Chambers, Municipal Building, and was called to order at 7:02 P.M. by Mayor Greavu.

2. Preliminary Plat and Variances - Bossard Addition
a. Director of Community Development Geoff Olson presented the Staff report.
b. Mr. Bill Bossard, the developer, spoke on behalf of the proposal. .
c. Mrs. Kate Fulk, daughter of the former owners of the property, Peter Moritz,
stated it was the understanding when the property was sold the house would be
removed.
d. Mayor Greavu called for persons who wished to be heard for or against the
proposal. The following were heard:
George Rossbach, 1406 E. County Road C
Fran Ronstad, daughter of Peter Moritz
Ray Pogue, 1516 E. Cope
e. Mayor Greavu closed the public hearing.
f. Councilmember Wasiluk moved to approve the preliminary plat and variance
for the Bossard Addition as requested
Seconded by Mayor Greavu.
Councilmember Bastian move that the _previous motion be separated and be
voted on individually

Plat subject to the following conditions being met before final plat approval
1. Payment of cash connection charges for water and sewer service.
2. City Engineer approval of final grading, utility and drainage
Plans. A developer's agreement shall be submitted, with the
required surety, for the utility connections and street restora-
tion.
3. Removal of all accessory structures.

h. Councilmember Wasiluk introdu the following resolution and moved its
adoption

WHEREAS, William Bossard applied for corner lot variances for the
following- described property:
This property is also known as 2291 Hazelwood Avenue, Maplewood;
WHEREAS, Section 30 -8 (f) of the Maplewood Code of Ordinances requires
at least 100 feet of corner lot width;
WHEREAS, the applicant is proposing 95 feet of width, requiring a vari-
ance of five feet for each lot;
WHEREAS, the procedural history of this variance is as follows:
1. These variances were reviewed by the Maplewood Planning Commission
on October 6, 1986. The Planning Commission recommended to the
City Council that said variances be approved.
2. The Maplewood City Council held a public hearing on November 10,
1986, to consider these variances. Notice thereof was published
and mailed pursuant to law. All persons present at said hearing
were given an opportunity to be heard and present written statements.
The Council also considered reports and recommendations of the City
Staff and Planning Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE 14APLEWOOD CITY COUNCIL that the above -
described variances be approved on th�i basis of the following findings of fact:
1. Strict enforcement would cause undue hardship because of circum-
stances unique to this property because:
a. Denying the variances would result in lot sizes that are
unreasonably larger than the code requires and that exist in
the neighborhood.

b. The plight of the landowner is due to circumstances unique to
this property, that were created by the previous platting.
C. The variances would not alter the essential character of the
neighborhood and would result in corner lots that exceed the
width of others in the neighborhood.
2. The variances would be in keeping with the spirit and intent of the
ordinances.
3. The City has approved similar variances in the past.
The variances are conditioned on sodding Lot Six to be compatible with
adjacent lots.
Seconded by Mayor Greavu. Ayes - Mayor Greavu, Councilmembers
Bastian and Wasiluk

Juker.
i. Councilmember Wasiluk moved to approve a variance for rear yard setback
of 19 feet.

3. New City Hall Dedication
a. Councilmember Juker moved budget transfer from the contingency fund in the
amount of $2300.00 for the City Hall dedication ceremonies
Seconded by Councilmember Wasiluk. Ayes - all.

1. Conditional Use Permit Renewal - 1810 E. County Road B (Fulk)
a. Director of Community Development Olson presented the Staff report.
b. Mr. Roger Fulk, the applicant, spoke on behalf of the proposal and re-
quested his hours of operation be from 5:00 A.M. to 10:00 P.M.
c. Councilmember Bastian moved to approve the renewal of the conditional
use permit for Roger Fulk, 1810 E. County Road B, to locate`: an M -1 use
within 350 feet of a residential zone for a one -year period and also moved
that the applicant can revise his hours of operation from 5:00 A.M. to 10:00
ew at the end of one ,

a. Mayor Greavu introduced the following resolution and moved its adoption
86 - 11 - 197
WHEREAS, the Burlington Northern corridor presents a unique opportunity
for local and regional transportation or recreational use;
WHEREAS, the ultimate use of this corridor will not be known for many
years; and
WHEREAS, the corridor will have to be purchased soon to preserve it.
NOW, THEREFORE, BE IT RESOLVED that Maplewood favors acquisition of the
corridor in such a way that as many options as possible are kept open.
NOW, THEREFORE, BE IT FURTHER RESOLVED that regardless of the eventual use
of the corridor, the City supports the following acquisitions;
1. Existing street crossings (City and County).
2. New street crossings north of Beam Avenue, at Gervais Avenue and
at Kohlman Avenue (City).
3. Highway 36 interchange (MnDOT).
4. Soo line trail crossing.
5. A trail crossing between Clarence Street and Harvest Park (City).
6. The cross -over corridor to the Soo Line for a new fire station (City).

a. Mrs. Kathy Juenemann, 721 Mt. �rnon, spoke in regards to the condition of
the house at 1980 Greenbrier.
b. Council directed Staff to review the situation and how the City Ordinances
would apply and report back.
7. Code Amendment : Wood Storage
a. Councilmember Bastian moved first reading of an ordinance regulating fire-
wood storage
Seconded by Councilmember Anderson. Ayes - all.
8. City Manager Evaluation
a. Councilmember Juker moved to accept the resignation of Donald L. Lais as
City Manager
Seconded by Councilmember Anderson.
b. Mayor Greavu read letters of support from the following:

C. Mrs. Kathy Juenemann, 721 Mt. Vernon, questioned the Council regarding
the hiring and now the firing of the manager.
d. Councilmember Juker revised her motion:
Councilmember Juker moved to accept the resignation of Donald L. Lais as
City Manager of Maplewood effective November 10, 1986, with the following
provisions
Paragraph No. 1 to remain as is
Clause No. 1: Severance pay under the February 5, 1986 Council memoran-
dum shall be provided on a bi- weekly basis until June 28, 1987.

Clause No. 2: Rights to continue hospitalization shall be governed by State Statue
No. 62.A17 as amended.
Clause No. 3: Waive any other claims of termination pay as listed under the
February 5, 1986 Council memorandum.
Clause No. 4: Waive the City's contribution to buy back P.E.R.A. as stated in
Council memorandum dated February 5, 1986.
Seconded by Councilmember Anderson. Ayes — Councilmembers Anderson, Bastian,
Juker and Wasiluk

9. Change Order —Hudson Place /Crestview Drive Project No. 85 -07
a. Director of Public Works Ken Haider presented the Staff report.
b. Councilmember Anderson introduced the following resolution and moved its
adoption:

WHEREAS, The City Council of Maplewood, Minnesota, as heretofore ordered
made Improvement Project 85 — 07, Crestview Drive - Hudson Place Water Main and has
let a construction contract therefore pursuant to Minnesota Statutes, Chapter 429, and
WHEREAS, it is now necessary and expedient that said contract be modified and
designated as Improvement Project 85 — 07, Change Order 1, bituminous curb placement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
MAPLEWOOD, MINNESOTA, that the Mayor and Clerk are hereby authorized and
directed to modify the existing contract by executing said Change Order 1.
Seconded by Councilmember Juker
Ayes — Councilmembers Anderson, Bastian,
Juker and Wasiluk.
Mayor Greavu abstained.

K. COUNCIL PRESENTATIONS
1. William's Pipeline
a. Councihnember Anderson questioned if the William's Pipeline Company do a
pressure test on the lines in Maplewood.
2. Retirement Insurance
a. Councilmember Anderson requested a report from Staff regarding retiree's medical
insurance.

3. Dog Ordinance
a. Councilmember Anderson requested a review of the dog ordinance relating to the
definition of when a dog is declared dangerous.
4. American Flag
a. Councilmember Anderson presented the City a Flag to be used on the main flagpole
outside of City Hall.

Severl major repairs have been necessary to the water system this y ear that
were not anticipated in the budget (i.e. failure of a $12.00 par=k which allowed
the Beebe Road booster station to f 1 ood, necessitating some $3,000 in repairs.
In order to meet these needs as well as any further major expenditures for
the remainder of this budget year it is recommended that the sum of $5,000
be transferred from -- ` -f �e unappropriat retained earnings to the water system
repair and maintenance budget.

Past Actions
This site:
12 -9 -85: Council approved a conditional use permit to authorize
Beaver Lake Lutheran Church to offer a preschool program for one
year, consisting of two sessions of twenty children each, and if
no unresolved nuisance conditions exist at the end of the year,
council may renew the permit.
Other:
11- 14 -83: Council granted the Montessori Academy Da Care

Facility (Beaver Lake Elementary School) a five -year time
extension at the end of its first year of operation.'
9- 17 -81: Council granted Holy Redeemer Church a five -year time
extension for their day care facility following the first year of
operation.
Planning
Section 36 -442 (e) of the city code states:
"All conditional use permits shall be reviewed by the council
within one year of the date of initial approval, unless such
_review is waived by council decision or ordinance. At the one -
ye ar review, - the council may specify an indefinite term or
.specific term, not to exceed five years for subsequent reviews.
The council may impose new or a d d i t i o n a l conditions upon the
permit at the time of the initial or subsequent reviews. A
Conditional use permit shall remain 'in effect as _lon g as the
conditions agreed upon are observed, but nothing in this section
shall prevent the city from enacting or amending official
controls to change the status of conditional uses."

PLANNING CONSIDERATIONS

business commercial (garden center site).
3 Applicable ordinance requirements:
a. Section 36 -17 (e) (2) states that no existing building or
premises devoted to a use not permitted in the district in which
such building or premises is located shall be enlarged,
reconstructed or structurally altered, unless there would not be
a significant affect, as determined by the city through a special
use permit, on the development of the parcel as zoned,
b. Section 36 -442 (b) provides that approval of a conditi.orla.l
use permit shall be based upon Conditions. On.e through Teri as
listed in the resolution (page 17) .
c. Section 36 -442 describes the procedures for review or
revocation of a conditional use permit. (Refer to page 14.)
d. Section 36 -6 allows residential garages u to 1 000 P square

feet in area. Garages may not exceed one story in height. The
proposed garage is 783 square feet and one story in height.
CITIZEN COMMENTS
Since construction began, staff has received complaints from three
neighboring residential households. The objections voiced were:
1. The new garage is in violation of the conditional use ermit

which was issued only to permit 28 off - street parking stalls.
20 The new garage will inevitably be used as an extension of the
garden center for business purposes, such as storin g supplies,
lies.
30 The garage detracts from whatever remaining residential. character

(e) All conditional use permits shall be reviewed by the
council within one year of the date of initial approval unless
such review is waived by council decision or ordinance. At the
one year review, the council may specify an . indefinite term or
specific term, not to exceed .five (5) years, for subsequent reviews.
The council may impose new or additional conditions upon the
permit at the time of the initial or subsequent reviews. A corndi-
tional use permit shall remain in effect as long as the conditions
agreed upon are observed, but nothing in this section shall pre-
vent the city from enacting or amending controls to-change

the status of conditional uses. Any conditional use that. meets the
agreed upon conditions and is later disallowed because of the city
enacting or amending official controls shall be considered a legal
nonconforming use.

occupation, other than one sign meeting the requirements of the cit

4. Limited retail sales of products produced off -site may be

ermitted but only when subordinate to the principal activity of the
home occupation.
5. No traffic shall be generated by a home occupation in
greater volumes than would normally be expected in a residential
neighborhood. The need for off - street parking shall not exceed more
than three off- street parking spaces for home occupations at any given
time, in addition to the parking spaces required by the resident
occupants.
6. No equipment or process shall be used in such home
occupation which creates noise, vibration, glare, fumes, odors or
electrical interference detectable to the normal senses Off the lot.
- In the case of electrical interference, no equipment or process shall
be used which creates visual or audible interference' in any radio or
television receivers off the premises, or caused fluctuations in line
voltage off the premises.
7. No fire safety or health hazard shall exist.
8. A home occupation shall not include the repair of internal
combustion engines, body shops, machine shops, welding, ammunition
manufacturing or, _other objectionable' uses as determined by the c i t y .
Machine shops are defined as places where raw metal is fabricated,
using machines that operate on more than one hundred twenty (120)
volts of current.
90 Any violation of these requirements shall result in the
denial or revocation of the home occupation.
100 Approval shall be for a period not to exceed one year.
Renewal shall be subject to the provisions of Chapter 17, Article II,
of the city licensing code.
NOW, THEREFORE, BE IT RESOLVED BY THE MAPLEWOOD CITY COUNCIL that
the above - described conditional use permit be on the
basis of the following findings -of- -fact:
1. The use is in conformity with the city's comprehensive plan
and with the purpose and standards of this chapter.
2. The establishment or maintenance of the use would not be
detrimental to the public health, safety or general welfare.
3. The use would be located, designed, maintained and operated
to be compatible with the character of that zoning district.
4. The use would not depreciate property values.
5. The use would not be hazardous, detrimental or disturbing to
present and potential surrounding land uses, due to the noises, glare,
smoke, dust, odor, fumes, water pollution, water run -off, vibration,
general unsightliness, electrical interference or other nuisances.

6. The use would generate only minimal vehicular traffic on
local streets and shall not create traffic congestion, unsafe access
or parking needs that will cause undue burden to the area ro er t i es .

Secretary Olson said the request is for a conditional use permit to operate
a reupholstering business as a home occupation. Staff is recommending approval
of the request as outlined in the report.
The commission questioned if the applicant is going to be doing limited
refinishing work, would a ventilating system have to be installed,
Seceretar y Olson said the fire marshal's office did review the proposal, there
was no comment on a ventilation system. He will check further-, however, before
th`i s request is reviewed by the council,
Jean Roberts indicated that the 20 percent of the area for the business would
be confined to the basement. She said the one hour separation .wall is almost
complete. She said she would be using a stripper and steel wool for the
limited ref i ni.shi ng work.
Chairman Axdahl asked if there was anyone else present who wished to comment
on the proposal.

Commissioner Whitcomb moved the planning commission recommend the city council

As per your request, the inside of the house at 1980 Greenbrier was inspected
relative to the rental housing code. The new occupants, Linda and Jeff Rader,
were quite friendly and let me in with little hesitation. The only thing
that came.close to a code violation was a missing wood strip on one bedroom
.window which Mr. Rader was in the process of fixing. The inside of the house
was actually quite nice.
The alleged broken basement window was not, in fact, a window at all but the
opening for the dryer vent which was now covered with a piece of plywood.
The garbage and brush were not all removed yet. As we told the owner to
remove it immediately on the 6th of November, I can write him a citation
on that.

Thank you for your recent letter regarding Edina Realty putting a sidewalk in
front of our building located at 2966 White Bear Avenue.
During the site approval process of our building, you may recall that we moved
our entrance on White Bear Avenue from the southwest corner of the property to the
northwest corner to help traffic control. This has worked out very well for Maple-
wood East and Edina Realty.
Upon receiving approval, it was noted that the City of Maplewood reserved the
right to take away our entrance on White Bear Avenue. When the Bruentrup property.
to the north is developed, White Bear Avenue is only accessible to north bound
traffic and is two lanes wide where our building is located. Our office is not a
retail type of building with heavy traffic. Most of our staff is in the office
during the day and we have a minimal amount of traffic from clients.
We have a mutual agreement with the Bruentrup property and when that is de-
veloped properties will be able to access White Bear Avenue from our drive -
,way.
I feel we have done our best to meet the city requirements regarding site
preparation, drainage, landscaping and all building codes. We feel very strongly
that if our access to White Bear Avenue is cut off at some time in the future, it
would be a great disadvantage to our business. I would like to request_ that this
provision be dropped by the city. Would you pass this request on to the proper
authority so the matter. can be resolved. We would appreciate a response in
writing for our files.
I agree that a sidewalk in front of our building would be to each of our
benefit and we will be happy to do so in the near future. We would hope that the
City of Maplewood views Edina Realty as a good business for the community. The
move to the new building has turned out to be very good for our firm. We have
increased our staff from 65 to 150 people since we have moved in and I feel this
is a definite plus to our area. Hopefully we can play a small part in helping
Maplewood be one of the top cities in our area.

REQUEST

Authorization is also requested to purchase addi ti ona1 off i equipment for
this position.

During meetings with the Council regarding the 1987 Budget, the need for,addi-
ti oval secretarial help for the City Manager. and Finance Director was explained
and. discussed Currently the City Manager 'and Finance Director share one
secretary. This level of staffing. is about 50/ of that in other departments
as most department heads have a full-time secretary. Asa result, the City
Manager and Finance Director often perform tasks more suitable for a secretary.
Another related problem is lack of phone coverage. This is especially true when
the secretary is away from her desk. Also, better coverage of the City Manager's
reception area is needed so that visitors don't have to wonder what to do if the
office is empty when they arrive,
The new secretary position author'i zed i n the 1987 Budget is jointly financed by
the City Manager's and Finance Department budgets Therefore, the new secretary
would do work. for both the City Manager and the Finance Director, However, the
current secretary would work prfmar ly for the City Manager and the new secretary
would work primarily for the Finance Director.
The 1987 Budget includes an appropr*i ati on for off ice equipment needed for the new
secretary. The budget incl=udes $875 for a desk and ch.arr, $840 for the purchase
and instal 1 ati on of a - phone, and $1,000 for a typewri ter. Authorization is
requested for the purchase- of the desk, chair and phone for delivery by January 5th.
Regarding the typewriter, 'it has been `determined that a terminal tied into the new
computer system would be more appropriate as it would have word processing capa-
bilities. Therefore, authorization is requested to use the $1,000 originally
appropriated for a to purchase a computer terminal instead.
RECOMMENDATION
It is recommended that the Council authorize:
(a) the hiring of a full -time permanent secretary for the Finance Director;
(b) the purchase of a desk, chair and phone for delivery by January 5th;
(c) the purchase of a computer terminal with word processing capabilities in
place of a typewriter.

It should be noted that the community development 'department i s
one of the most demanding departments on clerical time in the
city. In 1985 alone, the clerical staff typed 285 planning
reports, agendas and minutes for three permanent commissions and
two ad -hoc committees, took 613 building permits, answered over
.8 telephone calls, produced monthly building permit reports.
and typed numerous letters. In addition, the same three employees
handled all the telephone calls, correspondence, memorandums grid
reports from the.public works department.
2. Problems
The excessive workload is delaying all but the most important
clerical work. Higher paid, noncler ical personnel must then do
this work themselves. Likewise, when clerical eo le are sick on

vacation or typing rush jobs, nonclerical people must answer
telephones. This results in slowdowns and inefficiencies in the
two departments' work.
A second, but equally important problem, is stress. Excessive
stress increases sick time and reduces morale, thereby reducing
work production.

more unused vacation than any other city employee- -645 hours.
3. Limitations of Consultants
Our two building consultants have limited hours. The averaged ged about 8 hours
per week per inspector in 1985. Duane Grace serves several other cities. Lou
Bracke is retired and must limit his hours because of social security
regulations. Lou would also like to phase out his work with us. As he puts
i t, I f . I wanted to work .a lot of hours, I wouldn't have retired."

It takes 2 — 4 years, depending on experience, to train a new inspector. It
is important to use Lou Bracke to train a new inspector now before Lou leaves
us. Marge does not have time for training.

Other cities with a similar volume and type of construction, such as Woodbur
and Roseville, have two full —time inspectors. The enclosed chart lists the
cities closest to us in population and ranks them in order of total p ermi t
valuations. Note the high valuation of commercial permits in Maplewood compared
to other cities. This type of construction requires a more experienced and
knowledgeable inspector, as well as more time, than residential construction.

The purpose of building permit fees is to finance the cost of plan reviews and
inspections. The following chart shows that the inspection division has shown
a surplus since 1977. There is more than enough surplus to pay the $34,190
for a second inspector.

The 1987 budget for the Maplewood Nature Center included a permanent part -time
Clerk- typist I. Over the past years we have tried volunteers, Ramsey JPTH
employees, answering machine, etc, to provide information and service to the
public. Presently our naturalists must take time from their classes to do
work which could be done cheaper and more efficiently by a Clerk - typist.. At
present our building must be closed during school classes due to the naturalists
being outdoors with the students. We have also had to close the building on
Saturdays when naturalists have been providing special programs and doing pro -
jects outdoors.
General duties for the Clerk - typist:
Answer telephones and screen calls, answering routine questions.
Take program reservations from the public.
Confirm reservations for programs with schools, Boy Scouts, Girl Scouts, etc.
Greet and orient visitors to the Nature Center.
Collect program fees from participants.
.Maintain records such as.attendance, fees, phenology, etc.
Do light typing.
Maintain individual and organizational mailing lists.
Make trips to City Hall for the Nature Center's needs for copying, mailings,
timesheets /paychecks, etc.
Prepare and send out program flyers and press releases.
Orient scheduled and unscheduled self- guided groups.
Rent equipment to public such as snowshoes, binoculars, etc.
Maintain inventory of program supplies.
It is my opinion that we will generate additional revenue by permitting our
naturalists to operate paying programs and that we will be able to offer better
service to our Maplewood clientele.
It is requested that a permanent part -time (1/2) Clerk- typist I be approved
for the Maplewood Nature Center beginning January 1, 1987.

The Maplewood City Council on November 10, 1986, approved the Joint Powers
Agreement between School District #622 and City of Maplewood for the purpose
of obtaining an easement from the School District for the construction of an
elevated water storage tank and the planning and use of the Beaver Lake School
outdoor f a c i l i t i e s and the .City' s Geranium Park for the mutual benefit of the
students in.School District #622 and the residents of Maplewood. Included in
agreement under Section 4.2 Contributions is the statement that the School
District agrees to provide for a jointly planned and used ou tdoor recreational
facility and to assist in funding the. joint planned preparation. In Section
4.4 the City agrees also to assist in funding the joint plan preparation.
The Business Manager for School District #622 and the Director of Parks and
Recreation for Maplewood interviewed consultants for the planning of the School
and Park site and would like to recommend the hiring of Tim Erkkila ASLA for

$2,500 plus the cost of public presentations, if needed. The City will act as
the contractual agent and we will be reimbursed $1,000 toward this contract by
School District #622.
The Park and Recreation Commission at their meeting of November 17, 1986,
recommended the hiring of Mr. Erkkila for this project.
Recommendation
The City Council of Maplewood is requested to approve the hiring of Tim Erkkila
for the Joint School and Park Planning Services as proposed in the attached
at an estimated cost of $2,500. Funds should be allocated from the Beaver
Lake P.A.C. Fund.

As we discussed last week, Westwood Planning & Engineering Company is
anxious to provide you with park planning and design services. This letter
is a proposal which, if accepted, could be our services agreement for the
park planning services of a possible joint school and park facility at the

A. Use.site data (topographic maps, plat map, etc.) from the school and
City to create an enlarged scale site map for planning the facilities
at the school /park.
B. Conduct a needs analysis of park /school outdoor recreation options.
co Prepare two alternative schemes for the development of the
school /park /water tower site based on our understanding of your needs.
These concepts shall be presented to Joint meetings of the Park
Commission and School District personnel.
D. Following the Client's comment on the alternative, a selected favorite
or modification of plans shall be developed into a single master plan.
The Clients shall receive a reproduceable master from which it can
make its own prints or 8 prints shall be provided in place of the
reproduceable.
E. Provide a preliminary development cost estimate.

COST OF SREVICES
The cost of services described herein shall be billed at a cost estimated
at $2,500.00; plus the cost of public presentations. All work including
these. presentations shall be billed hourly as incurred based on the
attached hourly schedule.
The cost of any extra prints, reductions or any reproduceables shall be
billed at 110% of incurred cost. It is presently estimated that the
materials cost will be $20.00 - $40.00 depending on what you request. You
shall be billed monthly.
All work shall be performed within the time parameters specified by your
offices.
QUALIFICATIONS
Westwood Planning & Engineering Company is well suited to your park
planning needs. Besides providing planning, engineering and surveying, the
planning department is staffed by personnel experienced in park planning.
Within the last 18 months we have worked on park projects for many of the
high growth suburban communities. Specific examples would be:
• In addition to general park planning Westwood prepared
construction documents for four parks in Eagan, Minnesota.
• In Lakeville, Minnesota, Westwood worked on park master planning
for five park sites, in preparation for their successful Park
Bond Issue.
• In Apple Valley we studied four sites, assisted in a Park Bond
issue and now are developing construction plans on an athletic
complex.
• In Burnsville we are finishing plans for two park sites.
• In Maple Grove we have worked on joint use school and park sites,
numerous park studies, are now developing plans for beach and
trail improvements.
