is for a PUD amendment. to allow the elimination of the connecting tunnel. There are basically three reasons for our request., not the least of which is cost. Including the tunnel, a costly - modification to an existing storm sewer, remodeling of the-existing building just to make the connection,.plus s of t.costs, the total will approximate $150,000, or $2,000 per unit. If we felt this expenditure would contribute to the buyers enj oym" ent,., eve would not hesitate to provide the connection. we now feel very _strongly that the buyer will prefer the lower unit cost to a tunnel for which he or she may have no use. The second reason for our. request is that our plans have changed since the original concepts were drawn. Because HUD was intending to propose -a forever commitment.of.athe • HRCSC to these uses, it was decided to provide all of the essential facilities that would be patronized daily by resi- dents within the housing project itself. Thirdly, we-are getting some very strong indications that elderly people simply do not like to use tunnels, especially long ones (250 feet). our marketing to date suggests that . unit cost is -a very significant factor but that the tunnel is, at best, a neutral consideration in the decision to reserve a Hazel Ridge unit. With primary use being during the four hard winter months, we find it lacking in justification. When we came to the City for PUD approval in,March, we were already concerned that the tunnel was not justified, either from a patronage or cost standpoint, but were afraid we would upset the City's development schedule if we were to ask for a last minute PUD modification. Since the April .11 approval by the City. Council we have confirmed the issue as outlined above. We estimate that approximately one -third of the Hazel Ridge residents will use the HRCSC on a twice weekly basis. As we indicated in our February 18, 1983 cover letter, we intend to continue to operate the present HRCSC. as authorized by the 1980 Special Use Permit. These activities include outpatient treatment-for chemical dependency, home health care services, community health education, and the Health Resources, Inc. administrative offices and parking. .In addition, we intend to provide seniors support services that are desired' by the Hazel Ridge residents including recreational activities and' services to maximize convenience and enjoyment, not all of which can be defined at this time.' It is. important to note that these services will be immediately and conveniently available on 'an as- needed basis to the co -op residents and they will be made available by an organization that is uniquely qualified to deliver services to senior citizens. For a minute part of the tunnel cost, we can provide�a personalized and inexpensive transit service to Hazel Ridge residents. Tandem Senior Citizen /First -Time Home Buyer (FTHB) Pro y ram 9 Alternative David Briggs and Ted DeZuri k of Woodmark, Inc. explained their - proposal for proceeding with a modified senior citizen /first -time -• home buyer program. This modification came about because both Woodmark and Health Resources, Inc. notified the City on May 3, . .y 1983 that they no longer viewed the $7 million FTHB bond issue as attractive. on May 3, the HRA required a modified FTHB program to proceed with tax increment assistance, Woodmark reasoned that emphasis of the overall program should be placed. on lowering the cost of the seniors' units rLther than assist- ing tham to sell their existing homes. The _ HRA recapped their objectives for 'originally proposing the seniors housing program. The original report separated reconstruction of Holloway into two segments; Segment I consisted of Holloway between Beebe Road and McKnight Road and Segment II consisted of that section of Holloway Avenue between McKnight Road and Century Avenue. Segment II was ordered by the City Council, undertaken through a joint powers agreement between Maplewood, North St. Paul and Ramsey County. Segment I was deleted from the project due to lack of MSAS funds on the part of North St. Paul. North St. Paul has now received adequate MSAS allocations to proceed with this segment and Ramsey County has designated this section of roadway as a County Road and has encumbered funds for their cost sharing portion. Frc_ ; .If ..c Clerk V to- 0 D 7 ' L ' C The City of St. Paul recently amended their ordinance regulating the closing times for off -sale liquor establishments* The change permits off -sal e liquor stores to remain open until 10 P.M. on Friday nights. The 10 P.M. closing is wide spread in our surrouding communities. Because Maplewood off -sale liquor etbraesare required to close at 8 P.M. on Fridays, places us at an unfair trade advantage. Many of our customers are able to shop late on Friday at our competitors for their weekend needs and therefore, has substan- tially reduced our weekend business. With the state of th e ec onomy and the increase in formidable compet- ition in the off -sale liquor business, I hereby request that you, the city council of Yaplewood, consider amending the Maplewood ordinance in regards to off -sale liquor store hours to allow Maplewood off- sale liquor stores to remain open until 10 P.M. on Fridays as is the case for all our adjoining cities.
