SUBJECT: Woodbury Land Use Plan
DATE: November 19, 1 980.
The Metropolitan Land Planning Act requires each City to submit its Land Use Plan
to adjacent cities for review and comment. Copies of pertinent pages of the
Woodbury Land Use Plan are encl osed. A copy of the entire plan is in my office
for reference.
Woodbury's physical development plans are consistent with Mapl ewood' s except in
the area of Transportation. Both plans propose an interchange in the vicinity
of Century Avenue and I -494. However, there is disagreement as to the specific
location. Mapl ewood' s . Transportation Plan proposes Century Avenue and I -494 as
the site, whereas, Woodbury proposes the intersection about one -half mile to the
southwest (see encl osed Maps) ,.
A second item of inconsistency concerns the classification of Century Avenue
south of Lower Afton Road. Mapl ewood' s Transportation Plan calls for a major
arterial and coll ector, whereas-, Woodbury' s Plan calls for a minor arterial.
This discrepancy will likely be resolved once a location for the proposed
interchange is agreed upon (See enclosed Maps) .
Recommendation
Authorize staff to forward the above comments to the City of Woodbury.

The City has approved a number of time extensions for preliminary plats in the past.
As the applicant's letter indicates, he is progressing with the final plat and
hopes to submit it shortly after the turn of the year.
It is not uncommon these days that development plans are curtailed due to the
present state of the economy. It is difficult, therefore, for a developer to have
a final plat prepared and submitted to the City .wi thin 90 days of preliminary
plat approval,
Recommendation
Approval of the 90 day time extension for the Schwi chtenberg Addition preliminary
plat, based on the following findings:
1. Council has approved a number of time extensions for preliminary plats in
the past.
2. There has been no change in the conditions of approval or the applicant's
willingness to comply with them to warrant denial of this time extension.

RE Transfer to Close the 19.79 Diseased Tree Project

PROPOSAL
It is proposed that the remaining cash balance in the 1979 Diseased Tree
Project 79 -6 be transferred to Project 77 -9 (Gervais Avenue Improvements -
Germain to White Bear Avenue).

The 1979 Diseased Tree Project has been completed, the assessments for it
were levied in. July 1980, and the final bills have now been paid, As of
October 31, 1980, the project had a cash balance of $91,229. This surplus
represents unused proceeds from the 1979 Temporary Improvement Bonds and
should be transferred to another project financed by the same bond issue.
The most appropriate one is the Gervais Avenue Improvements Project
(Germain to White Bear Avenue) as the right -of -way costs for this project
are higher than originally anticipated.
RECOMMENDATION
It is recommended that the Council authorize a transfer of the remaining
cash balance in Project -6 to Project 77 -9.

Proposal
It is proposed that Maplewood State Bank be designated as the official
depository for the City's checking account during 1981.
Background
Chapter 427.02 of the Minnesota Statutes gives authority to the City Council
to desi gnate at the beginning of each calendar year, or from time to time,
banks as depositories for City funds. Normally, the depository designation
has been acted upon by the City Council in December as it takes approximately
six weeks to have new checks printed.
It has been past practice for staff to request quotati from nearby banks
for checking account services. These quotations are expressed in terms of
the size of the compensating balance required to be maintained in the City's
checking account. During the past five years, Eastern Heights State Bank of
St. Paul was the depository from 1976 through 1978 and Hillcrest Mid America
State Bank of Maplewood has been the depository for 1979 and 1980. The
required compensating balance at Hillcrest Mid America State Bank for 1980
has been $25,000.
On October 21st, letters requesting proposals for 1981 banking services were
sent to Hillcrest Mid America State Bank, Maplewood State Bank, Northwestern
National Bank, and Eastern Heights State Bank. Each bank was requested to

Proposed Terms for Banking Services Agreement
1. Checking account services shall be provided free of charge when the
City maintains a compensating balance in the amount specified in the
bank's proposal. In the event a daily balance is less than required
compensating balance, the City will increase the next day's balance
above the required amount so that the average balance for the two days
equals the required compensating balance.
2. A special daily savings account shall be provided by the bank accord-
ing to the following terms:
a. All transactions of the special daily savings account
shall be transfers to and from the City's checking
account as directed by the City.
b. No minimum amount in the special daily savings account
shall be required.
c . ,Transfers to and from the special daily savings account
shall be in increments of $1,000.
d. The special daily savings account shall accrue interest
compounded daily and credited quarterly to the account
at an interest rate equal to the maximum allowed by the
Federal Reserve's Regulation Q.

Recently proposals were requested from three firms to con-
tinue the City's Aerial Mapping Program. The proposals
each addressed a similar final product, although some slight
differences in the method of approach did exist.
Two firms, Mark Hurd Aerial Surveys, Inc. of Minneapolis
and The Sidwell Company of Chicago submitted proposals with
very similar costs. The third firm Aero- Metrics Engine-
ering, Inc. of Sheboygan, Wisconsin was several thousand
dollars more expensive.
Since Mark Hurd and Sidwell had small cost differences
other factors were considered in the final choice of a con-
sultant. The decision to choose Mark Hurd is based mainly
on consideration of their local experience and that com-
munication may be better due to their location.
Based on the above considerations, it is recommended that
the City Council authorizes engaging Mark Hurd Aerial
Surveys, Inc. as the consultant to continue the aerial mapping
program.

In accordance with your visit of October 20, 1980 we are pleased
to furnish our proposal for photogrammetric services for the City
of Maplewood. Details are described below.
AREA
Our understanding of the area to be covered by aerial photography
will be the entire city as shown in blue on the attached map. The
area covered by ground control and mapping will be as shown in red
on the attached map. We estimate the mapping area to contain
approximately 2,700 acres.
AERIAL PHOTOGRAPHY
We will obtain aerial photography suitable for the performing of the
photogrammetric services described below. Delivery will consist of one

set of contact prints providing stereoscopic coverage and a photo index.
Panchromatic aerial film will be used.
GROUND CONTROL
We will establish the necessary ground control for mapping. Horizontal
control will be based on the State Plane Coordinate System. Vertical
control will be based on Mean Sea Level Datum.
During the course of our survey, we will establish horizontal stations
and bench marks for future references. These points will be properly
described references (horizontal), and shown on the maps we furnish.

MAP ACCURACY AND LIABILITY
By accepting this proposal, you agree that the work described herein
will meet your intended purpose. The use of these maps for a purpose
other than that which is originally contemplated may render the maps
unreliable.
Except where the ground may be obscured, map accuracy will comply
with National Map Accuracy Standards. Briefly, these state that 900
of all well defined features shall be correct within 1/30 inch and
90% of all elevations correct within 1/2 contour interval. If areas
are obscured, contours will be dashed to indicate that they are
approximate. The accuracy standards should be applied only to the
basic scale and contour interval (1" =100' and 2 -foot C.I.) for which
the maps were designed.
MARKHURD's liability, in the production or use of these maps, for any
inaccuracies that may be found in these maps shall be limited to the
correction of such inaccuracies, and shall not exceed the contract
value of the maps. No representations or warranties are made other
than those stated herein.

PERFORMANCE SCHEDULE
We will obtain aerial photography as soon after notice to proceed, as
ground and weather conditions permit, during the spring of 1981. Ground
control work will commence within 15 days after completion of photography.
The time required for delivery of the mapping will depend upon our
work load when the aerial photography has been obtained, and the number
of quarter sections ordered. We suggest that a mutually agreeable
schedule be determined at that time.
Our charge for the services described above will be as follows:
1. Aerial Photography $1,075.00 Lump Sum
2. Ground Control and Orthophoto Maps $1,310.00 Per 1/4 Section
3. Ground Control and Topographic Mapping $ 910.00 Per 1/4 Section
Payment of our invoices will be due within 30 days after delivery and
invoicing. We will-present our first invoice following completion of
the aerial photography and ground control. Invoices for mapping will
be submitted monthly, based on sheets completed and delivered.

It is a pleasure to submit this cost estimate for aerial photography and topographic
mapping in response to your recent request. We have based all our cost estimates
on the "Municipality of Maplewood" map supplied by your office.
All costs are based on delivering a final mapping product at a horizontal scale of
1 = 100' with two foot contour intervals. Final map sheets are anticipated as being
single composite map sheets consisting of a reproducible orthophoto base with com-
plete vertical topographic information (contours and spot elevations) superimposed
on it. All contours and elevations would be shown as black and white lines as per
the sample provided by your office. Mapping would be oriented to the Minnesota
State Plane Coordinate System and Mean Sea Level datum and final maps would be
produced in quarter section format.
We estimate the cost of obtaining aerial photography covering the entire corporate
limits of Maplewood to be $1,900.00. After photography has been obtained, ground
control and mapping could be performed on any quarter section or large area as the
need arises. We estimate the cost for obtaining all necessary g roun control for map
ping the shaded area on the attached map (approximately 17 quarter sections) to be
$7,300. 00 to $8,050. 00. The cost to map the same area after ground control is obtain-
ed is $9,950.00 to $11,000.00.
We have also estimated costs for providing ground control and mapping for the entire
area outlined in green on the attached map. We estimate the cost for obtaining ground
control for this area to be $8,950.00 to $9,900 and the cost to provide mapping
to be $21, 700.00 to $24, 000.00 .
Many of the municipalities we have dealt with in the past have purchased aerial photo-
graphy and ground control as a package and then during subsequent fiscal periods
have ordered mapping on an as- needed or funding available basis. With this in mind,
we have estimated the following cost. Once photography and ground control have
been purchased, the cost to map a single quarter section would be $1,455. 00. As more
quarter sections are ordered at one time, the per unit price will decrease..

be put into by said City. The Department further agrees to give the City written
notice thirty (30) days before the expiration of this lease of its intention to
vacate at the end of this lease, otherwise the City will have the option of
continuing this lease from year to year from such expiration without notice to the
Department. In the event the Department should cease to provide fire protection
to the district assigned in said fire protection agreement, this agreement is termi-
nated and the.City shall have immediate right of re- entry.
3. That said Department will keep said premises continually in a neat, clean
and respectable condition. The said Department will not make or suffer any waste
thereon or thereof and will not assign or underlet said premises or any part thereof
during the term hereof, and will pay all utilities or any other services used
thereon during the same time.

Subject: Liquor Violations by Bodell, Inc., 1690 White Bear Avenue,
Hearings on Bond Forfeiture and License Revocation, 8:45 p.m.,
November 6, 1980
Please refer to the attached Staff Report of October 10, 1980, concerning
liquor license violations by Bodell's Spirit Shop and Liquor Store, 1690 White
Bear Avenue. On October 3, 1980, Bodell's, Inc., entered guilty pleas for
offenses of underage selling on March 15, 1980, to a 16- year -old boy and on
August 21, 1980, to an 18 -year -old boy.
Several Municipal Code sections require action by the City Council. One is
as follows:
'The City of Maplewood Municipal Code Section 703.080, Paragraph 2,
which reads in part as follows:
"Bond (c) That in the event of any violation of
the provisions of any law relating to the business for which
the license has been granted for the sale of intoxicating
liquor, such bond shall be forfeited to the municipality in
which such license was issued."
The second Code section is 703.220 which reads:
"703.220. REVOCATION OR SUSPENSION. Any license granted hereunder
may be revoked or suspended for violation of any provision of this
ordinance or of the Liquor Control Act of the State of Minnesota.
An "on sale" license may be suspended or revoked by the City Council.
An "off sale" license may be revoked or suspended by the City
Council or by the State Liquor Commissioner. No license hereunder
shall be revoked or suspended until the Council has held a public
hearing pursuant to ten (10) days notice to the licensee and no
suspension may exceed sixty (60) days."
It's also appropriate to note Bodell's previous plea of guilty to underaged
liquor sales on February 27, 1980. This matter involved a sale to a 16-year-
old girl on October 20, 1979. In addition, the police staff has held several
meetings with the management and all the employees at Bodell's in the last
few months. Their responsibilities as licensee and employees were carefully
outlined to them. As a direct result of this, there have been four arrests by
Bodell's personnel of underage people attempting to make purchases of liquor.
It appears they are now exercising their responsibilities.
In view of the foregoing, it is recommended that the City Council consider the
following actions:
1. Forfeit the bond on each offense or in the lieu thereof
allow the licensee to make a cash payment of $290000

2. Consider suspension of Bodell's liquor license for seven (7)

The Police Department had instance to observe liquor law violations at
Bodell's Liquor Store, White Bear Avenue and East Larpenteur Avenue, on
three occasions as follows:
1. On March 15, 1980, a 16-- year -old youthful- look ling boy was
observed by an officer of this department exiting the Bo-
dell Spirit Corner Liquor Store, 1690 White Bear Avenue,
carrying one twelve pack and one six pack of Miller strong
beer. Investigation revealed he had purchased the beer
from Steven Boda, who did not request identification or
attempt to verify his age.
2. On August 16, 1980, an 18- year -old youthful - appearing
boy was observed by an officer of this department .exit-
ing the Bodell Spirit Corner Liquor Store, 1690 white
Bear Avenue, carrying; a six pack of Pabst and six pack
of Grain Belt strong beer. Investigation revealed he
had purchased the beer from a clerk who did not request
identification or attempt to verify his age. Addition-
ally, this youth had one six pack of Lowenbrau and one
six pack of Blatz strong beer in his possession in a a
motor vehicle which he he had purchased at Bodell's
Liquor Store earlier that evening.
3. On August 21, 1980, an 18- year -old boy was observed by
an officer of this department exiting the Bodell
Spirit Corner Liquor Store, 1690 White Bear Avenue,
carrying a case of Blatz strong; beer. Investigation
revealed lie had purchased the beer from a clerk,
Lucille Boda , who did not request identification or
attempt to verify his age.
Not guilty pleas were entered in Municipal Court on all violations and
trial dates set.
On October 3, 1980, all three cases were resolved by:
1. Bodell's, Inc., entered a guilty plea and was assessed
a fine of $50.
2. Charges against Bodell's, Inc., were dismissed by the
prosecution.
3. Bodell's, Inc., entered a guilty plea and was assessed
a fine of $50.
In view of the foregoing, I recommend the City Council forfeit the bonds in
cases #1 and #3. In addition, I recommend that the City Council set a license
revocation hearing date for cases #1 and #3 at an early time.

Subject: Proposed Franchised Liquor Operations
Currently Staff is reviewing a liquor license application for the County
Road D and White Bear Avenue area. In the process, we have developed that
while an individual is applying, he plans to enter into a franchise agreement
with M.G.M. Liquor Warehouse International, Inc., and to operate under that
name. This franchise would involve the licensee using M.G.M. Liquor Warehouse
name, business counseling and training, purchasing power and similar things in
exchange for four per cent of the gross sales fee.
The police Staff has met with several of the M.G.M. owners, Patrick Maglich
and Terry Maglich, along with their lawyer. They have furnished us with their
form of franchise agreement, a copy is attached.
In inquiring in several communities that they presently have agreements in
effect, it appears they have good grades for clean, efficient and acceptable
operations.. The experience in Bloomington, where Maglichs owned and - operated
a successful liquor store operation for a number of years, has been very good
according to their officials. Staff checked their store, which is located
about a mile west of City Hall, and found a large, clean, neat and well- stocked
store.
The question arises about the impact this type of operation will have on the
present licensed off -sale stores. In Bloomington, within a block of the M.G.M.
franchise, there are two small competitors, one of which opened after M.G.M.
opened. Bloomington officials inform us that they all seem to be able to
survive in the same market area.
This matter is called to your attention in view of the fact it is a new approach
to "off-sale" liquor operations, not only to Maplewood but to the industry.
Within several weeks the City Council will have to consider the license applica-
tion involving this approach.

AMENDING THE MAPLEWOOD CODE
RELATING TO
SEWER SERVICE CHARGES
THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Chapter 206.140 is hereby amended to read as follows:
206.141. RATES. The following rates and charges are hereby established
for all sanitary sewer services furnished by and in the City of
Maplewood:
(1) The quarterly residential rates shall be:

(2) Non - residential rates shall be as follows:

Class A customers are defined as those that maintain pri vate
sewer system lines on a site of at least 200 acres.
Class B customers are defined as all other non - residential
customers.
Non - residential sewer service charges shall be a minimum of
$5.80 quarterly per sewer service connection.
(3) The senior citizen rate shall be billed only to those that meet
all of the following conditions:
(a) Must be residential property occupied by no more than two
persons;
(b) One of the occupants must be the owner and billed directly
by the City of Maplewood;
(c) One of the occupants must be a least 65 years of age or
older;
(d) If occupied by two persons, the second occupant must be
at least 62 years of age or older;
(e) Annually after November 1st and before December 15th, one
of the occupants must file an affidavit with the City Clerk
stating that all of the conditions required in this ordinance
are applicable to his or her residence. In the case of
rental property, the senior citizen shall submit proof that
he or she is responsible for payment of the sewer service
charge.
Affidavits accepted and approved by the City Clerk at a time
other than that specified above, shall entitle the resident to
the senior citizen rate for each full quarter remaining in the
year not including the quarter during which the affidavit is
filed.

(4) The rate for properties used jointly for residential and commer-
cial purposes that are not metered separately shall be billed at
non - residential rates.
(5) In respect to property which shall be connected with the City
sewer system for the discharge and disposal of other residential,
commercial or industrial sewage waste, or any waste unusual ip
either character or amount, then in addition to all applicable
charges hereunder, the City Council reserves the right to impose
such supplemental sewage rate charge as said City Council shall
determine as reasonable and warranted on the basis of all
relevant factors.
w4 206.142. FLOW CALCULATIONS.. Annually during the month of December, the
Director of Public Works shall determine, for each property
billed at non - residential rates, the effluent discharged during
the preceding year. This amount shall be used to calculate the
sewer service charges for the current ,year.
For the purpose of determining the quantity of effluent discharged
from any property within the City of Maplewood,, the Director of
Public Works shall determine the lowest quarter of water usage
during the preceding year, either through direct water meter
readings, or if not metered, by reasonable estimating methods
(i.e. special metering devices, comparison to similar types of
land and water uses, etc.). The quantity of water used, as
determined or estimated above, shall be the quantity of effluent
discharged subject to the rate structure. However, if determined
by the Director of Public Works that the lowest quarter's water
usage during the preceding year does not reflect a reasonable
estimate of probable effluent to be discharged during the current
year, the Director of Public Works shall use any other equitable
and reasonable method to estimate the probable effluent to be
discharged in the following current year (i.e., special metering
devices of effluent discharged, total yearly or estimated yearly
usage, consumption minus estimated water usage not discharged
into the sewer system, comparison with similar uses , etc.).. All
new properties connecting to sanitary sewer and applicable to
the non - residential rate structure, as defined in this section,
shall be ass i nged an estimated quantity of discharge, by any of
the methods above which reasonably reflect such probable discharge.
Such estimated quantity shall be subject to the rate structure
herein defined, until the end of that year at which time the
Director of Public Works shall include such property into his
study of applicable properties under this paragraph.
206.132. STATEMENTS. All accounts shall be billed quarterly except for
those that have City utility billings totaling $600 or more per
year in which case they shall be b i l l e d monthly. Statements
shall be mailed to "occupant" at the address of the property except
for:
(a) Residents billed at the senior citizen rate;
(b) Properties for which someone other than the occupant
has requested to be billed.

206.144 DELINQUENT ACCOUNTS. There shall be added to all statements not
paid by the date indicated in Section 206.143 a delinquency charge
of one dollar or ten percent of the amount due, whichever is greater.
Annually by October 10th, the City Clerk shall deliver to the
Council for adoption an assessment roll providing for collection
of all delinquent amounts billed through the second quarter. Upon
adoption by the Council, these accounts, including penalties and
interest, shall be certified to the County Auditor for collection
with taxes during the ensuing year. Such action may be optional
or subsequent to taking legal action to collect delinquent accounts.
206.145. COMMENCEMENT OF SEWER SERVICE. CHARGES. Sewer service charges shall
commence on the date of application for an "Occupancy Permit" or
"Final Plumbing Inspection ", whichever shall be first. Failure to
obtain either of these permits, as required in the City Code, shall
be subject to the penalties of the code relevant to such permits,
penalties of Chapter 206, and retroactive billing made from the
date occupancy occurred as determined by the building official
206.146. NON- USAGE. Adjustments in billing for any property for non -usage
of the sewer service facilities may be granted by the City Clerk if
proof is submitted by the applicant that water service had been
terminated for a period of not less than 30 days.
Section 2. This his ordinance shall take effect and be in force beginning January 1,
1981.

Staff does not forsee any problems with this proposal and the neighbors have no objections. r
The City's main concern, though, with home occupations, is 'that they could potentially
grow into a nuisance situation. A one year time limit on the permit should be applied, F
after which time the City can review the permit. If there have been no complaints, the
permit may then be renewed for five years,
Recommendation
Approval of a home occupation permit for a sharpening service for one year. After one
year, if there have been no complaints , the permit may be renewed fQr five years.
Approval is subject to compliance with the criteria outlined in the Planning Commission's
Subcommittee Report on home occupations.
