Schaller Subject: Sale of Used Police Cruiser -- Additicnal Gas Metering System Proposal It is proposed that . the City Council support the purchase of additional gasoline metering equipment for the Police Department and authorize the necessary budget transfer from revenue received from the sale of our used police cruiser into account number 121 -4640 to cover the expense of this purchase. Background: At the present time the Police Department has a fleet of vehicles using unleaded gasoline, and we are only allotted five metering stations at the new City garage facility, requiring several vehicles to be on the same meter. This prevents any accurate accounting of gasoline usage. The Finance Department has indicated that they will be able to provide computer analysis of vehicle operating expenses when all of our vehicles have individual gasoline metering systems. The Engineering Department has indicated that they will be able to purchase the necessary gasoline metering equipment .for us at an approximate cost of $ 700, including installation. On April 8, 1980 the Police Department sold a used police cruiser for a net revenue of $845 t- hrough public bidding. Summary of Existing C = . ode Sections 904.060 (Residential- Single Dwelling) and 905.060 (Residential- Double Dwelling) state that accessory buildings are subject to a five foot setback regU i cement for side and rear yards, except as follows: a. Rear Yard - "not less than four feet where alleys are plotted". b. Side Yard - "Where a garage is located in the rear of a lot, not less than twenty feet (20 ft.) behind the dwell i nq, such garage may be built so that no. portion tl ereof is less than one foot (1 ft.) from the side lot line". Reasons fo Chang 10 Boundary disputes are encouraged when garages Care allowed to be built within one foot of a lot line. Since the City does not require surveys for building permits, the Building Inspectors may not be able to visually determine if a structure is on the Applicant's lot. This is parti cul arl.y a problem with a one foot setback. Increasing the setback to five feet would reduce the chance of boundary disputes. 2. Friction between neighbors may develop, due to stormwater running off a garage roof onto adjacent property. Increasing the setback would help to minimize the potential for such disputes. 3. The Building Code requires a one -hour fire wall and no wall openings, when a structure is less than 3 feet from a property line or within 6 feet of another structure. Assuming that a 5 moot setback were to be adopted, the maximum allowable overhang could be accommodated and still provide a 3 foot separation between building and lot line, eliminating the need and added expense of a fire wall. 4.. There is no reason for allowing a garage to be built up t0 four feet closer to a lot line than another accessory building on the same lot. The converse would be more appropriate from . a public safety perspective. I 50 Public Works requests that driveways maintain a 5 foot setback to p rovi de an adequate turning radius onto the property and to provide adequate area.for snow storage. 60' A . survey of several other communities revealed the predominant setback for side and rear yards to be at least 5 feet for accessory buildings. (See enclosed survey.) 7. Sections 904.060 and 905.060 allow a garage to be built with a side yard setback of one -foot, provided the structure is to be located at least 20 feet behind a dwel 1 i ng. If at a later date however, the homeowner desires to expand the home or garage into the required 20 foot separation, a variance must be approved. Rather than approving each variance request of this type, as has been done in the past, Staff recommends that the 20 foot separation requirement be eliminated and replaced with reference to the provisions of the Building Code. The Code does not establish minimum allowable separation distances, Rather, it requires the incorporation of more restrictive construction standards when placing a structure closer than 3 feet from a lot line or within 6 feet of another structure on the same - lot. 8. Adoption of a uniform 5 foot setback amendment. would cause garages with less than a five foot setback to be considered as non-conforming. The Planning Commission has in the past voiced a concern that status as a non- conformina structure would create a problem for those persons wishing to enlarge garages which were legal and conforming p`)-i or to amendment of the ordinance, Staff has considered this concern and proposes that .Section 912.010 of City Code (Non - Conforming lases) be amended to provide fo expansion of non-conforming accessory structures under specified ci rcums tali ces (refer to pace 4) . Past Actions The Board of Adjustments and Appeals has, in the past, approved variances to the 20 foot separation provision of Sections 904.060 and 905.060. The most recent examples are : - October 13, 1977: Darlene Karow, 1896 Barclay Street - an addition to her home, reducing the requi, red 20 foot separation to 8 fee t. -July 23, 1977: 0«ry Bumbach, 2256 -Craig Place W- an addition to his home, reducing the required separation to 8 feet. On September 19, 1977 Staff recommended adoption of a uniform 5 foot setback and elimination of the 20 foot separation provision of Sections 904.060 and 905.060. Applicant has not filed a deed for this split. 10. October 10, 1978: Applicant submitted. another plan to Staff for the future development of his proprty. (See enclosed map labeled "Future Development proposed by the Applicant (1978)". 1 l . January 18, 1979: Counci-1 approved a lot di Vi si on for a 110 by 143 foot lot at the southwest corner of his property, corresponding to lot 3 on his 1978 future Development Proposal, 2 K: 1,20 Joly 27 1979: Staff approved a lot division correspondin g to lot 2 on the applicant's 1978 Future Development Proposal. Council had previously approved a variance and similar lot division on May 20, 1976. The applicant asked the City Attorney to draw up l egal s for each of the lots shown on the enclosed map titled "Exi s ti n:g F roperty Line Map (1980)". These legal s were not to be recorded, but were only to be used for future applications. The County mistakenly recorded six separate parcels. The applicant would like to have these lots recombined and a lot division /variance approved for the northeasterly parcel Past Actions on other Area Properties 1 . 1956: Registered Land Survey 103 (see enclosed map titled "Existing Property Line leap (1980)" was recorded creating four buildable lots ranging from 11,250 square feet to 38,370 square feet. Lots "D" and "F" do not have adequate frontage on a paved public street. A variance would, therefore, be req.ui red. A recent court ruling on a sewer easement through these properties found that lots "D" and "F" are legally buildable, since they were recorded prior. to incorporation of the City and adoption of ordinances. 2. 12- 21. -72: Council approved a lot division for Mr. Harmon at 21.38 Arcade, splitting a long narrow lot into two parcels. The easterly parcel does not front on a paved public street. 3. December 4, 1975: Council approved a lot division for 2140 Arcade, splitting a long narrow lot into two parcels. The easterly parcel does not front on a paved public street, but does have access to a 10 foot wide, paved driveway, Planning Considerations l Land Use Plan designation: Residential Low Density, not to exceed 14 people Per net acre. This neighborhood has s ubs to r: ti al ly less density than allowed, because of the long, narrow lots. 2. Zoning : R-1. Single Dwelling Residential. The minimum lot size in this zone is 10,000 square feet 30 Section 501.020 of the City Code states that: "No building permit will be issued for any construction wi thin . the Village unless the building site is located adjacent to an existing street which is dedicated and maintained a-s a Village street, or unless provision for street construction has been made in full compliance with this code and in no case until grading work as provided herein has been completed and certified to the clerk by the Village Engineer; except that in isolated instances the Council may enter an agreement with a property owner for special handling of an unusual situation which agreement shall be recorded so as to run with the land, affected." 4. The proposed lot with the applicant's house would not have access to a paved public street if this lot split is approved.. 3 'P ublic Wor Con siderations The house at 2130 Arcade Street is connected to water and sewer. 2. A .sewer runs north and south through the middle of the site (sewer 72 -13) . 30 The City Council has stipulated that all newly created lots east of Arcade Street are to be assessed $2,644.51 for this sanitary sewer at the time of filing a lot split. The newly created lot will be adjacent to sanitary sewer 72-13. Ci ti zen Comments 19 A letter from Gordon Grant, the adjacent property owner to the north, is enclosed. 2. Esther Rylander, the adjacent property owner to the south, made the following comments: "I feel this would establish a dangerous precedent and encourage other such req.Ies is , endangering the interests of other property owners in the neighborhood." 3. The owners of 2128 112 Arcade, relatives of the applicant, have no objections. This is the new house on Arcade Street. Analysi s The. Ci ty has found it difficult to establish a consistent policy for the development of the area east of Arcade Street and south of Highway 36. A policy was adopted on November 20, 1975 limiting future development to existing streets and requiring full compliance with City Codes for lot sizes and frontage on improved streets. Six months later, in May, 1976, Council approved a lot division and variance for the applicant, creating a lot without frontage on a paved public street. Pre%,jious to the 1975 policy, there were seven lots east of Arcade Street without direct street frontage. There are an additional four lots with less than the Code required 60 feet of frontage on a public street. It is apparent that this is an unusual area that has not been developed according to the City's traditional standards. The proposed split is similar to other lots in the area and is almost identical to the variance and split approved by the Council n 1976. The purpose of the split .is to allow the applicant to sell his home and retain the balance of the property for future development.. Staff cannot see a problem with this as long as an easement is granted over the undeveloped property restricting future development without Council approval. Staff would recommend that any future house in the rear of, the property have access to a paved public street. If Council is concerned with the size of future lots on this parcel, the City should create an "estate 'lot" zoning district for this area. Under the present R -1 zoning, the applicant can develop 10,000 square foot lots, if he can provide a public street. As a part of this review, staf f was directed to prepare a stud on potential future development of I the area l g enerall y on the west side of Keller Lake between Arcade, Hi 36 and Roselawn. Area Characteristics The total area within the stud area is approximatel 50 acres. The t*e r -1- a kri is rollin with the rid and valle running , g enerall y north-south. The steepest g round is in the central portion with the g reate'st slopes (30-35%) adjacent - to the... .1a*ke-... Low and flat areas exis * t in the north adjacent to n the sewer lift statio and in the south around the Luebben Arboretum. T . he entire area is characteriz'ed b substantial mature tree g rowth, Ownership Pattern Presentl there ' are 31 separate parcels within the stud area and all but 12 of these have fronta on both Arcade and Keller Lake. Lot depths of the double fronta par-cels ran from 300. -350 feet at the extreme north and south ends to 800 feet at the center with the avera over 600 feet. Lot widths are narrow. The ran from a low of 67 feet (5 lots) to a hi of 237 feet with. the avera bein 100 to 125 feet. Sanitar sewer is in place in Arcade Street. Additionall a sewer line has been provided parallel to and approximatel 400 feet easterl of Arcade to service the central, internal portion of this area. At the time that the second sanitar sewer was installed the propert owners indicated their desire that the sewer serve onl the existin homes and that additional capacit be restricted. Therefore, if additional lots were to be developed an increased pumpin capacit would be needed for the existin lift station. A water . main is located in Arcade between County . Road B and Eldridge. CD Access Most of the homes in this area are located on the easterl sides of the lots ad l ake shore., and therefore g ain access b lon individual drivewa To provide access f or the complete area if such is developed into I conventional 10 to 15.,,000 s foot lots, -additional internal streets are necessary* It is possible to serve a portion of , the central section (approximately 600 feet in a north-south -dimension) b means of a looped street or two separate cul-de-sacs. Problems relative to installation of internal streets are terrain, poor soils, location of existing homes, tree g rowth and cost. The property ±o the west is 8 large undeveloped parcel with a single family home fronting on Radatz Avenue. It is zoned F, Farm Residential and designated for Low Densil'- Residential use on the Cit1Y Land Use Plan. Past Actions l. 5-11- 72: The Cftv Council denied a PUD for 15 acre parcel" which included the subject property. The PUO proposed a high rise, four 3 story apartments, an office building, and commercial developrient. 2. 10-21-74; Ajax Venture Company proposed a rezoning from F" Farm Residence to BC, Business Commercial Of the 5.3 acres of the subject property fronting On White Bear Avenue. This case was tabled by the Planning Commission for further study on the use of conditional zoning. 3. 4-21-75: The Planning Commission recommended denial of the rezoning. 4. 6-21-75: The City Council reviewed a proposal by Ramsey .County for acquisition Of Various properties adjacent to Ditch 18. The County proposes to acquire property in the general area of the subject property for drainage as well as open space purposes. As a part of this program, the County included the .westerly 2/3 of the subject property as part of that area to be acquired. The City approved the overall County project and further recommended the inclusion of the easterly 1/3 Of the subject property. Ramsey County sub- sequently did not include this additional five acres in the Ditch 18 program. 5. 7-l7-75: The City Council considered the re Based on the following find- ings, recommended by the Planning Commission, the Council denied the zone change: a. The proposed zoning would be contrary to the land use designation indicated in the Compreheneisve Plan; b. Staff feels that under our present`ordfnances, the four criteria under the RLE district are met. 3. The proposed densit is at the maximum allowed densit of 14 people/net acre. 4. The proposed density is based on defining the units as apartments, rather than townhOus Under our present ordinance, the units are defined as apartments. Staff feels that they should be defined as townhouses. Staff has proposed an amendment to clarify this definition. 5, The Land Use plan assumes , that townhouses produce more people than apartments. This means that the number of units proposed Would have to be reduced to keep the population density at 14 people/net acre, if these units were defined as townhouses. G. The east part of the property, where the office building is proposed, is desi foir LSC, Limited Service Commercia-1 use. 7. The subject property 1S zoned F,Farm Residential 8. The Ramsey-Washington Metro Watershed Board gave concept approval to this project On January 4, 1979 /see enclosed letter). 9. A permit will be required from the City by the Department of Natural Resources for the storm sewer outlets into the wetlands. The DNR also wants to review the final grad plan. lO. This makes it impossible to determine how much filling is proposed. 2. Several units are proposed to encroach on the'floUdplain. The flOodpldin shown 1s the ultimate level after construction of pOnd1ngfaCil The existing floodplain is below the ultimate level. 3. There is a significant wetland on the property that is part of the County Ditch 18 system. There is some minor enCroachment Of wetlands /See "edge Of ' swamp" line On the drainage plan). 4. The Soil Conservation Service has reviewed . this proposal and recommends approval, subject to conditions. They had previously recommended denial, but Changed their Opin1on after reviewing o Current plan. 5. Significant stands of trees are Shown on the Drainage Plan. Several large oaks are proposed to he removed. D. The Ramsey County Parks and Open Space Staff rev1ewed the proposed site plan and "would not recommend changing the previous decision to delete this parcel from the open space site" /See enclosed letter of 12-4-78\. Public Works ConSideratiOns l. Sanitary sewer is available for both office and residential use. Sewer is in White Bear Avenue and there are two Systems in Radatz Avenue. One flows east and One flows west. 2. The proposed grade of the westerly unit may be too low for Sewer service. This can be adiusted on the final plan. 3. Water will have to be extended from White Bear Avenue, along Radatz Avenue, ' and looped through the project to proposed Southlawn Drive and finally ' connecting to the existing line in Beam Avenue. 40 Public streets terminate at Radatz Avenue and White Bear Avenue. The question arises as to the ownership Of the water and sewer lines through the pUD. Staff recommends that the sewer and water main be dedicated to the public and the appropriate easements be obtained in acc with thefinal plan. 5. Radatz Avenue should be upgraded, including water and storm sewer. Southlawn Drive should be constructed from Radatz z to Beam Avenue. The purpose of this is to provide a proper street to handle the increased and existing traffic, to eliminate the high maintenance cost and safety hazard of a long dead end street, to provide better traffic circulation, and t0 loop the water 6. The Maplewood Drainage Plan proposes a series of ponds that inolude the wet- lands On the subject property. The Plan also proposes a storm sewer in R.adatz Avenue that would drain into these ponds. 5 . . �r '7. B Engineering has completed a preliminary design for the drainage system in the area (see enclosed report dated 12-17-78). The proposed floodplain is -'^the'5a�e as shown in the applicant's plan. The two proposed ponds are in- undation ponds, rather than storage ponds. Water would only pond during the heav storms. The natural marsh would be preserved for the rest of the y ear. 8. The second building from the east1S located within the high, water line of the proposed pond' g. The applicant is proposing to fill in part of the planned flOodplain and exCavate from other areas to maintain the same storage capaci ty. This should be shown on the final grading plan. Barr Engineering has stated that the proposed filling would have no significant affect on flood Storage capacity. lO. Therefore, we recommend that the flood level be established at elevation 915 with a minimum buildin level of elevation 916 adjacent to this pondin site,. This would re a restriction dike with a top elevation of 916. A 21-- inch corru metal pipe should be placed throu t1his dike to allow E. Staff is recommending modification Of the first two conditions as outlined in their report, Commf3sio�er Pellfsh said he thought with the original proposal, there was negative discussion as to having access to the site from White Bear Avenue from a traffic standpoint. This was one of the primary reasons for moving the access to Radatz Avenue. There woul d still be traffic congestion, only it would be a block or two north on White Bear Avenue, Secretary Olson Said the original plan did show e drive to White Bear 1n addftfnn to Radatz Avenue. The drive to White Bear was shown as part of the concept plan for the Office building and was not planned to be put in with the housing project. With the median in White Bear" there would be only right in, right out movement. Staff feels the best solution from a traffic standpoint would be to use either White Bear or the first drive on Radatz and then going out to Southlawn. Staff feels that Southlawn will become the main access via Beam Avenue, Mike McKenna, Realty Development Services, rev some of the past ' hiStbry of this development proposal. They thought the best access for the site would be by using Radatz Avenue on th!-:1 eastern and western portions of the site, He discussed the Grant applications that have been mode to try and off set some of the improvement costs required for the project. CDmmisSiomer Kfshel asked Mr. 11cKenna how they propose the ~ pro'ect be Served by utilities and streets unless the conditions remain f the original approval. ` Mr. McKenna said it could be done, in a number of ways. He did not think 30 to 35 cars would accelerate the deterioration of Radatz Avenue that much. Their most favorable Option would be to proceed as planned, to do the storm water improvements as originally proposed, do the water looping as originally proposed, but not build the new street, . gutter and water service in Radatz Avenue. The Staff has reviewed this matter and feels for pedestrian safety and vehicle turning and maneuvering safety this area. should be zoned and marked "No Parking Anytime." This proposal has been reviewed with the Bowl manager.rient, the Moose Lodge management and the two residents. in this area. They all concur that in the interest of safety it would be a desirable posting.
