A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council
Chambers, Municipal Building, and was called to order at 7:02 P.M. by Mavor Greavu.

Approved that (1) the portion of Project 78 -10 costs not assessed and
not paid for by the developer be financed by interest on the project
bond proceeds and (2) that the surplus in Project 78 -10 be transferred

Approved that (1) the cash deficit in Project 84 -4 be financed by a
transfer from the Hydrant Charge Fund and (2) that the sub -fund for this
project be closed by a transfer for the special assessments receivable to
the sub -fund for the 1986 Bond Issue that financed this project.
Budget Increase : Consulting Inspectors
Approved to increase Account 4480 -73 (fees for services - building inspec-
tions) by $34,400, to compensate for the deficit in that account, with
surplus revenues from the nonbusiness license and permits account.'
F. PUBLIC HEARINGS
1. 7:00 P.M., Plan Amendment and Rezoning : Radatz and White Bear (4 Votes)
a. Mayor Greavu convened the meeting for a public hearing regarding the
request of Dr. Alan Baumann for approval of a land use plan amendment from
RM, residential medium density, to LSC, limited service commercial, and a
rezoning from F, farm residence, to LBC, limited business commercial, to
construct a dental clinic.
b. Director of Community Development Geoff Olson presented the Staff report.
C. Commissioner Dave Whitcomb presented the Planning Commission recommendation.
d. A representative of the Baumann Dental Clinic spoke on behalf of the
proposal.
e. Mayor Greavu called for proponents. None were heard.
f. Mayor Greavu called for opponents. None were heard.
g. Mayor Greavu closed the public hearing.

h. Mayor Greavu introduced the following resolution and moved its adoution:

86-12-212
WHEREAS, Dr. Baumann, D.D.S., initiated an amendment to the Maplewood
Comprehensive Plan from RM, residential medium density, to LSC, limited service
commercial, for the property northeast of Radatz and White Bear Avenues.
WHEREAS, the procedural history of this plan amendment is as follows:
1. The Maplewood Planning Commission held a public hearing on December 15, 1986,
to consider this plan amendment. Notice thereof was published and mailed pursuant
to law. All persons present at said hearing were given an opportunity to be heard and
present written statements. The Planning Commission recommended to the City
Council that said plan amendment be approved.
2. The Maplewood City Council considered said plan amendment on December 22,
1986. The Council considered reports and recommendations from the Planning
Commission and City Staff.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL
that the above - described plan amendment be approved on the basis of the following fmdings
of fact:
1. Good access and high visibility are more important to a business than a residence.
This property is a corner lot on a high - volume street.
2. The traffic noise from White Bear Avenue would be more of a nuisance to a
residential, rather than a commercial use.
3. An office would beat least as compatible with adjacent uses as an RM use —traffic
would be relatively low and hours would be limited.
Seconded by Councilmember Bastian. Ayes — all.
i. Mayor Greava introduced the following resolution and moved its ado lion:

WHEREAS, Dr. Bauman, D.D.S., initiated a rezoning from F, farm residence, to LBC,
limited business commercial, for the following- described property:
Subject to White Bear Avenue and except north 520 feet and except east 455 feet part of
southwest 1/4 east of center line of said avenue and north of Radatz Avenue in Section 2,
Township 29, Range 22;
WHEREAS, the procedural history of this rezoning is as follows:
1. This rezoning was initiated pursuant to Chapter 36, Article VII of the Maplewood
Code of Ordinances.
2. This rezoning was reviewed by the Maplewood Planning Commission on

3. The Maplewood City Council held a public hearing on December 22, 1986, to
consider this rezoning. Notice thereof was published and mailed pursuant to law. All
persons present at said hearing were given an opportunity to be heard and present
written statements. The Council also considered reports and recommendations of the
City Staff and Planning Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL
that the above - described rezoning be approved on the basis of the following findings of fact:
1. The proposed change is consistent with the spirit, purpose and intent of the zoning
code and the comprehensive plan.
2. The proposed change will not substantially injure or detract from the use of
neighboring property or from the character of the neighborhood, and that the use of
the property adjacent to the area included in the proposed change or plan is
adequately safeguarded.
3. The proposed change will serve the best interests and conveniences of the
community, where applicable, and the public welfare.
4. The proposed change would have no negative effect upon the logical, efficient, and
economical extension of public services and facilities, such as public water, sewers,
police and fire protection and schools.
5. State law requires zoning be brought into compliance with the comprehensive plan
within nine months of an amendment to the plan.

2. 7:10 P.M., Plan Amendment and Conditional Use Permit: Ariel and Woodlyn - Salvation
Army (4 Votes on Plan Amendment)
a. Mayor Greavu convened the meeting for a public hearing regarding the request of
Bossardt Christenson Corporation for approval of an amendment of the comprehensive plan
from RM, medium density residential to C, church, and approval of a conditional use permit
for a church and adult daycare in an F, farm residence district.
b. Director of Community Development Olson presented the Staff report.
c. Commissioner Dave Whitcomb presented the Planning Commission recommendation.
d. Mr. John Bossardt, Bossardt Christenson Corporation, spoke on behalf of the Salvation
Army proposal.
e. Major Walt Winters, Salvation Army spoke on behalf of the request.
f. Mayor Greavu called for persons who wished to be heard for or against the proposal. The
following expressed their opinions:

h. Councilmember Bastian introduced the following resolution and moved its
adoption (Plan Amendment)

WHEREAS, Bossardt Christenson Corporation initiated an amendment to the
Maplewood Comprehensive Plan from RM, residential medium density to C,
church for property located at the southeast corner of Woodlynn Avenue and
Ariel Street.
WHEREAS, the procedural history of this plan amendment is as follows:
1. The Maplewood Planning Commission held a public hearing on
December 15, 1986, to consider this plan amendment. Notice
thereof was published and mailed pursuant to law. All persons
present at said hearing were given an opportunity to be heard and
present written statements. The Planning Commission recommended
to the City Council that said plan amendment be approved.
2. The Maplewood City Council considered said plan amendment on Decem-
ber 22, 1986. The Council considered reports and recommendations
from the Planning Commission and City staff.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the
above- described plan amendment be approved on the basis of the following
findings of fact:
1. Churches are typically located in residential districts.
2. Woodlynn Avenue is designated as a major collector street. This
designation allows for higher volumes of traffic.

i. Councilmember Bastian introduced the following resolution and moved its
adoption (Conditional Use Permit)

WHEREAS, Bossardt Christenson Corporation initiated a conditional use
permit for a Salvation Army Church and adult day -care facility at the
following- described property:
Northwest 1/4 of the Northeast 1/4 the West 165 feet of the South 366
feet Section 2, Township 29, Range 22, and also that part of the North-
west 1/4 of the Northeast 1/4 the West 527.26 feet of the East 263.63
feet of the South 320 feet lying south of Woodlynn and east of Ariel all
in Section 2, Township 29, Range 22.
This property is located at the southeasterly corner of Woodlynn Avenue
and Ariel Street.
WHEREAS, the procedural history of this conditional use permit is as
follows:

1. This conditional use permit was initiated by Bossardt Christenson
Corporation, pursuant to the Maplewood Code of Ordinances.
2. This conditional use permit was reviewed by the Maplewood Planning
Commission on December 15, 1986. The Planning Commission recommended
to the City Council that said permit be approved.
3. The Maplewood City Council held a public hearing on December 22,
1986. Notice thereof was published and mailed pursuant to law.
All persons present at said hearing were given an opportunity to be
heard and present written statements. The Council also considered
reports and recommendations of the City Staff and Planning Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the
above- described conditional use permit be approved on the basis of the following
findings -of -fact:
1. The use is in conformity with the City's comprehensive plan and with
the purpose and standards of this chapter.
2. The establishment or maintenance of the use would not be detrimental
to the public health, safety or general welfare.
3. The use would be located, designed, maintained and operated to be
compatible with the character of that zoning district.
4. The use would not depreciate property values.
5. The use would not be hazardous, detrimental or disturbing to present
and potential surrounding land uses, due to the noises, glare, smoke,
dust, odor, fumes, water pollution, water run -off, vibration, general
unsightliness, electrical interference or other nuisances.
6. The use would generate only minimal vehicular traffic on local streets
and shall not create traffic congestion, unsafe access or parking
needs that will cause undue burden to the area properties.
7. The use would be serviced by essential public services, such as
streets, police, fire protection, utilities, schools and parks.
8. The use would not create excessive additional requirements at public
cost for public facilities and services; and would not be detrimental
to the welfare of the City.
9. The use would preserve and incorporate the site's natural and scenic
features into the development design.
10. The use would cause minimal adverse environmental effects.
Approval is subject to the following conditions:
1. Adherence to the site plan, dated October 28, 1986, unless a change
is approved by the City's Community Design Review Board.
2. Installation of an adequate landscaping screen along the east and
south sides of the parking lot to satisfy the screening criteria
required by code.

2. Approval of plans by the Community Design Review Board does not
constitute approval of a building permit.
3. Any outdoor trash dumpsters shall be stored in screening enclosures
with a 100% opaque wooden gate and shall be a color and material
compatible with the building. Enclosures shall be protected by
concrete - filled steel posts, or the equivalent, anchored in the
ground at the front corners of the structure. If the enclosure is
masonry, the protective posts may be omitted.
4. Any exterior building or roof -top equipment shall be decoratively
screened and hidden from view. The screening material is subject
to Staff approval.
a. If any of the structures are damaged, they shall be
repaired as soon as possible but in no event longer than
90 days.
5. An erosion control plan, acceptable to the City Engineer, shall be
submitted prior to the issuance of a building permit for erosion
control during construction.
6. Parking areas shall be striped and all bituminous areas shall have
continuous concrete curbing. Parking lots shall be kept in a con-
tinual state of repair.
7. If construction has not begun within two years of approval, boalM
review shall be repeated.
8. Site security lighting shall be provided and shall be directed or
shielded so not to cause any undue glare onto adjacent properties or
roadways.
9. If any adjacent property is disturbed or property irons removed due
to construction of the site, that property shall be restored and
irons replaced by the applicant.
10. Grading, drainage and utility plans shall be subject to the City
Engineer's approval.
11. The applicant shall provide a monetary guarantee, in a form accept-
able to Staff, in the amount of 150% of the estimated cost of any
site improvements that.are:.not:completed by occupancy,

12. This approval is for the site plan only, A landscaping plan and
building elevations must still be approved.
13. Landscaping and screening shall be required on the east and south
sides of the parking lot to prevent headlight glare and to provide
a buffer, Screening shall be done in accordance with City ordi-
nance and will provide a buffer consisting of a berm on the east
and south property lines and as far as the berm, the C.D.R.B. will
specify the actual height and screen plantings on the berm.
14, Stop signs shall be provided at all exits.:
15. Sidewalks shall be installed on Ariel and on Woodlynn up to the
parking lot.

G. AWARD OF BIDS

H, UNFINISHED BUSINESS
1. Special Meeting Date on Petition for Project 86 -33
a. Acting Manager Ken Haider stated that at the December 8, 1986 Meeting,
the Council delayed setting a date for a special meeting to discuss the
procedure and impact of the developer of the Budd Kolby Second Addition's
request that the City install and finance the internal streets and utilities.
It is anticipated that Staff comments will be available on January 9, 1987.
b. Council established a meeting, Thursday, January 15, 1987, at 7:00 P.M.
2, Ordering of Hillcrest Trunk Sanitary Sewer Project 86 -22
a. Acting City Engineer Chuck Ahl presehted the Staff report.
b. Mayor Greavu introduced the following resolution and moved its adoption

WHEREAS, after due notice of public hearing on the construction of
trunk sanitary sewer and water main from Larpenteur Avenue and Sterling
Street south and westerly across the Hillcrest Development property to
Ivy Avenue and McKnight Road then south to Nokomis Avenue and McKnight
Road, City Project 86 -22, Hillcrest Trunk Sanitary Sewer, a hearing on said
improvement in accordance with the notice duly given was duly held on Octo-
ber 27, 1986, and the Council has heard all persons desiring to be heard on
the matter and has fully considered the same, and
WHEREAS, the Council tabled a decision to order the project to no later
than November 14, 1986, and
WHEREAS, on November 24, 1986, the Council approved a revised financing
proposal and extended the tabling motion;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, as follows:
1. That is advisable, expedient, and necessary that the City of
Maplewood construct trunk sanitary sewer and water main from
Larpenteur Avenue and Sterling Street south and westerly across '1
the Hillcrest Development property to Ivy Avenue and McKnight
Road, then south to Nokomis Avenue and McKnight Road, City
Project 86 -22 Hillcrest Trunk Sanitary Sewer, as described in
the notice of hearing thereon, and orders the same to be made.
2. The City Engineer is designated Engineer for this improvement
and is hereby directed to prepare final plans and specifications
for the making of said improvement.
3. The City Engineer shall negotiate and draft an agreement with
Hillcrest Development that conveys the necessary project ease-
ments on the Hillcrest property to the City and report back to the
Council for approval of the agreement.
Seconded by Councilmember Bastian. Ayes - all.
I. NEW BUSINESS
1. Parking Problems - Archer Heights
a. Mr. Arkadi Kask, a resident at 1816 Beebe Road, Archer Heights apartments
related to the Council the numerous parking problems the residents are ex-
periencing.
b. Council referred the problem to the Staff for investigation.
2. Petition for Lakewood Drive Street Lights - Project 86 -34
a. Acting City Engineer Ahl presented the Staff report.
b. Councilmember Anderson introduced the following resolution and moved its
adoption:

WHEREAS, it is proposed to construct street lighting along Lakewood
Drive from Larpenteur Avenue to Montana Avenue and to assess the benefited
property for all or a portion of the cost of the improvement, pursuant to
Minnesota Statutes, Chapter 429.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNE-
SOTA:
That the proposed improvement be referred to the City Engineer for study
and that he is instructed to report to the Council with all convenient speed
advising the Council in a preliminary way as to whether the proposed improve-
ment is feasible and as to whether it should best be made as proposed or in
connection with some other improvement, and the estimated cost of the improve-
ment as recommended.

3. Dege Garden Center
a. City Attorney John Bannigan presented the legal opinion regarding the City
reimbursing Mr. George Dege for removal of his garage.

4. 1987 Court Lease
a. Director of Finance Dan Faust presented the Staff report.
b. Mayor Greavu moved that Ramsey County be allowed to lease office space at
old City Hall on a month to month basis at the 1986 lease rate for six months
in accordance with Section XII of the current lease.

5. Increase in Ambulance Rates
a. Director of Finance Faust presented the Staff report.
b. Councilmember Anderson introduced the following resolution and moved its

WHEREAS, the City of Maplewood is authorized to impose reasonable charges
for emergency and paramedic ambulance services by Minnesota Statutes 471.476
and by special laws (Chapter 426, Laws of 1975, and Chapter 743, Laws of 1978);
and
WHEREAS, it is fair and reasonable to charge for services rendered based
upon the length of time services are provided between arrival at the scene
and arrival at the hospital or clinic.
NOW, THEREFORE, BE IT RESOLVED, that the following charges shall be
effective January 1, 1987:

BE IT FURTHER RESOLVED, that there shall be no charge for services

a. Councilmember Bastian stated Fire Marshal Jim Embertson and himself, plus
one representative from each department, were on the volunteer fire department
committee.

ORDINANCE NO. 600
AN ORDINANCE
AMENDING THE MAPLEWOOD CODE
RELATING TO
SEWER SERVICE CHARGES
THE COUNCIL OF THE CITY OF MAPLEWOOD DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Chapter 28 -21 is hereby amended to read as follows:
The following rates and charges are hereby established for all
sanitary sewer services furnished by and in the City:
(1) The quarterly residential rates shall be:
- 2 - 12/29
Single - Family Dwelling
$28.00
Townhouse
28.00
Duplex
56.00
Mobile Home
28.00
Condominium
28.00
Apartment
22.40
(2)
Non - residential rates shall be
$1.40 per 1,000 gallons.
Non - residential sewer service
charges shall be a minimum
of $5.90 quarterly per sewer
service connection.
(3)
The rate for properties used
jointly for residential and
commercial purposes that are
not metered separately shall
be billed at non - residential
rates.
(4)
In respect to property which
shall be connected with the
City sewer system for the discharge
and disposal of other
residential, commercial or industrial
sewage waste, or any

waste unusual in either character or amount, then in addition to all applicable
charges hereunder, the City Council reserves the right to impose such
supplemental sewage rate charges as said City Council shall determine as
reasonable and warranted on the basis of all relevant factors.
Section 2. This ordinance shall take effect and be in force beginning January 1,
1987.

I. NEW BUSINESS
1. Labor Agreements
a. Acting City Manager presented the Staff reports regarding the contract agreements
between the City and A.F.S.C.M.E. Clerical/Technical and the Maintenance units; and the
Metro Supervisory unit.
b. Councilmember Wasiluk moved to approve a 6 -month contract with A.F.S.C.M.E.
Clerical/Technical — Maintenance Union with a forty cent (40 2) increase per hour to the base
and add Martin Luther King Day as a paid holiday as recommended.

c. Councilmember Wasiluk moved to approve a 6 -month contract with the Metropolitan
SWervisory Union with a 3.5% increase and Martin Luther King Day as a paid holiday as
recommended.

a. Acting City Manager Haider updated the Council regarding the Joint Comparative Study.
K. COUNCIL PRESENTATIONS
1. City Hall - Locks
a. Councilmember Anderson requested Staff to investigate changing the locks on the front
door to City Hall as so many (such as contractors that were working on the building, etc.) had
keys.
2. Phone System
a. Councilmember Anderson requested Staff to look into improving the phone system.
3. Smoking Policy
a. Councilmember Bastian requested Staff to investigate the conditions of the smoking
rooms within City Hall.
4. Truth in Housing

b. Staff stated the City did not.

PROPOSAL
It is proposed (1) that a one -year agreement. with Maplewood State Bank for financial
services be approved as outlined in their proposal, (2) that Maplewood State Bank
be designated as the official depository for the City's demand deposits and (3) that
the necessary budget change be approved to finance the service.charges.
BACKGROUND
Chapter 427.02 of the Minnesota Statutes gives authority to the City Council to
designate at the beginning of each. calendar year, or from time to time, financial
institutions as depositories for City funds . Normally, the depository designation
has been acted upon by the City Council in December or January of each year.
It has been past practice to request quotati ons from local financial institutions
for checking account services. These quotations are expressed in terms of the size
of the compensating balance required to be maintained in the City's checking account.
Duri n ..the past five years, the .depositories have been Maplewood State Bank from
1982 through 1983 and First.Minnesota Savings Bank from 1984 through 1986. The
requi red compensating balance at Maplewood State Bank for 1982 was $35,000 and for
1983 was $97,000. At First Minnesota, for 1984 and 1.985, it was $3.7,000. In 1986,
First Minnesota was paid service charges in lieu of a compensating balance.
On December 10th, letters requesting proposals for 1987 banking services were sent
to all local banks and savings and loan institutions. These letters disclosed the
service .charges currently paid First Minnesota. Each financial institution was
requested to submit a one -year or two -year proposal based upon agreement terms
presently in effect at First Minnesota. Also, each financial institution was
requested to submit alternate proposals for a N.O.W. checking account and a Super
N.O.W. account.
Each financial . institution was also requested to submit a proposal for 1 or1 kbox services.
The l ockbox services are especially important to the City because a significant amount
of personnel time is saved in the City Clerk's Department by having a bank process
utility bill payments. Also, the 1 ockbox service makes the utility bill payments
available for investment more quickly. In the past, periodic delays occurred in the
processing of utility bill remittances due to variations in other work demands
(especially motor vehicle licensing) a:nd when key personnel were absent due to
illness or vacations. Also, the number of utility bill remittances vary greatly
each day with the majority being received after the 20th of each month. The timely
deposit of utility bill remittances via a lock box service has generated approximately
$4,00.0 of additional investment interest per year.
QUOTATIONS
In response to the letters requesting proposals, three propos.aT s were received.
The following is a comparison of the annual costs based upon service charges in
the proposals recei ved :

$99,500 for checking account services. and, $120,000 for 1 ockbox servi ces .
ANALYSIS OF PROPOSALS
All of the proposals received complied with the proposed terms outlined in the
Request for Proposal, except for minor deviations. Also, all three of the banks
that submitted .proposals have provided satisfactory services in the past. Therefore,
the annual cost of services is the key determinant of which bank shoul.d be the City's
depository.
The lowest cost proposal for checking account services is Town and Country Bank.
However, they did not indicate an interest in providing l ockbox services. Maplewood
State Bank was contacted to determine if they would provide l ockbox services alone,
and they indicated they 'would not. Therefore, the lowest cost alternative is for
Mapl ewood State Bank-to provide both checking a.nd l ockbox services. The alternative
proposal of Maplewood State Bank, to maintain a compensating balance in lieu of
paying service charges, is not feasible as the.service charges are less than the
interest that could be earned by i-nvesting i n. a. G ..N..M.A. mutual fund.
In order to finance the proposed contract with Mapl ewood ' State Bank, -a $5,690 budget
transfer from the General Fund Contingency Account. wi 1 i be needed for the checking
account services. When the 1987 Budget was prepared, it was undertai n if checking
account services would be financed. by a compensating balance or by service charges.
RECOMMENDATION
It is recommended ( a one -year agreement with Maplewood State Bank for financial
services be approved as outlined in their proposal. . (2) that Maplewood State Bank be
designated as the official depository for the City's demand deposits and (3) that the
necessary budget change be approved to finance the service charges.

Road Rescue includes a lifetime modular unit warranty. Three
years /36,000 miles electrical.
Fire Safety includes a 15 -year modular unit warranty and it's
not known as to electrical warranty.
Service
Road Rescue has local and proven service available.
Fire Safety provides service from the company in Duluth and at
our facili However, with major problems, the u n i t must be
brought to Duluth at our expense. As of this time, I am unable
to find a service that has an ambulance from Fire Safety in the
state so that I may establish r e l i a b i l i t y of service on their
part.

First Regular: At the first regular Council meeting in January of each year,

.designate the official newspaper, (3) choose an Acting Mayor from
the membership of the Counci who shall perform the duties of the
Mayor during the disability or absence of the Mayor, and (4) review
the Rules of Procedure of the City Council and make any necessary
changes if such changes are desired.
Section 2.
AGENDA FOR REGULAR MEETING
(1) All matters to be submitted to the Counci shall be filed not later than
12:00 Noon on the Monday prior to the Monday Council meeting at which con-
sideration is desired, and shall be delivered to the City Manager, or in
his absence, the City Clerk. I n unusual ci rcumstances and when the matter
does not require investigation, an item may be accepted after the deadline
upon the approval of the City Manager.
( 2) Except for' trivial matters, no item or business shall be considered for
action by the Council which does not appear on the agenda for the meet-
ing, except that an item or urgent business which requires immediate action
and is so determined by a majority of the Council may be considered by the
Council whether or not there is a full membership present. The Council
will hear all reasonable citizen petitions, requests and statements how-
' ever, such items. which do not specifically appear on the agenda shall be
deferred to a future meeting for more careful consideration and study if
Council action other than filing, i s required or requested.
The Mayor and each Counc i lmember shall be provided with a copy of the
agenda, m nutes of the previous meeting, and any other reports and in-
formation pertinent to the agenda at least seventy -two hours prior to each

Section 4.
MINUTES
(a) The City Clerk shall keep a record of all Council meetings.'
(b) Unless a reading of the minutes of a Council meeting is requested
by a member of the Council, such minutes may be approved without
reading i f each member has previously been provided a copy..
(c) The Council may, by motion carried by a majority vote, amend the
minutes. Such amending motion shall become a part of the minutes
of the subsequent meeting.
Section 5.
DUTIES OF THE PRESIDING OFFICER:
The presiding officer shall preserve strict order and decorum at all
meetings of the Council. He shall state every question coming before
the Council, announce the decision of the Council on all subjects, and
decide all questions or order, subject, however, to an appeal to the
Council in which event a majority vote of the Council shall govern and
conclusively determine such questions or order. He shall vote on all
questions and on a roll call vote rotate the order in which votes are
cast.
Section 6
RULES OF DEBATE
(a) The Mayor or other Presiding Officer may move, second and debate
from the chair, subject only to such limitations of debate as are by
the rules imposed 'on all members and shall not be deprived of any
of the rights and privileges of a Counc i 1 member by reason of his
acting as the Presiding Officer.
(b) Every member desiring to .speak shall address the chair, and upon
_ recognition by the Presiding Officer shall confine h ims 1 of to the
question under debate avoiding all personalities and indecorous

(f) The Clerk shall enter in the minutes a synopsis of the discussion
on any question coming in proper order before the Council.
• ADDRESSING THE COUNCIL
. Any person desiring to address the Council s hall first secure the p er-
mission of the Presiding Officer.
Each p erson addressing the Council shall give his name and address in an
audible tone for the records, and unless further time is granted by the
Presiding Officer, shall limit his address to five minutes, except at a
public hearing when the limit shall be ten minutes . All remarks should
be addressed to the Council as a body and not to any member. No person
other than the Council and the person having the floor, shall be permitted
to enter into any discussion, either direct or through a member of the
Council, without the perms i s i on of the Presiding Officer. No question
shall be asked a Councilmember or any member of the Administrative Staff
except through the Presiding Officer.
Section 8.
GENERAL RULES OF ORDER.
Robert's Rules of Order and Robert's Parliamentary Law shall be accepted
as an authority on parliamentary practice on matters not specifically
covered and in case of a conflict these rules shall govern.

present ordinances, resolutions. and other ratters or subjects to
the Council.
(b)
Every ordinance and resoluti shall be presented in writing and
read in full at a Council meeting; provided, however. that the
reading. of an ordinance or resolution may be dispensed with by
unanimous consent. Upon the vote on ordinances, -resolutions and
motions, the ayes and nays shall be recorded. The vote shall be
by roll call of all members of the Council as' provided under DUTIES
OF THE PRESIDING OFFICER in this resolution. A mojority vote of
all members of the Council shall be required for the passage of
all ordinances, motions and resolutions except as otherwise pro-
vided by law and except that amendments to the comprehensive plan

The Council is aware of the Court's action to initially reduce services
in the suburban courts and ultimately. consolidate the services to one
suburban l.ocati on . This has a dramatic effect on City costs and time
commitments for police officers It is in. the City's and the taxpayers
best interest to maintain the current service level at the Maplewood
court location.
Maplewood, No. St. Paul, White Bear Lake and New Brighton have each
obtained their City Attorney's opinion on the recent action of the Court
system. Each opinion agrees.there is no basis for the Court's actions.
The New Brighton City Attorney has prepared the attached resolution
objecting to the Court's actions. and authorizing en.teri,ng into legal
proceedings to resolve the issue.
It is recommended that Maplewood join with the other three cities in a
legal action to resolve the issue and contribute a maximum of $1,500
to pay the legal fees involved.

RESOLUTION AUTHORIZING LEGAL ACTION
CHALLENGING THE CLOSING OF RMISEY COUNTY
SUBURBAN COURTS AND THE TRANSFER OF
-CERTAIN COURT FUNCTIONS TO-THE
COURTHOUSE IN ST. PAUL
WHEREAS, the Ramsey County Court System presently includes
the holding of court in the cities of Roseville, New Brighton,
White Bear Lake, North St. Paul, and Maplewood (the Suburban
Courts) in accordance with Minnesota Statutes Section 488A.18
Subdivisions 10 and 13; and
WHEREAS, by Order dated December. 15, 1986, entitled "In Re:
The Phased Reduction of the Number of Suburban Court Locations"
the Chief Judge of Ramsey County District Court ordered the
administrative staff of the Ramsey County Courts "... to proceed
with all due dispatch to reduce the number of suburban sites at
which court operations are conducted. "; and
WHEREAS, by separate Order of the same date entitled "In Re:
The Relocation of Criminal and Traffic Jury Trials From Suburban
Court Locations to St. Paul," the Chief Judge of the Ramsey
County District Court ordered "... that all Gross Misdemeanor and
Misdemeanor matters previously scheduled for trial by jury at
suburban locations be scheduled at the St. Paul location. This
Order shall be effective concurrent with the commencement of the
new merged court assignment system this Spring. "; and
WHEREAS, the Council finds that the closing of the Suburban
Courts or the relocation of trials from the Suburban Courts to

the courthouse in St. Paul would cause inconvenience and in-
oroased expense to crime victims, a��.tnesses, �defer�dahts, police
. .officers, and other city personnel involved with law -enforcement;
would increase l enforcement costs to- the City; and would
generally make the court system less accessible to the public it
is designed to serve; and
WHEREAS, the Council further finds that it is in the best
interest of the public in general and the citizens of the City
that Court continue to be held in'the Suburban Courts and
WHEREAS, certain Cities in Ramsey County have indicated
opposition to the Court's plan and have authorized legal action
to prevent the closing of the Suburban Courts or the removal of
court functions therefrom;
NOW, THEREFORE, BE IT RESOLVED by the City Council. of the

Suburban Courts in Ramsey County and to the transfer of court
functions from the Suburban Courts to the courthouse in St. Paul,

I MEETINGS
A. All meetings shall be held in the council chambers in the
administration building, 1830 E. County Road B, unless

at least 24 hours notice will be given to all members.

fourth Tuesdays of each calendar month, provided that when

During th 1987 Budget preparation it was impossible to anticipate
the personnel needs for building maintenance. It was agreed to wait
until January 1, 1987 to assess the situation.
Th New City Hall, .one floor of the Old City Hall and the Public Works
Building require service at this time. I t i s anticipated this .situation
wi ll continue for some time: It has become obvious that the two full.-time
and one part -time janitors cannot be expected to adequately maintain this
much space Even the most routine items, like trashing and light floor
case-, are not always satisfactory. There is virtually no time available
for extended or special maintenance like stripping and ` wax - ing floors. In
addition, snow removal and grounds maintenance has not:yet required much
attention due to the mild weather.
It is recommended that a budget transfer from the Contingency Account be
authorized in. the amount of $21,580. This would fund an add i oval
full-time Building Maintenance Person . I n addition , i t is requested that
the City Council authorize hiring an individual to fill the proposed new
position.

SUBJECT: Code Amendment -- Siding Materials for Single Dwellings
DATE: January 21, 1987
A city resident has requested that Maplewood consider adopting
a code to require single 'dwe to be sided with acceptable
materials. (Refer to the attached letter.) T h i s person is
referring to a dwelling near 3M that has never been sided. This
dwelling only has tar paper covering the exterior walls. The
building official states that this situation can occur under the
present uniform building code requirements if an occupancy permit
is not needed for financing or where an owner — occupant is doing the
construction himself over a long period of time.
Recommendation
Direct staff to - investigate the need for a code amendment to
require the installation of acceptable exterior siding on existing
structures and to require a time period within which siding must be
installed on new constructiont
