The next step in actually forming a WMO is creating a joint powers agreement between the cities within the boundary. Roseville, Falcon Heights, St, Paul and Maplewood will be involved. It has been suggested that each city select a representative to serve on a negotiating committee. The City Council would give direction . to this individual and must approve the final agreement. Since I am aware of the technical issues and familiar with the administration of a WMO, please consider myself a volunteer. Jeff Jarpe, repr.esenti ng Hill crest Development, said they d'i d not the rezoning to single family was appropriate for the property because of the location of the property (overlooking Highway 36 and the water tower adjacent to it). He suggested the property adjacent to theirs should be considered for a commercial use (water tower property) If the zone change occurs to the property, all hope for development would be lost. The number of units for each acre would vary by dwelling type and bedroom mix. As an example, a two and three bedroom townhouse project with private roads would be allowed a maximum density of six units for each acre. A similar apartment project would be allowed 7.5 units for each net acre. 3. Zoning maps should be updated as necessary to make both land use maps and zoning maps compatible. 4. Contract Award and Const ruction The C: ty did duly receive bids and shall award a contract to the lowest responsible bidder, subject to full and complete execution of this agreement which is understood and agreed to be concurrence by the State in such award, for the frontage road construction to be performed along and adjacent to the east side of Trunk Highway No. 61 (Maplewood Drive) from Gervais Avenue to County Road C within the corporate City limits in accordance with State approved City prepared plans, speci- fications and special provisions therefor designated by the City as Project No. 80 -10 and by the State as State Project No. 6222 -104 (T.H. 61 =1) . Said city contract construction shall be performed in accor- dance with the State approved City plans, specifications and special provisions which are on file in the office of the City Engineer at Maplewood, Minnesota, and in the office of the Commissioner of Trans- portation at St. Paul, Minnesota, and are made a part hereof by reference with the same force and effect as though fully set forth herein. Section B. Direction, Supervision and Ins ection of Construction .The city contract construction work contemplated herein shall be under the direction of the City, and shall be under the supervision of a regisItered professional engineer; however, the state cost participation construction to be performed under said city contract sha be open -3- 61375 to inspection by the, District Engineer of the Minnesota Department of Transportation at Oakdale or his duly authorized representatives and must _Jpe approved by said District Engineer as satisfactory. before -any payment is made by the State therefor. The completion date for said city contract construction may be extended by an exchange of letters between the City Manager or City Engineer and the District Engineer of the Depart- ment of Transportation at Oakdale for unavoidable delays encountered in the performance thereof. ARTICLE III - PAYMENT BY THE STA Section A. District Engineer at Oakdale in writing prior to the performance of such additional state cost participation construc- tion. Said notification shall include an estimate in the amount of additional funds necessary to complete the city contract including construction engineering costs and the reason (s) why the original amount encumbered will be exceeded. The District Engineer shall approve and then submit said documents to the State's Municipal Engineer. The State's Municipal Engineer shall request encumbrance of such additional funds as may be deemed necessary. This encumbrance increase will have the effect of amending this agreement so as to include supplemental costs of the work. Should the City cause the performance of construction which would otherwise qualify for state cost participation but for which the State has not previously encumbered funds to cover its participation therein, the City agrees that any such work is done at its own risk. Records Keeping and Invoicing by the City The City shall keep such records and accounts that will enable the City before invoicing the State for partial and /or final payment in accordance with Sections C. and D. of this article to provide the. State with the following: (1) Quantities of state cost participation construction contract work items performed and, if applicable, other state cost participation contract items which have been paid for by the City and included in the requested payment. Said quantities are to be entered on the Modified SCHEDULE "I" form provided by the State. (2) Copies of the City contractor's invoice (s) covering the above state cost participation items. (3) Copies of the appropriate endorsed and cancelled city warrant (s) or ch=eck (s) paying the aforesaid contractor's invoice. Said partial payment shall be an amount equal to 90 percent of the value of said completed state cost construction or equal to the amount the City has paid to its contractor on said completed state cost construction, whichever amount is smaller, plus an 8 percent construction engineering cost share. Such request by the City for partial payment shall be made in accordance with a written procedure to be furnished the City by the State. (Item 2 .) In the event that (a) the state cost participation con - struction hereunder must .be suspended at the end of the construction seasot until the following spring or (b) completion of the city con- r traces .construction is in abeyance because of unavoidable i elay (s) thus i f -14- 61 375 delaying payment by the State to the City and such delay would be a financial hardship to the City, the -tate will, upon request of the City, one of . the two following partial payments to the City for T the sT-ate cost participation construction work completed under said city contract at such time as the City has made payment to its con- tractor on said completed state cost construction. (1) When no previous partial payment has been made to the City and if the value of said completed state cost construction is at least equal to 25 percent of the estimated state cost construction amount of $236,650.56, a partial payment will be made in an amount equal to 90 percent of the value of said completed state cost construction or equal to the amount the City has paid to its contractor on said com- pleted state cost construction, whichever amount is smaller, plus an 8 percent construction engineering cost share. (2) When no previous partial payment has been made to the City in accordance with (Item 1 .) above and if the value of the total state cost participation construction work completed is equal to an amount at least 25 percent greater than the completed state cost construc- tion amount which was the basis for the State's previous partial payment to the City, a second partial payment will be made in an amount equal to 90 percent of the value of said completed state cost construction or equal to the amount the City has paid to its L 7 contr=actor on said completed state cost construction, whcbever R --15 - 61375 amount is smaller, plus an 8 percent construction engineering cost share minus the total amount of the previous partial paynfent made t by tlfe State to the City hereunder. 3 A request by the City for partial payment shall be made in accordance with a written procedure to be furnished the City by the State. The retained 10 percent of the state cost share of the completed construction and construction engineering upon which either or both of the aforesaid partial payments is based will be withheld until all of the state cost participation construction work to be performed under said city contract has been satisfactorily completed and accepted by the State and the City submits an invoice for final payment. Section D. Final Payment by the State Final payment by the State to the City hereunder in accordance with Article II hereof of the State's total cost participation amount less the total amount of any partial payment made by the State pur- suant to Section C. above shall be made upon the satisfactory com- pletion of all of the state cost participation construction work to be performed under the said city contract, acceptance thereof by the State and invoicing the State by the City in accordance with a written procedure furnished the City by the State. r Z. s -16- �` 61375 ARTICLE IV - GENERAL PROVISIONS Section A. Replacement of Castin s In with the adjustment of City owned frame and ring castings T and valve boxes to be performed by the City's contractor under State Project No. 6222 -104 (T.H. 61 =1) , the City hereby agrees to furnish the City's contractor with new castings and /or parts therefor when replacements are required, without cost or expense to the State. Section B. Utility Permits mom The City shall, within 30 days of the execution of this agreement, make application to the State's District Engineer at Oakdale for a permit or permits granting the City's permission to place all of the utility facilities to be constructed upon and within the Trunk Highway No. 61 right of way limits under State Project No. 6222 -104 (T.H. 61= 1) . Application for such permit or permits shall be made on Minnesota Department of Transportation Form 25250 Section C. Maintenance It is hereby understood and agreed that, upon the satisfactory com- pletion. of State Project No. 6222-10-4 (T. H. 61 =1) construction, the City shall thereafter properly maintain, without cost or expense to the State, the entire portion of Trunk Highway No. 61 East Frontage Road c e onstructed under said stat project and including all of the s - f acil - sties a part- thereof. Said maintenance shall be und.e.,rs tood to -17- 61375 include, but not be limited to, snow and debris removal, resurfacing and /or seal coating, miscellaneous reconstruction and any - other main- t_ 7 tenan activities necessary to perpetuate said roadway ih a safe and - usable condition. Additional Draina e It is hereby understood and agreed that neither party to this agree- ment shall drain any additional areas into the storm sewer facilities constructed under State Project No. 6222 -104 (T.H. 61 =1) that are not included in the drainage areas for which said storm sewer facili- ties were designed without first obtaining permission to do so from the other party. Section E. Section F. Nondiscrimination The provisions of Minnesota Statute 181.59 and of any applicable ordi- nance relating to civil rights and discrimination shall be considered part of this agreement as if fully set forth herein, Se ction G. Approval Before this agreement shall become binding and effective, it shall be approved by resolution of the. RAr.KnRmmn In 1980, temporary improvement bonds totaling $2,950,000 were issued to finance several construction projects. Temporary, rather than permanent, bonds were issued because the construction costs and schedules were uncertain for the projects being financed. These projects have been comDleted and assessed. The 1980 temporary bonds mature on August 1, 1983 and require a payment of $3,029,175. New bonds need to be issued totaling $1,706,380 to finance the August 1st payment. The difference will be financed by cash balances which have accumulated from special assessment collections, investment interest, and surplus balances in construction accounts. Bonds are also required to fi nance the construction of two new projects: Frost Avenue (from Birmingham to White Bear Avenue) and the Crestview Drive Water Project. A total of $231,500 is needed for these projects. In addition, $64,200 of bonds are required to cover the estimated costs of th bond sale and the underwriti discount. Thus, the total.amount of the first, or Series A. bond issue is $2,000,000. A second, or Series B, bond issue is proposed to refinance the 1982 Temporary Improve- ment Bonds. When these bonds were sold last year, bond interest rates were near record levels. Consequently, these temporary bonds were issued to avoid ''locking in" for 20 Y ears the record high interest rates that were in effect at the time. The bonds co ntain a call feature to allow redemption and prepayment at the option of the City on July 1, 1983 and July 1, 1984, This strateqy has been effective as the interest rate on the temporary bonds was 9.85/. Since these bonds were sold, market interest p Y rates have decreased. This is evidenced by the Bond Buyers Index which has declined by almost 4/. Many forecasters believe that current bond interest rates are in a "val 1 e Y " now and w i l l start to rise the latter part of this year. Therefore, it is proposed that bids be taken now on long -term bonds refinance the 1982 Temporary Improvement Bonds. Both of the attached resolutions should be adopted with amendments for the new schedule. A rating on these bond issues will be requested from both Moody's Investors Service and Standard and Poors. In the past, only Moody ' has been requested to provide a rating. However, due to th combined size of the bond issues it would be beneficial to have a rating from Standard and Poors . Also, the reduction in our bond rating last year from A -1 to A by Moody's was not justified, in my opinion, based upon the explanation which was given. Several financial transfers are needed to provide adequate funds for the bonds being refinanced and for the construction projects being. financed.
