CALL TO ORDER
A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council
Chambers, Municipal Building, and was called to order at 7:05 P.M. by Mayor Greavu.

approve the consent agenda Items 1 3 and 4 as recommended:

Approve the accounts (Part I - Fees, Services, Expenses Check register dated
February 11 and February 12, 1987 - $81,942.17 : Part II - Payroll dated

submitted.

Resolution No. 87 - 2 - 28
WHEREAS, the City Clerk and City engineer have presented the final
figures for the Water Service District No. 6 improvements, City Project
86 -03.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, that the City Clerk and City Engineer shall forthwith cal-
culate the proper amount to be specially assessed for such improvement
against every assessable lot, piece or parcel of land abutting on the
streets affected, without regard to cash valuation, as provided by law,
and they shall file a copy of such proposed assessment in the City Office
for inspection.
FURTHER, the Clerk shall, upon completion of such proposed assessment
notify the Council thereof.
4. Approve Easement Agreement - McKnight
Resolution No. 87 - 2 - 29
WHEREAS, Ramsey County has proposed to acquire the necessary temporary
slope easements for the reconstruction of McKnight Road from Larpenteur
Avenue to Highway 36 and from Beaver Lake to Conway Avenue, and
WHEREAS, the City of Maplewood is the owner of certain properties
along said route which Ramsey County has identified as requiring tem-
porary slope easements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA:
That the Mayor and City Clerk are hereby authorized and directed
to execute the proposed easement agreements with Ramsey County for con-
veyance of all necessary slope easements on City of Maplewood property
required for the reconstruction of McKnight Road and that said slope
easements shall be granted in consideration of the benefits received
from said reconstruction.

F. PUBLIC HEARINGS
1. 7:00 P.M., Variance : County Road B and Barclay (Apts.) 2140 and 2142 Barclay
Street
a. Mayor Greavu convened the meeting for a public hearing regarding the
request of William and Bonnie Gear for approval of a ten foot setback
variance to construct a row of apartment garages 10 feet from the south
lot line. Code requires 20 feet.
b. Director of Community Development Geoff Olson presented the Staff report.
c. Board Member Tom Deans presented the Community Design Review Board recom-
mended actions.
d. Mr. William Gear, the applicant, spoke on behalf of his request.
e. Mayor Greavu called for proponents. None were heard.
f. Mayor Greavu called for opponents. None were heard.
g. Mayor Greavu closed the public hearing.
h. Councilmember Anderson introduced the following resolution and moved its
adoption:
87 -2 -30
WHEREAS, William and Bonnie Gear applied for a variance for the
following- described property:
Block 17 of Sabin Addition to Gladstone and the Westerly 300 feet of
vacated Burke Street, lying between Barclay Street and Hazelwood
Avenues.
WHEREAS, section 36 -27 of the Maplewood Code of Ordinances requires
a twenty -foot landscaped area between a multiple - dwelling use and prop-
erty zoned R -1, single dwelling residential;
WHEREAS, the applicant is proposing a ten -foot setback, requiring a
variance of ten feet;
WHEREAS, the procedural history of this variance is as follows:
1. This variance was applied for on July 29, 1986.
2. This variance was reviewed by the Maplewood Community Design
Review Board on January 27, 1987. The Community Design Review
Board recommended to the City Council that said variance be
approved.
3. The Maplewood City Council held a public hearing on February 23,
1987, to consider this variance. Notice thereof was published and
mailed pursuant to law. All persons present at said hearing were

given an opportunity to be heard and present written statements
The Council also considered reports and recommendations of the
City Staff and Community Design Review Board.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the
above - described variance be approved on the basis of the following findings
of fact:
1. A sufficient landscaped screen is already provided south of
the proposed garages providing a substantial buffer.
2. Strict enforcement of the code would cause undue hardship, since
minimum setbacks and parking requirements would not be met if
the garages were moved to the north.
3. The property to the south is most effected and is owned by the
applicant.
Approval is subject to the replacement of the landscaped screen in a
manner acceptable to ordinance if the existing screen is ever lost.
Seconded by Councilmember Wasiluk. Ayes - all.
2. On -Sale Liquor Licenses - Fox and Hounds, 1734 Adolphus
a. Mayor Greavu convened the meeting for a public hearing regarding the
request of Robert James Mullen and Lloyd Arnold Urban for an On -Sale Intoxi-
cating Liquor License for the Fox and Hounds, 1734 Adolphus.
b. Acting Manager Ken Haider presented the Staff report.
c. Mr. T. Jay Salmen, attorney representing the applicants, spoke on
behalf of the request.
d. Mayor Greavu called for proponents. None were heard.
e. Mayor Greavu called for opponents. None were heard.
f. Mayor Greavu closed the public hearing.
g. Councilmember Anderson introduced the following resolution and moved its
adoption:

NOTICE IS HEREBY GIVEN, that pursuant to action by the City Council
of the City of Maplewood on February 23, 1987, an On -Sale Intoxicating
Liquor License was approved for Robert James Mullan and Lloyd Arnold
Urban, dba Fox and Hounds, 1734 Adolphus Street, Maplewood, Mn. 55117.

of the City Ordinances.

2. Park and Recreation Annual Report and 1987 Activity Report
a. Acting Manager Haider presented the Staff report.
b. Councilmember Joker moved to accept the Parks and Recreation Commission
Annual Report and 1987 Activity Report.
Seconded by Councilmember Anderson. Ayes - all.

1. Order Assessment Hearing - Arkwright Street Project 86 -12
a. Acting City Engineer Chuck Ahl presented the Staff report.
b. Councilmember Bastian intorduced the following resolution a moved its
adoption: -

WHEREAS, the Clerk and the Engineer have, at the direction of the
Council, prepared an assessment roll for the construction of Arkwright
Street, City Project 86 -12, and the said assessment roll is on file in
the office of the City Clerk;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA:
1. A hearing shall be held on the 23rd day of March, 1987, at
the City Hall at 7:00 P.M. to pass upon such proposed assess-
ment and at such time and place all persons owning property
affected by such improvement will be given an opportunity to
be heard with reference to such assessment.

2. The City Clerk is hereby directed to cause a notice of the
hearing on the proposed assessment to be published in the
official newspaper, at least two weeks prior to the hearing,
and to mail notices to the owners of all property affected
by said assessment.

WHEREAS, the Clerk and the Engineer have, at the direction of the

Road C Water Main, City Project 86 -04, and the said assessment roll is
on file in the office of the City Clerk;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA:

3. Feasibility Study - Beam Avenue Water Main - Project 84 -12
a. Acting City Engineer Ahl presented the Staff report.
b. Councilmember Juker introduced the following resolution and moved its
adoption:
87 -2 -34
WHEREAS, the City Engineer for the City of Maplewood has been
authorized and directed to prepare a report with reference to the im-
provement of Beam Avenue, west of T.H. 61 by construction of trunk water
main, and
WHEREAS, the said City Engineer has prepared the aforesaid report for
the improvement herein described;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, as follows:
1. The report of the City Engineer advising this council that the
proposed improvement on Beam Avenue, west of T.H. 61 by con-
struction of trunk water main is feasible and should best be
made as proposed, is hereby received.
2. The council will consider the aforesaid improvement in ac-
cordance with the reports and the assessment of benefited
property for all or a portion of the cost of the improvement
according to M.S.A. Chapter 429, at an estimated total cost
of the improvement of $282,650.00.
3. A public hearing will be held in the Council Chambers of the
City Hall at 1830 East County Road B on Monday, the 9th day of
March, 1987, at 7:10 P.M. to consider said improvement. The
City Clerk shall give mailed and published notice of said hear-
ing and improvement as required by law.

4. Order Feasibility Study, Larpenteur Avenue, Project 86 -27
a. Acting City Engineer Ahl presented the Staff report.
b. Councilmember Anderson introduced the following resolution and moved
its adoption:
87 -2 -35
WHEREAS, it is proposed to reconstruct Larpenteur Avenue from
Edgerton Street to I -35E and to assess the benefited property for all
or a portion of the cost of the improvement, pursuant to Minnesota
Statutes, Chapter 429,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA:
That the proposed improvement be referred to the City Engineer for
study and that he is instructed to report to the Council with all con-
venient speed advising the Council in a preliminary way as to whether
the proposed improvement is feasible and as to whether it should best be
made as proposed or in connection with some other improvement, and the
estimated cost of the improvement as recommended.

5. Order Feasibility Study - Roselawn Avenue Project 87 -01
a. Councilmember Bastian introduced the following resolution and moved its
adoption:

WHEREAS, it is proposed to reconstruct Roselawn Avenue from Rice
Street to Jackson Street and to assess the benefited property for all
or a portion of the cost of the improvement, pursuant to Minnesota
Statutes, Chapter 429,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA:
That the proposed improvement be referred to the City Engineer
for study and that he is instructed to report to the Council with all
convenient speed advising the Council in a preliminary way as to
whether the proposed improvement is feasible and as to whether it
should best be made as proposed or in connection with some other
improvement, and the estimated cost of the improvement as recommended.

a. Acting City Engineer Ahl presented the Staff report.

Amendment to Agreement for Consulting Services
a. Councilmember Anderson moved to approve.the following amendment to an agree-
ment for consulting services:
FIRST AMENDMENT TO AN
AGREEMENT FOR CONSULTING SERVICES
The parties hereto hereby agree that the Agreement for Consulting Services
which they entered into on December 24, 1986, shall be amended as follows:
A. Section A (Scope of Services) shall be amended by adding thereto
the following additional services:
"11. Assist the Mayor and City Council in determining the criteria
which will be used in evaluating the final group of candidates
for the Manager's position.
12. Contact appropriate references on each of the finalists for
this position.
13. Prepare a format and procedures for use by the Mayor and City
Council in interviewing the final group of candidates.
14. Assist the Mayor and City Council in conducting interviews
with the finalists and in their evaluation of the candidates
interviewed.
15. On behalf of the City, negotiate terms and conditions of
employment with the candidate selected for the Manager's
position by the Mayor and City council."
B. Section B. (Compensation) shall be amended by adding to the first
paragraph thereof the following additional sentence:
"The Consultant shall be compensated by the City for the
services described in Sections A -11 through A -15 of this
Agreement at a fee of Two Thousand Dollars ($2,000)."

2. Boy Scout Troop 42
a. Bill Domeier, 1761 Gulden Place and Tom Och from Boy Scout Troup No. 42
are working on badges and attended the meeting to observe. They also stated
Wakefield Park is becoming very "messy ".

K. COUNCIL PRESENTATIONS
1. Cable
a. Councilmember Anderson questioned when cable would be installed in City
Hall.
b. Staff stated when the frost is out of the ground.
2. Fire Station Tour
a. Councilmember Bastian stated there will be a tour of the City Fire
Departments on April 11, 1987 at 9:00 A.M.
3. Aerial Committee
a. Councilmember Bastian stated there will be a meeting of the Aerial Com-
mittee on Wednesday, February 25, 1987, to discuss new aerial equipment and
obtaining training facilities.
4. Waste Management Task Force
a. Councilmember Wasiluk stated the Recycling Committee met last Friday and
are scheduling a grand opening of the recycling center on April 4, 1987, at
10:00 A.M.

The Federal Revenue Sharing program. ended September 30, :1986. However, ' .
recently the City of Maplewood received .$3,674 of Federal. .Revenue Sharing
money. This payment resulted from. the allocation revenue sharing reserve
funds which : have been held for final adjustments to local governments,
This final payment was not anticipated i n . the 1987 Budget . In prior years;
budgets,. 'revenue shari ng money was transferred from the. City`! s Revenue
Sharing Fund to th.e General Fund to partly f i nan.ce the contracts between
the C ty - and. its three "fi re departments.. It would be appropriate to do
the same thing with the money received in 1987,
Therefore, it is recommended that the City Council authorize the transfer
of all Federal revenue sharing money received in 1987, plus accrued investment
interest, to the General Fund to partly finance the contracts between the City
and its three fire departments.

Construction Licenses with CNW Railroad
DATE: February 27, 1987
The construction of the trunk sewer main along the McKnight Road alignment
requires construction in the Chicago and Northwestern Railroad right —of —way.
Approval of this construction is contingent upon the city and railroad enter—
ing into an agreement, a copy of which is attached. The agreement stipulates
certain insurance requirements, which will be arranged with the contractor.
It is recommended that the council approve this agreement and authorize its
execution by the mayor and city clerk by passing the attached resolution.

SUMMARY
Request
Approval of a one -year time extension for the South oaks preliminary
plat for fourteen single- dwelling lots.
Reason for Request
The street and utilities have partially constructed. A
developer's agreement has been submitted to guarantee their
completion. A lien waiver from the applicant's contractor must be
submitted before the city will take over these improvements. Once.the
lien waiver issue is resolved, final plat approval can be granted.
The applicant believes this issue will soon be resolved, but not
before his preliminary plat approval expires on March 10 1987.
Recommendation
Approval of a one -yeas time extension for the South Oaks preliminary
plat, subject to the original conditions as amended on March 25, 1985.
In addition, the "wetland area" shown on the proposed final plat shall
.be. renamed "drainage easement" and the boundaries of the easement
shall be revised, as necessary, to comply with the final grading and
drainage plan.
BACKGROUND
Past Actions
3- 26 -84: Council granted approval to the Alternative B site plan
(Hillwood Drive as a through street.) -for the South Oaks preliminary
plat, subject to:
1. Dedication of the Hillwood Drive right -of -way with Phase II as a
through street. The land north and south of the right -of -way may be
designated
gnated as Block One, Lot Seven and Block Two, Lot One,
respectively or retained as one lot - -Block One, Lot Seven,
2. Dedication of three feet along the west boundary of the entire
site for the McKnight Road right -of -way.
3. Increasing the width of proposed Teakwood Court from 24 to 32
feet.
40 Signing the required developer's agreement and submission of the
required surety for construction of Teakwood Court and associated
improvements.
50 City engineer approval of final grading, drainage and utility
plans. The drainage plan shall provide for a two acre foot storm
drainage pond to serve the Teakwood Court properties.
6. Where slopes between 25 and 40 percent in grade are to be
developed, the following conditions shall be met.
a. Controls and protections must exist uphill from the proposed
development such that there is no danger of structures or streets
being struck by falling rock, mud, sediment from erosion,
uprooted trees or other materials.
b. The proposed development must present no danger of falling
rock, mud, sediment from erosion, uprooted trees or other
materials to structures downhill.
c . The city engineer may require the developer to provide a
soils engineer to certify the stability of potentially unstable
slopes.
7. Submission of an erosion control plan, which incorporates the
recommendations of the Soil Conservation Service, before the issuance
of any building permits.
3- 25 -85: Council approved a one year time extension subject to the
original conditions, except Condition One which was amended to read
( the underlined language was added.) :
16 Dedication of the Hillwood Drive right -of -way with Phase I as a

1000 feet of length. Variances of 275 and 225 feet are required,
Comments
This proposal raises two policy questions:
10 Does the public safety need to restrict the length of cul -de -sacs
outweigh the desire to save mature trees?
20 Should grading of wooded areas be roh ibi ted for the

of borrowing soil for fill.
Public Safety prefers cul -de -sacs to be limited to 500 to 600 feet of
length. The applicant's proposal would result in two cul -de -sacs that
would range from . 1225+ to 1275+ feet of length. The through - street
proposed by staff (page 18 ) would resolve public safety's concerns but
it would result in the grading of 5 to 14 percent more wooded area - - 5
percent if grading were prohibited for the sole, purpose of borrowing
soil for fill (page 18) and 14 percent if the applicant is per to
satisfy his fill needs with on -site soil (page 1y) .
Applicant's Proposal (page 17) .
Pluses: The least amount of site grading would occur and the most
number of trees would be saved.
Negatives:
.1. Upwards of 57 households would be limited to one area street
access. Typical cul -de -sacs contain 10 to 15 households.
2. Timely emergency vehicle response time could not be guaranteed to
all of these households, particularly in the event of a tornado or
blizzard.
3. The city attorney believes there is exposure for a lawsuit if a.
variance is granted and the excessive cul -de -sac length could be
attributed to a delay or non - delivery of emergency vehicle service.
4. A precedent would be set, making it difficult to deny similar
requests for long cul- de- sacs. This is a concern because of the large
amount of undeveloped property in the "leg" with similar physical
characteristics.
Staff's Alternative Proposal (page 18) :
Pluses:
1.. The two proposed 1225+ foot -long cul -de -sacs would be reduced to
one 400 -foot long cul-de-sac,
2. The number of households with one means of emergency vehicle
access would be reduced from 57 to 15.
3. The applicant would gain two lots.
4. Children could walk to a future school from the property to the
west without using Linwood Avenue,
Negatives: Depending upon the final grading plan, between 5 and 14
percent additional treed area would be disturbed .
Recommendation
1. Denial of a cul -de -sac length variance f or . Dah 1 Road in the
proposed Budd Kolby Second Addition preliminary plat dated 11- 20 -86.
(See the resolution on page 20.) Denial is on the basis that:

2. Deny the Budd Kolby Second Addition preliminary plat dated 11 -20-
86 (page 17 ) on the basis that Dahl Road exceeds the maximum length
for a cul -de -sac.
3. Approve a revised preliminary plat for the Budd Kolby Second
Addition, subject to the following conditions bein g met prior to final
plat approval:
a. Submittal to the director of community development of a
revised plat, drainage, utility and grading plans for a
development similar to the concept plan shown on page 18 of
the February 23, 1987, staff report.
b. The site may be developed in three phases, as follows:
(1) The 18 properties along Linwood Court and Linwood
Avenue
(2) Outlot B
(3) The properties along Dahl Road. There shall be no
phasing of the construction of Dahl Road. This phase
shall also not precede until street and utility
construction has occurred or is guaranteed from Dahl
Road to a through- street that is improved and main-
tained by the city.
c. Show a twenty -foot wide sanitary sewer easement from Dahl
Road to Out 1 of B.
d. A recordable quit -claim deed shall be submitted to the city
for a ten -foot -wide trail easement to be centered on the
sanitary sewer easement required in Condition c.

e. Submittal of a concept development plan for Outlot B. A
future lot line shall be centered on the easement required in
Condition c.
f. The southeast portion of Outlot A shall be revised to
provide enough area for a smooth transition of the walkway from
Jefferson Fourth Addition to Outlot A.
g. A recordable quit -claim deed (s) shall be submitted to
transfer ownership to the city for Outlots A and C.
h. Final grading, utility, erosion control and drainage plans
shall be submitted to the city engineer for approval. These
plans shall include, but not be limited.to:
(1) construction of a sanitary sewer from Outlot B to Dahl
Road.
(2) grading for the following trails:
(a) An eight -foot wide corridor from Outlot .A to
Dor land Road , not to exceed a seven percent grade,
The location within the easement shall be approved
by the city engineer.
(b) An eight -foot wide corridor from Dahl Road to the
future cul-de-sac that will provide access to Outlot B.
This trail shall not exceed 7 percent of grade. The
trail corridor shall be graveled to the west line of
Outlot B.
(c) Provision of level area of about 150 square feet
where the walkway from the Jefferson Fourth Addition
abuts the south line of this property. This area
shall be seeded and mulched.
(3 ) the grading plan shall specifically designate the
trees to be saved. These areas shall be identified on the
site before grading begins.
(4 ) grading shall not be allowed in areas with mature
trees for the sole purpose of borrow. Grading may occur
where construction is proposed.
i. A drainage easement shall be shown along the west fifteen
feet of Lots 43 -45 of the staff proposal.
j. A drainage-easement shall be shown on the plat fifteen feet
either side of the storm sewer south of Linwood Court. If a
drainage swale is to be constructed, the easement width shall
be determined by the city engineer.
k. A declaration of covenants shall be prepared by the
applicant and submitted to the director of community

development for approval. This document shall prohibit
driveway access from Linwood Avenue to Lots One - Six and Lot
Seventeen in the northeast portion of the plat.
1. Submittal of a signed developer's agreement and required
surety to include, but be. limited to:
(1) street and utility construction
(2) construction of an eight -foot wide trail from Outlot A
to Dorland Road. The trail shall be bituminous unless the
final grading plan shows a grade (s) compatible with wood
chips as determined by the parks director.
(3) removal of the barn located on proposed Lot .19
(4) removal of the accessory building that appears to
straddle the north line of Lot 19., unless evidence is
submitted from a land surveyor that this structure will be
at least five feet from all exterior property lines.
m. The words " Outlot B" should be contained within the area to
be designated as Outlot B.
4. Approve the resolution on page 22 to rezone the easterly portion
of this site from F, farm residence to Rl, single dwelling, on the
basis of the four standard findings and that this rezoning would
eliminate any potential nuisance problems associated with the F, farm
residence district, such as raising of livestock within a single-
dwelling neighborhood. (At least four votes in favor are necessary
for approval),

8- 21 -80:
Council conditionally approved the Schwichtenberg Addition preliminary
plat for single - dwelling lots and a large remnant which is included in
the present proposal. The following statement was included in the
staff report dated 7- 10 -80:
"The City will eventually require that Dahl Road connect to
a future Sterling Street or Linwood Avenue to P rovide two means
of access to the property. If the applicant does not find th i s
acceptable, he should plan to put Dorland Road through to
Linwood Avenue now."
11 -8 -82:
Council approved the Schwichtenberg Second Addition preliminary plat
( page 15 ) subject to eleven conditions that included:
"Prior to issuance of an occupancy permit, the developer
shall grade an eight - foot -wide trail within the storm water
easement adjoining Lot Eleven, Block One from Outlot C to the
.temporary cul -de -sac for Dorland Road. The alignment within _
the storm water easement shall be approved by the city engineer.
(A recommended trail alignment is illustrated on page 16 ) . if _
"Outlot C�shall be dedicated to the city for park. Dedicating
shall not be in lieu of PAC charges."

3- 10 -86:
Council conditionally approved the Budd Kolby Addition preliminary
plat (page 17). The Kolby plat was a revision of the Schwichtenberg
Second Addition. The changes included dropping the dedication of
Outlot C for a mini -park and realignment of the trail /utility easement
that would have been the access to the Outlot C park site.
10 - 20 -86:
The parks commission refused to support a plan amendment proposal to
drop the trail designation that crosses the applicant's site
( page 1 6). The commis also recommended that the tra i 1 plan
should be expanded to include an on- street trail along the Sterling
Street alignment between Highwood and Linwood Avenues.
Other sites
3- 25 -85:
1. Council gave preliminary approval to Cave's Lakewood Addition
subject to conditions including:
"Arrangement must be made for a street connection, with water,
sanitary sewer and storm sewer between proposed Lakewood Street
and Montana Avenue. A developer's agreement for private
construction or council ordering of the improvement must be
accomplished prior to application for final plat approval."
Construction of the street connection required right -of -way to be
obtained from an adjoining property owner (Hillcrest Development).
Without this street connection, Lakewood Drive would have exceeded
1000 feet of length.
2. Council approved a feasibility study for the construction of
Lakewood Drive and Montana Avenue across Hillcrest Development's
property. This study was dropped because Hillcrest Development
decided to sell the right -of -way and abutting property to Ed Cave and
Sons. The street was then constructed by Mr. Cave.

facilities are adequately secured as an intergral part of
servicing community development for securing increased fire
safety.
b. Page 17 -6: The city should provide and maintain efficient
ambulance service to assure prompt medical attention in emergency
situations.
7. Compliance with land use laws:
a. Section 462.358, Subdivision 6 states "Subdivision regula
tions may provide for a procedure for varying the regulations as
they apply to specific properties where an unusual hardship on

the land exists, but variances may be granted only upon the
specific grounds set forth in the regulations."
b. City code:
(1) Section 30 -11 (subdivision requirements) states "The
planning commission may recommend variations from the
requirements of this chapter in specific cases which in
its opinion, do not affect the general plan or the intent
of this chapter. Such recommendation shall be communicated
to the council in writing, substantiating the recommended
variations. The council may approve variations from the
requirements of this chapter in specific cases which, in
its opinion, do not adversely affect the plan and spirit
of this chapter." .
(2 ) Section 30 -8 ( 3 ) states "A cul-de-sac, when used, shall
be held to as short a distance as possible between the
origin or main street and the end of the cul -de -sac. In
no case shall a cul -de -sac exceed one thousand (1,000)
feet in length, unless no other alternative is possible."
(3) Section 30 -8 (8) states "When subdividing any land, due
regard shall be shown for all natural features, such as tree
growth, watercourses, historic spots or similar conditions,
which if preserved will add attractiveness and value to the
proposed development. The city council may require the
clustering of lots, such as with a PUD, to preserve natural
features." The applicant is opposed to any development
option other than single dwellings.
(4) Section 9 -191 (5) of the environmental protection code
states:
"a. Development shall be designed to preserve the
maximum number of healthy trees. This requirement
shall not apply to diseased trees-or where a forester
certifies that thinning is needed for the overall
health of a woodlot, in which case, a specific tree
removal plan must be approved by the city.
"b. If trees are cut, the density of trees shall be
restored to that which existed before development, but
in no case shall the applicant be required to raise the
density above ten (10) trees per acre, unless part of a
required planting screen. Any trees required to be
planted shall be varied in species, shall maximize the
use of species native to the area, shall not include
any species under disease epidemic and shall be hardy
under local conditions. Tree diameters shall be at
least two ( 2 ) inches,

which takes place will be conducted in a manner that
preserves the root zone areation and stability of
existing trees and provides an adequate waterin g area
equal to at least one-half (1/2) of each tree's crown
cover."
About 3/4 of the site i s wooded. Oak and an occasional aspen are the
predominant species. Trees with a trunk diameter of four inches or
greater occur about every 500 square feet. Refer to the map on page
g
for the wooded areas that would be disturbed as a result of the
applicant's and staff's site plan proposals.
A 25- foot -deep wooded ravine separates the applicant's proposed
westerly and southerly cul -de -sac. Filling of the ravine would remove
about .. 166 mature trees, assuming the one tree per 500 square feet is
an accurate estimate.
Many of these trees would, however, appear deformed with few branches
near the ground, if the surrounding trees were removed,

The south part of the site ( Lots 26 -41 on the map on page 18) probably
.cannot be served until sewer is extended from the Jefferson Fourth
Addition.

City Council of the City of Maplewood, Minnesota was duly called and
held in the council chambers in said city on the day of

The following members were present:
The following members were absent:
WHEREAS, Castle Design and Development applied for a cul -de -sac
length to construct a cul -de -sac in excess of 1000 feet of length in
the Budd Kolby Second Addition.
WHEREAS, section 30 -8 ( 3 ) of the Maplewood Code of Ordinances
restricts the length of cul -de -sacs to 1000 feet:
WHEREAS, the applicant is proposing cul -de -sacs of 1225and 1275
feet of length, requiring variances of 225 and 275 feet, respectively;
WHEREAS, the procedural history of this variance is as follows:
1. This variance was reviewed by the Maplewood Planning
Commission on March 2, 1987. The planning commission recommended to
the city council that said variance be .
2. The Maplewood City Council held a public hearing on
1987, to consider this variance. Notice thereof was published and
mailed pursuant to law. All persons present at said hearing were
given an opportunity to be heard and present written statements. The
council also considered reports and recommendations of the city staff
and planning commission.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL
that the above - described variance be denied on the basis of the
following findings of fact:
1. No unusual hardship exists on the land. A through - street can
be constructed.
2. The desire to save trees is outweighed by public safety
considerations. Streets once constructed are permanent. Trees are a
renewable resource.4
3. If the variance were to be approved, the resulting cul -de-
sacs would not be in keeping with the general plan or the intent of
the subdivision code because emergency vehicle response time to the
cul -de -sac lots would be impaired.

A public hearing has been called for March 9, 1987 at 7:10 p.m. for
the Beam Avenue Trunk Water Main Project. Notices have been sent to
all affected property owners along this frontage.
Attached is the feasibility report on providing water service to the
Beam Avenue area west of Trunk Highway 61. Three separate reports,
prepared by SEH, Inc., the city's engineering consultant, are attached
which address the costs of providing service to this area. The first
is the original feasibility report, dated January 14 1985, which
addresses the cost and construction of providing service through a
trunk water main from the railroad bridge on Beam Avenue to 1,200 feet
west of T.H. 61. The second report is a letter dated January 13, 1987
which updates the cost estimate of the 1985 report. The third report
in a letter dated February 13, 1987 addresses the construction and
cost estimate to provide water service to the area with a well, pump
and storage tank.
A comparison of the benefits between providing service with a trunk
main or with a remote pumping system revealed that the trunk main at
an estimated project cost of $270,000.00 would provide better service
than the remote pumping system which was estimated at $510 F 000. 00. In
addition the trunk main provides lateral water service to properties
fronting on the proposed route who can be assessed for a portion of
the project cost. The remote pumping system would require total cost
participation by the city since all properties served by this system
have been previously assessed for a water tower in City Project 75 -16.
Other reasons for not pursuing the remote pumping system are
additional costs for distribution system, land acquisition, annual
maintenance and power consumption, water quality problems and the need
for reserve or back -up facilities for emergencies.
The following financing proposals considers assessing benefited
properties west of T.H. 61 on a front -foot basis for the estimated
cost of an 8-inch lateral main. Based on recent projects on
McClelland Street, Ripley Avenue Crestview Drive and bids on Arkwright
Street and H i t lwood Drive it is recommended that $30.00 per front foot
be used as the lateral main equivalent rate. The properties on the
east side of T.H. 61 are not proposed to be assessed at this time due
to their swamp conditions and unknown development plans. If
development occurs on these parcels, a cash - connection charge would be
collected based upon the development plans. City participation is
proposed for the main ovens i z i ng and for extending the main to T.H.
61. Funds for the city's portion of the project are proposed to be as
a payment from the tax - increment fund through a revision of the
existing fund. Properties receiving water service stubs are proposed
to be assessed the actual cost of the service.

DATE: February 25, 1987
Attached is a street plan concept for Sterling Street from Mailand Road
to Highwood Avenue. The counci - 1 has ordered water improvements for this
area which will involve the construction of a water tower in the Linwood
Avenue area near Sterling Street. The trunk mains to service this tower
should be located in the Sterling Street right —of —way as a utility corridor.
As a guide, we have shown other concepts for streets connecting to Sterling
Street and also the preliminary plats approved in the area. The dark shaded
streets are preliminary platted streets, while the lighter shading is future
streets (Sterling Street and Hillwood Drive) to be constructed by the city.
The speckled shading is unapproved concepts that are shown only to indicate
how a street system may function.
It is recommended that the council endorse this street.plan so that the
tower and trunk water main feasibility report can proceed.

Supplementary Agreement No. 1
DATE: February 28, 1987
The city has a permit from the Minnesota DNR for an i nfringement upon a protected
wetland along the Sterling Street alignment south of Larpenteur Avenue. As a
part of this permit, the city is required to provide mitigative measures in other
areas to compensate for the disturbed wetland. The agreed upon measures are
located on the pondin project at Ivy Avenue and Ferndale Street, as shown on
the attached map. The mitigation is to construct nesting islands on Ponds 4
and 5 and expand the north and east slopes of . Pond 5 to 10:1 slopes.
The nesting island on Pond 5 and the expansion of the north slope of Pond.S has
already been accomplished through staking and quantity revisions to the existing
contract for Project 83 -07, North Beaver Lake Storm Sewer Improvements. The
Pond 4 island and east slope expansion will require a supplementary agreement
of the existing constructio contract. L & G Rehbein, Inc. has provided a bid
to perform this work for $27,414.00 under an agreement to the existing contract
for Project 86 -03. The contractor for Project 83 -07, c/m Barry Construction,
Inc., also submitted a bid for the work under a supplementary agreement of $77,909,00,,
It is recommended that the council authorize the mayor and city clerk to execute
a supplementary agreement with L & G Rehbein, Inc. for the construction of a
-- nesting i s l a n d in Pond 4 and expansion of the east slopes of Pond 5 for $27,414.G
by passing the attached resolution.

DIRECTING MODIFICATION OF EXISTING CONSTRUCTION.CONTRACT
WHEREAS, the City Council of Maplewood, Minnesota has heretofore ordered
made Improvement Project No. 86 -03B, Water Service District 6 Improvements
and has let a construction contract with L & G Rehbei n, Inc. therefore
pursuant to Minnesota Statutes, Chapter 429, and
WHEREAS, it is now necessary and expedient that said contract. be
modified and designated as Improvement Project No. 86 -03B, Water Service
District 6 Improvements, Supplementary Agreement No. 1.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA
that the Mayor and City Clerk are hereby authorized and directed to modify the

This amendment updates city code to provide for the new building code
just adopted by the state. Adoption of the state building code_ is
required by state law. The fee schedule and several optional chapters
are not required. All of the optional chapters included in the attached
ordinance have been previously adopted by the city, except for Chapter 7
of the Uniform Building Code (UBC) which . deal s with covered malls.
Chapter 7 i less restrictive than the general requirements of the UBC,
while still providing minimum safety standards. This chapter addresses
such things as automatic sprinkler systems, public address systems,
plastic panels and signs, standby power, exits and occupancy levels.
It would be an advantage to the Maplewood Mall.to have this amendment
adopted before their planned expansion this month.
Recommendation
Adoption of the attached ordinance.

AN ORDINANCE AMENDING THE SECTIONS OF CITY CODE
DEALING WITH THE ADOPTION AND ADMINISTRATION OF
THE STATE BUILDING CODE
THE MAPLEWOOD CITY COUNCIL DOES ORDAIN AS FOLLOWS:
Section 1. Sections 9 -21 through 9 -24 are amended as follows:
- Sec: 9 -21. Adoption of state building code.
The Minnesota State Building Code, established pursuant to Minnesota
Statutes 16B.60 through 16B.73, is hereby adopted as the building code
for the city and is a part of this code as completely as if fully set
forth herein. A copy of the building code shall be kept available for
p u b l i c use in the office of the b u i l d i n g official,
Sec. 9 -22. Adoption of optional chapters.
The following optional chapters of the Minnesota State Building Code
are hereby adopted by reference.
1. Chapter 1305.0150 Subpart 2:
UBC Appendix Chapters 1, 7, 38, 55 and 70
2. Chapter 1305.6905, Special Fire Suppression Systems with the option of

(a) The organization of the building - department and enforcement of
the state building code shall be conducted within the guidelines establisk.

department of the city. The administrative authority shall be a state
certified building official so designated by the city manager.
(c) The building official is responsible for the administration of

Sec. 9 -24. Permits, inspections and fees.
The issuance of permits, conduction of inspections and collection of
fees pursuant to this article shall be as provided for i n Chapter 3 of
the Uniform Building Code, except that a building permit shall not be
required for nonstructural, residential maintenance items such as the same
size replacement of doors, windows, the first or second layer of shi ng 1 es,
j trim or siding. Separate permits, fees and inspections shall be required
g' for all electrical, heating and plumbing. work regulated by the State Build—
ing Code. .
