Budd Kolby 3rd Addition: Final Plat Approved the Budd Kolby Third Addition Final Plat. F. PUBLIC HEARINGS 1. 7:00 P.M., Code Amendment - R -2 Lot Width (First Reading) a. Mayor Greavu convened the meeting for a public hearing regarding a proposed amendment that would "grandfather" R -2 double dwelling residen- tial lots that had a minimum lot width of 75 feet prior to December 9, 1985 (the date of the code change requiring a minimum of 85 feet). b. Manager McGuire presented the Staff report. c. Director of Community Development Olson presented the proposal in detail. d. Commissioner Albert Goins presented the Planning Commission report. e. Mayor Greavu called for persons who wished to be heard for or against the proposal. The following voiced their opinions: Carol Braden, 2056 Bradley Resident of 565 Skillman Richard Schreier, owner of a 75 foot lot zoned R -2 f. Mayor Greavu closed the public hearing. g. Initiate Public Improvement Project 1. Mayor Greavu convened the meeting for a public hearing regarding the request of Menard, Inc., for the following: a. A conditional use permit to add an exterior storage /sales yard within 350 feet of a residential zone. - 3 - 3/28 b. Authorization for fewer parking spaces than code allows. 395 spaces are proposed and 456 spaces are required. Other items to be discussed is an appeal from the Community Design Review Board recommendation and a request for Council to initiate a storm sewer project. 2. Manager McGuire presented the Staff report. 3. Director of Community Development Olson presented the specifics of the proposal. 4. Director of Public Works Haider presented the report regarding sewer improvement recommendations. 5. Board Member Marc Erickson presented the Community Design Review Board recommendation. 6. Mayor Greavu called for proponents. The following were heard: Mary Pnachaska, Vice President of Real Estate Menards, Inc. 7. Mayor Greavu called for opponents. County Road B A letter from Gregory Mach, Director of Ramsey County Parks and Recreation Department, was made a part of the record in which he voiced his concerns. 8. Mayor Greavu closed the public hearing. 9. Councilmember Anderson _introduced the following resolution and moved its adoption: f• 1� WHEREAS, Menard, Inc., initiated a conditional use permit to construct an outside storage yard within 350 feet of a residential district at the following— described property: Parcel 1: That certain triangular tract of land situated in the Southwest Quarter of Section 9, Township 29, Range 22, described as follows, to —wit: Commencing at a point on the East line of the Southwest Quarter of said Section 9 at its intersection with the Easterly line of United States Highway No. 61, as widened; thence south on the east line of said Southwest quarter to a point 100 feet north of the north line of County Road B; thence west and parallel with the north line of said County Road B to the easterly line of United States Highway No. 61, — 4 — 3/28 as widened; thence Northeasterlycalong the Easterly line of said United States Highway No. 61, as widened, to the point of beginning. This property is also known as 2280 Maplewood Drive, Maplewood; WHEREAS, the procedural history of this conditional use permit is as follows: 1. This conditional use permit was reviewed by the Maplewood Planning Commission on March 21, 1988. The Planning Com- mission recommended to the City Council that said permit be approved. 2. The Maplewood City Council held a public hearing on March 28, 1988. Notice thereof was published and mailed pursuant to law. All persons present at said hearing were given an oppor- tunity to be heard and present written statements. The Council also considered reports and recommendations of the City Staff and Planning Commission. NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that the above - described conditional use permit be approved on the basis of the following findings -of -fact: 1. The use is in conformity with the City's Comprehensive Plan and with the purpose and standards of this chapter. 2. The establishment or maintenance of the use would not be detrimental to the public health, safety or general welfare. - 5 - 3/28 3. The use would be located, designed, maintained and operated to be compatible with the character of that zoning district. 4. The use would not depreciate property values. 5. The use would not be hazardous, detrimental or disturbing to present and potential surrounding land uses, due to the noises, glare, smoke, dust, odor, fumes, water pollution, water run —off, vibration, general unsightliness,electrical interference or other nuisances. 6. The use would generate only minimal vehicular traffic on local streets and shall not create traffic congestion, un— safe access or parking needs that will cause undue burden to the area properties. 7. The use would be serviced by essential public services, such as streets, police, fire protection, utilities, schools and parks. 8. The use would not create excessive additional requirements at public cost for public facilities and services; and would not be detrimental to the welfare of the City. 9. The use would preserve and incorporate the site's natural and scenic features into the development design. 10. The use would cause minimal adverse environmental effects. Approval is subject to the following conditions: 1. Adherence to the site plan, dated March 15, 1988, unless a change is approved by the City's Community Design Review Board. 2. Materials in the storage yard shall be no more than 80% visible from the residential lots to the south. This may limit stacking heights or require a higher fence height. 3. Hours of operation in the storage yard shall be limited to 7:00 A.M. to 10:00 P.M. Seconded by Mayor Greavu. Ayes — all. 10. Councilmember Anderson moved to allow 395 parking spaces. All fencing shall be continually and properly maintained. Barb wire is prohibited. The fence along the south and east borders of the parking lot shall be decorative wood rather than metal. The fence shall be up to ten feet in height. — 6 — 3/28 2. Any change in sign location or area must be approved by the City. 3. All drives shall be 30 feet in width. 4. All trash dumpsters shall be stored in screening enclo- sures with a 100% opaque wooden gate and shall be a color and material compatible with the building. Enclosures shall be protected by concrete - filled steel posts, or the equiva- lent, anchored in the ground at the front corners of the structure. If the enclosure is masonry, the protective posts may be omitted. 5. Grading, drainage and utility plans shall be submitted for the City Engineer's approval. 6. A new sanitary sewer and service connections shall be con- structed from the building to the Metro interceptor. Easements shall be provided. The City shall reimburse Menard's for the cost. 7. Dedication of a utility easement from the existing sanitary sewer main at the southwest corner of the site to the MWCC interceptor. 8. All requirements of the Fire Marshal shall be met relative to the automatic fire suppression systems and alarms. 9. Site security lighting shall be provided and shall be directed or shielded so not to cause any undue glare onto adjacent properties or roadways. 10. If any adjacent property is disturbed or property irons removed due to construction of the site, that property shall be restored and irons replaced by the applicant. 11. The outside incinerator on the south side of the building shall be removed. 12. Since the developer proposes future development on the outlot, any future development shall comply with the requirements of the Shoreland Ordinance. 13. Restripe the parking lot to conform with the striping plan. 14. The City Engineer may require concrete curb and gutter where needed to channel water away from residential proeprty or the frontage road. A storm sewer shall.be constructed from the southeast corner of the site to the southwest corner of the site. The City Engineer may require surface drainage as an alternative if the storm sewer cannot be constructed because of William Brothers Pipeline. - 7 - 3/28 15. Install a fire hydrant in front of the building and another hydrant west of the storage yard, consistent with St. Paul Water Department standards. 12 16. The applicant shall provide a monetary guarantee in a form acceptable to staff, in the amount of 1509 of the estimated cost of any site improvements that are not completed by oc- cupancy. Seconded by Councilmember Rossbach. Ayes - all. Mayor Greavu introduced the following resolution and moved its adoption: 88 -3 -42 WHEREAS, it is proposed to construct trunk storm sewers and stormwater ponds to drain the area roughly bounded by U.S. Highway 61, State Trunk Highway 36, English Street and Burke Avenue (ex- tended) and to assess the benefited property for all or a portion of the cost of the improvement, pursuant to Minnesota Statutes, Chapter 429, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: That the proposed improvement be referred to the City Engineer for study and that he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimbated cost of the improvement as recom- mended. Harvester Avenue Storm Sewer, City Project 87 -31 - Schedule Public Hearing a. Manager McGuire presented the Staff report. - 8 - 3/28 b. Councilmember Bastian introduced the following resolution and moved its adoption: 88 -3 -43 WHEREAS, the City Engineer for the City of Maplewood has been authorized and directed to prepare a report with reference to the im- provement of Harvester Avenue at Sterling Street, City Project 87 -31 by construction of trunk storm sewer outlet, and WHEREAS, the said City Engineer has prepared the aforesaid report for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. The report of the City Engineer aavising this Council that the proposed improvement on Harvester at Sterling Street, City Pro- ject 87 -31 by construction of trunk storm sewer outlet is feasi- ble and should best be made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accordance with the reports and the assessment of benefited property for all or a portion of the cost of the improvement according to MSA Chap- ter 429, at an estimated total cost of the improvement of $83,900. 3. A public hearing will be held in the Council Chambers of the City Hall at 1830 East County Road B on Monday, the 25th day of April, 1988, at 7:00 P.M. to consider said improvement. The City Clerk shall give mailed and published notice of said hearing and improve- ment as required by law. Seconded by Councilmember Anderson. Ayes - all. 2. Meyer Street Watermain, City Project 87 -13, Order Public Hearing a. Manager McGuire presented the Staff report. b. Mayor Greavu introduced the following resolution and moved its adoption: 88 -3 -44 WHEREAS, the City Engineer for the City of Maplewood has been author- ized and directed to prepare a report With reference to the improvement of Meyer Street between Bush Avenue and Minnehaha Avenue, City Project 87 -13, by construction of water main, and WHEREAS, the said City Engineer has prepared the aforesaid report for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: - 9 - 3/28 1. The report of the City Engineer advising this Council that the proposed improvement on Meyer Street between Bush Avenue and Minnehaha Avenue, City Project 87 -13, by construction of water main is feasible and should best be made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accordance with the reports and the assessment of benefited property for all or a portion of the cost of the improvement according to MSA Chap- ter 429, at an estimated total cost of the improvement of $56,500. 3. A public hearing will be held in the Council Chambers of the City Hall at 1830 East County Road B on Monday, the 25th day of April, 1988, at 7:10 P.M. to consider said improvement. Highway 61 Watermain City Project 87 -44 - Schedule Public Hearing a. Manager McGuire presented the Staff report. b. Mayor Greavu introduced the following resolution and moved its adoption: 88 -3 -45 WHEREAS, the City Engineer for the City of Maplewood has been author- ized and directed to prepare a report with reference to the improvement of Trunk Highway 61 north of Kohlman Avenue, City Project 87 -44, by con- struction of water main, and WHEREAS, the said City Engineer has prepared the aforesaid report for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. The report of the City Engineer advising this Council that the proposed improvement on Trunk Highway 61 north of Kohlman Avenue, City Project 87 -44, by construction of water main is feasible and should best be made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accordance with the reports and the assessment of benefited property for all or a por- tion of the cost of the improvement according to MSA Chapter 429, at an estimated total cost of the improvement of $213,120. 3. A public hearing will be held in the Council Chambers of the City Hall at 1830 East County Road B on Monday, the 25th day of April, 1988, at 7:20 P.M. to consider said improvement. Mayor Greavu introduced the following resolution and moved its adoption: WHEREAS, the City Engineer for the City of Maplewood has been author- ized and directed to prepare a report with reference to the improvement of County Road C from White Bear Avenue to Ariel Street, City Project 86 -25 by construction of water main and services, sanitary sewer and ser- vices, storm sewer, sidewalk, and street with concrete curb and gutter, and WHEREAS, the said City Engineer has prepared the aforesaid report for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. The report of the City Engineer advising this Council that the proposed improvement on County Road C from White Bear Avenue to Ariel Street, City Project 86 -25 by construction of water main and services, sanitary sewer and services, storm sewer, sidewalk, and street with concrete curb and gutter is feasible and should best be made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accor- dance with the reports and the assessment of benefited property for all or a portion of the cost of the improvement according to MSA Chapter 429, at an estimated total cost of the improve- ment of $112,419.42. 3. A public hearing will be held in the Council Chambers of the City Hall at 1830 East County Road B on Monday, the 25th day of April, 1988, at 7 :30 P.M. to consider said improvement. The City Clerk shall give mailed and published notice of said hearing and improvement as required by law. Manager McGuire presented the Staff report. - 11 - 3/28 b. Jerry Fritsch, 845 Palm Court and James Vitale, 830 Palm Court, expressed the need for City water. c. Mayor Greavu introduced the following resolution and moved its adoption: 88 -3 -47 WHEREAS, the City Council has proposed that the area described as: Car -Don Estates, County Road C and Keller Parkway be improved by construction of watermain. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the proposed improvement be referred to the City Engineer, who is hereby instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and should best be made as proposed, and the estimated cost of the improvement as recommended. Seconded by Councilmember Anderson. Ayes - all. 6. S.A.C. Charge Refund Appeal a. Manager McGuire presented the Staff report. b. Mr. Frank Popplewell, the applicant, presented his reasons for requesting a S.A.C. charge refund. c. Councilmember Juker moved that no action be taken on the request. Seconded by Councilmember Rossbach. Ayes - all. 7. Electrical Permit Fees a. Manager McGuire presented the Staff report. b. Mr. Gunnar Pettersen, Electrical Inspector, spoke on behalf of the increase. c. Mayor Greavu moved to approve the Fee Schedule for electrical permits (A) Minimum fee for each separate inspection of an installation, replacement, alteration or repair limited to one inspection only $15.00 (B) Services, changes of service, temporary services, additions, alterations, or repairs on either primary or secondary ser- vices shall be computed separately: 0 to 100 ampere capacity 18.00 101 to and including 200 ampere capacity 22.00 For each additional 100 ampere capacity or fraction thereof 10.00 - 12 - 3/28 (C) Circuits, installations of, additions, alterations, or repairs of each circuit or sub - feeder shall be computed separately, including circuits fed from sub - feeders and including the equipment served, except as provided for in (D) through (K): 0 to and including 30 ampere capacity $ 5.00 (Maximum number of 0 to 30 ampere circuits to be paid on is 30 to any one cabinet) 31 to and including 100 ampere capacity 7.00 For each additional 100 ampere capacity or fraction thereof 4.00 (D) Maximum fee on a single family dwelling shll not exceed $75.00 if not over 200 ampere capacity. This includes service, feeders, circuits, fixtures and equipment. The maximum fee provides for not more than two rough -in inspections and the final inspection per dwelling. Additional inspections at the reinspection rate. (E) Maximum fee on an apartment building shall not exceed $35.00 per dwelling unit for the first 20 units and $30.00 per dwelling unit for the balance of the units. A two -unit dwelling, (duplex) maximum fee per unit as per single family dwelling. (F) The maximum number of 0 to 30 ampere circuits to be paid on any one athletic field lighting standard is ten. (G) In addition to the above fees: 1. A charge of $2.00 will be made for each street lighting standard. 2. A charge of $3.n0 will be made for each traffic signal standard. Circuits originating within the standard will not be used when computing fees. (H) In addition to the above fees, all transformers and generators for light, heat, and power shall be computed separately at $6.00 per unit plus 302 per KVA up to and including 100 KVA. 101KVA and over at 252 per KVA. The maximum fee for any transformer or generator in this category is $60.00. (I) In addition to the above fees, all transformers for signs and outline lighting shall be computed at $5.00 for the first 500 VA or fraction thereof per unit, plus 502 for each additional 100 VA or fraction thereof. (J) In addition to the above fees, unless included in the maximum fee filed by the initial installer, remote control, - 13 - 3/28 signal circuits, and circuits of less than 50 volts shall be computed at $4.00 per each ten openings or devices of each system plus $2.00 for each additional ten or fraction thereof. (K) In addition to the above fees, the inspection fee for each separate inspection of a swimming pool shall be computed at $20.00, reinfor- cing steel for swimming pools requires a rough -in inspection. City Project 87--21 feasibility studyr the developers in conjunction with the St. Paul Ski Cl ubr Inc. have proposed on April 4r 1988,r a privately executed plan to address the drainage concerns. BACKGROUND The engineering department has reviewed the proposed plans The following items were discussed as part of an alternative to the public improvement project, 1. A permanent 50 acre -foot storm water pond ing easement shall be dedicated to the City of Maplewood. The developers. Maplewood Highlands and Highwood Estates, shall procure the easement from the St. Paul Ski Clubs Inc. The developers shall arrange for and pay for legal costs of drafting the easements. The developers shall arrange for and pay costs of a registered land surveyor to determine a traverse around the proposed easement such that there is 50 acre -feet of storage within the bounds of the traverse available for storm water storage based on a field survey of the site* 2. A 14 acre -foot sedimentation basin shall be constructed within the proposed storm water easement. The developers are to pay for engineering and construction costs of the sedimentation basin. The City of Maplewood undertakes the responsibility of removing sediment buildup within the sediment basin such that sediment volume does not exceed three acre feet, 3. All storm sewers within the tributary area shall discharge to the sediment basin. The developers shall secure easement for the storm sewers and shall dedicate to the City of Maplewood. The developers shall pay all costs for engineering and construction of the storm sewers. 4. An access road is to be constructed from Sterling Street to the southeast corner of the ,sediment basin. The westerly 250 feet of the access road, which is proposed to be located on a steep grade, should be paved with a bituminous surface to prevent erosion,, The remaining access road is to have a gravel surface to avoid conflict with ski jump land areas, 5, A manhole, 24 inch diameter RCP gravity outf al i. and energy diss ipator shall be constructed from within the St. Paul Ski Club, Inc. property to the Interstate 494 ditch. This outfa l l will allow the St. Paul Ski Club. Inc. to convey the discharge from temporary pumps to the freeway drainage ditch without causing erosion problems. The developers shall construct the gravity pump discharge structure as approved-by the city engineer and MnDOT, 60 The City of Maplewood will apply to MnDOT for discharge of storm water to the freeway ditch. Private use of the discharge line shall conform to permit conditions established by MnDOT, 7e The developers shall construct needed improvements to the Interstate 494 ditch and culvert as requested by MnDOT. 82 The developers shall construct a wire fabric fence and gates on the west property line of the St. Paul Ski Club site, The fence shall extend to natural barriers on north and south ends. The gate shall deter unauthorized use of the pond access road. 98 The developers shall compensate the City of Maplewood for all engineering costs incurred by engineering department staff or consultants to date, The developers will be charged engineering time for review during construction of the foregoing items. The Ski Club has operated its ski jumping facilities on the site in question since 1949 with no problems due to high water in the ponding area or to excessive run -off. 2. On the night of July 23, 1987, the Ramsey Washington Metro Wstershed District reports that 8 inches of rain fell in the Carver Lake - Fish Creek area and that this rates as a 250 - 500 year event. Pictures of the area taken the next morning show that approximately one acre foot of water reached the ponding area, with the water level at an elevation of approximately 889 feet. The surface of the water . reached a point approximately 180 feet from the freeway fence and would not have interfered with any of the existing ski jumps or any proposed for the future. It is the Ski Club's position that, contrary to theoretical projections, this event defines the extreme condition that could occur under existing natural conditions and that the that the Ski Club facilities are in no way threatened by such occ:uranaes. The Club has repeatedly expressed the requirement that this condition continue to exist after development,. and is not requesting any "improvements ". Consequently, the proposed "improvements" are not necessary for the Club activities and do not benefit the Club. 3. Club detirminations indicate that the 100 year occurance would result in a pond volume of 11 acre feet, and that this volume could be contained behind a berm built 160 feet from the freeway fence and parallel to it. It is recommended that a berm be built in the above described location and to a height 14 feet above the current lowest point in the ponding area (an elevation of approximately 900 feet) . The volume behind this berm would be capable of holding 14 acre feet of run -off, and could accumulate 3 acre feet of silting before cleaning maintenance would be required. He has made a separate application for a home occupation permit to operate a heating, air conditioning and refrigeration repair business. Code restricts nonresident emplo to one. The nonresident emplo are self-emplo subcontractors that Mrs Donnell dispatches to the homes of his clients. The subcontractors stop at Mr. Donnell home once a. da for about 5 to 10 minutes to drop off invoices and client pa One. of the work items suggested b the p anning commission is a review of the permitted uses in the zoning ordinances • I[iiscussion This ordinance would make the following major changes: 1. Home occupation permits would be issued to indivi duals q through a I icense, rather than going. with the propert through a conditional use permit 2. Initiate an amendment to the code to "grandfather" in the lots that, were zoned R -2 and at least 75 feet in width on the date that the code. was amended to require 85 feet in width (December 9, 1985)o Discussion Staff would not object to a double dwelling on this lot if it was 85 feet wide. There are townhouses to the south and double dwellings across the street. In 1985, the city decided that a double dwelling should not be built on less than 85 feet of width. The state required finding of a hardship "unique to the property" cannot be. made . There are two other undeveloped, substandard, R -2 lots of 84 and 75 feet of width in this neighborhood. ( See the map on page .) There are other undeveloped, R -2 lots in the city with less than 85 feet of frontage. There are also single dwellings on R -2 zones with less than 85 feet of frontage that may consider remodeling to duplexes. The city should be careful not to set a precedent that would effect these situations It should also be noted that the applicant acquired this ro ert after p p Y the code was amended requiring 85- foot --wide lots for double dwellings. Recommendation Denial of a 2.7 -foot lot width variance for Lot 4, Block 1 Kodale Addition for the construction of a double dwelling, on the basis that: 1. There is no hardship caused the applicant due to circumstances "unique to the property." 2. This variance is not unique to this lot, There are two other undeveloped R -2 lots with substandard widths of 84 and 75 feet in this neighborhood. Approval of a variance would set a precedent for approving double dwellings on these lots. 3. The property can be put to a reasonable use - -a single dwelling. The three lots zoned R -2 to the north are also zoned R -2. 4. The basis for the variance is primarily economic. 5. The lot was substandard before the applicant purchased it. 2 CITIZEN COMMENTS Staff s urveyed the 33 surrounding property owners within 350 feet of this site. Of the 18 replies, four had no comment, four were in favor and ten objected, In Favor Comments 1. The variance in lot width isn't that much. I can't see why 2.7 feet would make much difference. ( Three r e p l i e s . ) 2. More rental property would add to the Maplewood tax base. 3. The property is properly zoned and I feel it would compliment the neighborhood. Objections 1. This lot is too small for a double dwelling. This property should be used for a single - family home. A double dwelling. would detract from our neighborhood. Stick to code. Staff Comment: According to the zoning map on page 7, R -2 zoning is common in this neighborhood. The majority of homes on the west side of this street are double dwellings. There are townhouses to the south. 2. There should be brick on the front and be sure aluminum siding is used so it blends with townhomes and does not end up looking like what is across the street in a few years Staff Comment: The design of the structure was approved by the design review board on 8- 25 -87. There will be aluminum siding, but no brick. Notices were mailed to the neighbors for this meeting. 3. The density in the neighborhood is too high already. We are already saturated with this type of housing. Staff Comment : The present density in the neighborhood is below the allowable density according to the Land Use Plan. Refer to planning considerations on page 4. Thirteen parcels that are zoned R -2 for double dwellings are presently developed with single - family homes. 4. It does not meet the law. Coon, Esq. Deputy General Counsel, NYS Dept. of State On June 9, 1987, the U.S. Supreme Court ruled in the case of First Evangelical Lutheran Church of Glendale v. County of Los An- geles that where land use regulations are found to be so restrictive as to constitute a "taking" of property, the landowner may recover moneyy damages for the period during which the regulation was im- P osed. Traditionally, where the government acts under its power of emi- nent domain to condemn private property, the just compensation clause of the Fifth Amendment of the U.S. Constitution has re- quired that compensation be paid to the owner. This requirement has now been .extended to include compensation for "temporary regulatory takings" (that is, land use regulations which are ulti- mately invalidated by courts as "takings "). The decision is an attempt by the Court to establish a balance be- tween the rights of landowners and the legitimate concerns of local governments for the health, safety and general welfare of their community. It is important to understand what the decision says and what it does not say. The decision holds that a landowner who claims that property has been "taken" by a land use regulation may recover damages for the time before it is finally determined by a court that the regula- tion is invalid as a "taking" of his property. The decision.does not hold that the ordinance which was the sub- ject of the case (a Los Angeles County flood protection ordi- nance) was in fact a "taking" of the landowner's property. It is absolutely essential to understand that the decision does not alter the traditional rules for determining when a regulation in fact constituted a taking. Those rules require the landowner to estab- lish that all reasonable use of prop erty, is denied by the regulation. Whether a articular reg does indeed constitute a "taking" P 9 9 depends upon the facts and circumstances of the regulation and the land involved. It is not at all common for courts to invalidate regulations as "takings." The Supreme Court decision did not change this. By its very nature, zoning may act in some circumstances to di- minish the economic value of real property. It is a well settled rule in decisions of New York's courts as well as those of the United States Supreme Court that a reduction in the economic value of / property -- even a substantial reduction -- because of zoning or other regulations does no in an o itself constitute a "t akin " in violation of the Constitution. Date AGENDA REPORT T0: City Manager FROM: Finance Director RE: Selection of Insurance Agents DATE: April 4, 1988 Annually, when the City requests proposals for property /casualty insurance, the process involves the pre-qualification of insurance agents and the assignment of markets, T h i s process involves requesting agents to complete a questionnaire listing their qualifications and the names of the insurance companies that they want to represent. The completed questionnaires are reviewed to determine which agents should be designated to receive the City's insurance specifications and which insurance companies that they should be given exclusive access to. Que stionnaires were mailed to our current insurance agent and one additional agent who had expressed an interest in providing insurance to the City. The latter agent is Hadtrath and Associates located in Minneapolis. No agent is used for the City's workers compensation insurance because the coverage is provided by the League of Minnesota Cities joint self- insurance plan. A completed questionnaire was received from both agents. A recommendation from our insurance consultant regarding the assignment of insurance companies to the agents will be distributed at the Council meeting on Thursday. Subsequent to this, I contacted Jerry Ekblad and gave him an opportunity to quote a revised fee to compete with the proposal from Hadtrath and Associates. (The questionnaires sent to agents did not ask for a quote on agent services charges. Also, both agents wanted to submit quotes for the League Program). Mr. Ekblad indicated that he would be willing to provide a net quote on the League Program and then charge a 5% service fee in lieu of a commission. He indicated that he thought Hadtrath and Associates had quoted the same fee based on information he received from another city. Since Jerry Ekblad has provided adequate services to the City and his fee is the same as Hadtrath and Associates, I recommend that his agency be assigned the League Program. Attached is our insurance consultant's recommendation regarding the assignment of other markets to each agency. I concur with the recommendation. Per the completed agency background questionnaires returned to the City, the following recommendation is made regarding each agency's utilization of markets. Ekblad, Pardee & Bewell, Inc. As the incumbent agency, it appears they have worked well with the City of Maplewood for the past three years. They are obviously familiar with the City and aware of the exposures involved. They have indicated three markets avail - able to them to quote the package (property /casualty) on the City. These being the current LMCIT program, Hartford ( Penco), and Reliance (Marinco). Because the LMCIT program can be satisfactorily handled and also discounted by either agency, as the current agency, Ekblad, Pardee & Bewell, Inc. will be given the opportunity to offer the City their best commission or fee for service require- ment involved with their servicing of the LMCIT program. Although the Penco program was indicated by both agencies, it is recommended that this agency be allowed to provide a Penco quote. The Hadtrath & Associates Agency has much closer ties with two other markets not offered by Jerry Ekblad's agency. It is also recommended that the following markets also be assigned to Ekblad, Pardee & Bewell, Inc.; Reliance (Marinco, Inc.); State Fund Mutual for workers' compensation coverage; Hartford and Travelers on the boiler; St. Paul, Auto Owners, and Travelers for bond coverage. BACKGROUND The feasibilit stud evaluates re for trunk storm sewer facilities to conve storm water from Footprint Lake to Gerte Pond north of Gervais Avenue. The feasibilit stud also identifies measures to correct existin serious draina problems at several other locations within the Footprint Lake draina area. The report does not address future lateral storm sewer needs. It is proposed to install lateral storm sewers in connection with future street with curb and g utter improvements as an incidental item. The function of the storm sewers identified in this report is to provide protection from floodin due to intense rainfall events. Separate cost estimates have been formulated for the trunk s and the two subareas, which are currentl experiencin si draina problems. It is feasible to order the construction of the trunk line between Footprint Lake and Gerten Po alone. It is not feasible to order the miscellaneous improvements alone without the construction of the trunk storm sewer. In the event that miscellaneous improvements were made without the implementation of the trunk sewerr, other problems ma be created or exacerbated elsewhere in the draina area. The draina problems on Cope Avenue have been included in this report since this area also outlets to Gerten Pond. This situation is markedl different in that modifications of the existin storm sewer s are re to remed existin problems. The recommended Cope Avenue improvements ma be independent of Footprint Lake s improvements. Due to the fact that this area was previousl assessed for storm sewer and Cope Avenue is an MSA router it is proposed to f inance the Cope Avenue improvements with MSA maintenance funds, BUDGET IMPACT It is proposed to f inance the Footprint Lake s improvements b assessment to propert within the draina area based on s feet. As noted previousl the Cope Avenue improvements in the estimated amount of $58#900 is proposed for fundin throu MSA maintenance funds. The assessment boundar is as shown on the map enclosed in the pocket of the feasibilit stud with the exclusion of areas 73P 74P 75• 76P 84 and 85. Within this area there is 13#165.vOOO s feet of propert which has not been previousl assessed for storm sewer. Based on implementation of Sherwood Park and Prosperit Avenue storm sewersp in addition to the trunk storm sewer between Footprint Lake and Gerten Pond as recommended# the amount to be recovered b assessment is $1,385P300. The assessment rate to recover this cost avera 10.52 cents per net s foot. It should be noted that it was not possible at this time to estimate the cost for an additional g radin g within Sherwood Park to provide for 12 acre feet of pondin within the park to supplement the stora capacit of Knucklehead Lake under a 100- - y ear rainfall event.
