BACKGROUND
Past Actions
2 -7 -80:
Council conditionally approved Cave's Century Addition planned unit
development and preliminary plat and vacated a portion of Hawthorne
Street (page 6 ) .
The original conditions for the PUD have been satisfied. Those
conditions of the preliminary plat that are still in effect are as
follows:
1. Footings for double or quad units shall be pinned by a registered
surveyor before the foundation is laid to assure that party walls will
be constructed exactly on common lot lines.
2. All building construction shall comply with the approved PUD.
3. Submission of a signed developer's agreement to be y
approved b the
city engineer.

4. Approval of final utility and drainage plans ;by the city engineer.
50 Implementation of the recommendations of the Soil Conservation
Service.
5 -15 -80 and 9 -4 -80:
Time extensions were approved for the preliminary plat and planned
unit development, subject to the original conditions.
Council approved.a final plat for Cave's Century Addition. This plat
was only for the quad units along the west-boundary of the s i t e
(page 6 ) .

Council conditionally approved an amendment to the Cave's Century
Addition PUD and preliminary plat, for the subject portion of the
site. The amendment changed the site plan from 32 quad -style dwelling
units (eight structures) to 32 town house -style dwelling units,
consisting of four, eight -unit structures.
The original conditions of the PUD were deleted and the following'
condition was added: "No Parking" signs being placed on the P rivate
drives - to maintain emergency vehicle access,
The original conditions of the preliminary plat were reduced to those
shown in the 2 -7 -80 Past Action, plus the following conditions were
added:
1. Adding "town houses" to Condition #1.

20 Enlarge the utility easement for sanitary sewer and water main to
thirty feet in width.
3. An easement from the adjacent property owner to the south must be
submitted for off -site grading.
4. Revise the plat to provide twenty feet of separation between
blocks three and four.
5. Revise the plat to provide fifty feet of separation between blocks
two and three.
6. The homeowner's agreement shall restrict tenure to owner
occupancy.

Council approved a two -year time extension for the undeveloped
portions of the PUD and preliminary plat.

Council approved Cave's Century 3rd Addition final plat (page 6) .

Council approved an amendment to the PUD site plan and gave
preliminary approval for the replatting of a portion of the 3rd
Addition as the 4th Addition. This amendment substituted fourteen
single dwellings for 22 double dwellings. There were no changes to
the 6 -14 -82 PUD or preliminary plat conditions.

8- 12 -85:
Council approved a one -year time extension for the undeveloped portion
of Cave's Century Addition PUD and preliminary plat to be designated
as Cave's Century 5th Addition,
3- 31 -86:
The applicant requested a plan amendment and an amendment of the PUD
and preliminary plat to develop the 5th Addition with convenience
` ,shopping uses, including motor fuel sales. This request was
withdrawn following a recommendation to deny from the planning
commission.

1, Section 36- 4442(e) states that "all conditional use permits shall
be reviewed by council within one year of the initial approval. At
that time council may specify an indefinite term or specific term not
to exceed five years for subsequent reviews."
2. Section 1005(e) of the subdivision code provides that for one year
following preliminary approval and for two years following final plat
approval, "unless the subdivider and the city agree otherwise, no
amendment to a comprehensive plan or official control shall apply to
or affect the use, development density, lot size, lot layout or
dedication or platting required or permitted by the approved
application. Thereafter, pursuant to its regulations, the city may_
extend the period by agreement with the subdivider and subject to all
applicable performance conditions and requirements, or it may require
submission of a new application, unless substantial physical activity
and investment has occurred in reasonable reliance on the approved
application and the subdivider w i l l suffer substantial financial
damage as a consequence of a requirement to submit a new application.
In connection with a subdivision involving planned and staged
development, the city may by resolution and agreement grant the rights
referred to herein for such periods of time longer than two ( 2 ) years
which it determines to be reasonable and appropriate."

RESOLUTION
A regular meeting of the City Council of the City of Maplewood, Minnesota
was duly called and held in the council chambers in said city on the 11th day
of August, 1986, at 7 p.m.
The following members were present:
The following members were absent:
WHEREAS, on June 9, 1986 the council passed Resolution 86 -6 -101 vacating
a utility easement located on Lot 5, Block 1, Tousley Commercial Park; and
WHEREAS, Tousley Development Corporation has requested that said
resolution be amended so as to provide a more definite legal description of the
vacated easement and of the premises released from said easement.
NOW, THEREFORE, be it resolved by the Maplewood City Council that
Resolution 86 -6 -101 be amended as follows:
1. The description of the vacated easement contained in the resolution
is deleted and the following is substituted:
Utility easement (described on the plat as
"sewer easement ") located on Lot 5, Block 1,
of the plat of Tousley Commercial Park.
2. The public interest in the vacated easement shall accrue to: Lot 5
except the east 82 feet thereof, B l o c k 1, Tousley Commercial Park according to
the recorded plat thereof.

Public Works
1. The proposed pond is needed because the downstream storm sewer
has not been constructed. This property will eventually drain
westerly.
2. Gervais Avenue is planned as a major collector street between
Highway 61 and White Bear Avenue. East of Highway 61 and west of
White Bear Avenue, this street is 48 feet wide, requiring at least 66
feet of right -of -way. The south half of Gervais Avenue right-of-
way, adjacent to the applicant's site, is 33 feet wide. East of
Hazelwood Street, the right -of -way is also 66 feet wide.

Citizen Comments
Thirt propert owners within 350 feet were asked to respond to
the 29-lot proposal on pa 9. Of the fourteen responses received,
four were in favor, four h ' ad no comment and six expressed opposition.
The reasons for opposition are:
1. The public improvements would re assessments a nearb
properties. (Comment: The developer will be responsible for all
costs associated with this development.
20 Development of this propert will increase the taxes for the
existin homes., (Comment: Burt Reinich an appraiser for Ramse
Count stated that there is ver little chance that the taxes for
adjoinin properties would be increased. Taxes would onl increase
if the value of homes increases. An adjustment would not be
considered for at least four to five y ears. )
3* The propert owner at 2467 Hazelwood Avenue ( pa g e 8 ) is opposed
if he would be assessed for the construction of Barcla Street north
to Brooks Avenue, (Comment: Barcla 'Street will not be needed north
of the applicant's site until the adjoinin land is developed.

concerned that the poor access to this area should be reviewed.

Pipeline
The location of the pipeline is shown on page 12 of the staff report. The
pipeline is approximately 825 feet from the closest part of the plat.
Density
The minimum l ot size required by code is 10,000 square feet. The average
lot size proposed is 15,507 square feet.
Fish Creek Bluff
The bluff is eroding. The developer would grade the peak of the bluff
to reduce erosion. The county has approved the grading plans. See the
attached letter.

The staff recommends changing the name of the cul —de —sac to "Bluff Circle"
to avoid confusion with existing street names.
Summary
This development meets or exceeds the city's development standards. If

plat is recorded. They would be located on Lots 13 and 14, Block 2 and
meet all required setbacks, except that the westerly dwelling would
encroach on the bluff l i n e setback for Fish Creek. Since it is an
existing dwelling, it would remain, but any expansion would require
council approval.

eliminate any possible nuisances associated with farm residence zoning,

single -- dwelling neighborhood.
Recommendation
10 Approve the Carver Hei preliminar plat, subject to the
followin conditions bein satisfied before final plat approval:
a. Submittal of a developer's agreement, with re suret

for the street stubbed to the east propert line, off-site storm

from this pond to Fish Creek, if the applicant can document that
the pond will not need an outlet until the draina area is more
full developed.

Secretary Olson said the proposal is a preliminary plat for 25 single dwelling
lots and zone the property from F to R -1.
Carl Peterson. said they have no problem with the recommendation of staff.
Chairman Fischer asked if there was anyone present who wished to comment on the
proposal.

Commissioner Whitcomb moved the planning commission recommend the city counc i 1
approve the Carver Heights preliminary plat, subject to the following conditions
being satisfied before final plat approval:

The cit desi consultant has completed plans and
specifications for the elevated tank portion of the Water Service
District 6 Project. The elevated tank is located approximatel
600 feet west of Ferndale Street alon Stillwater Avenue. The
concept proposed in the feasibilit stud was to locate the tower
300 feet north of Stillwater Avenue on the back softball field of
the Beaver Lake School propert In easement negotiations with
the school district it was determined that the tower would be
better located as close to Stillwater Avenue on the school's
propert as possible. The attached map shows the planned
location as shown in the elevated tank plans,

Ne have been takin place with the Hillcrest
Development Corporation for a water main easement throu their
propert for the trunk water main south of Sterlin Street that
is proposed as part of the Water Service District 6 Improvement
project to connect the Beebe Road pump station to the proposed
elevated tank. The Hillcrest Development Corporation has taken
the position that if the cit will commit to orderin a trunk
sanitar sewer project that would parallel the trunk water main
alon the Sterlin Street ali to the railroad ri
then Hillcrest will g rant the necessar easements or ri
for this utilit corridor. This trunk sanitar sewer was
ori proposed and studied in 1979 and was desi to
eliminate an at-capacit lift station at Larpenteur Avenue and
Sterlin Street, run alon Sterlin Street to the Hillcrest
propert approximatel follow the Hillcrest internal street
la throu the propert to McKni Road and Iv Avenue and
then south in McKni Road to Mar Avenue. The lift station
at Larpenteur Avenue and Sterlin Street has been up
however, the recommendation remains to eliminate it from the
s with a trunk sewer, especiall with the recentl approved
developments of Ed Cave and Sons, Inc. at Lakewood Drive and at
Sterlin Street and Hillcrest's stated plans to extend Montana

and to outline financin options prior to committin to the

The move to the new city hall facili will require the
relocation and installation of the Emergency, Services communication.
and monitoring antennas, currently installed on the roof at
1380 Frost Avenue.. The * subject has been studied and two alternatives
were generally considered acceptable; the first, to add our antennas
to the tower east of the new building.
While this appeared to be a val al ternative, recent discussions
with people exper.i enced is n this type of i nstal l ati�on has lead us to the
concl us ion that this is no l onger . an acceptable alternative, The cable,
needed to run f rom . the transmitter site to the tower, would be proh.i bid -
ti'vely expensive. It i�s estimated to be i excess of $8,000. Even.
with this cable, 1 the l osses would severely reduce our equi s
performance and 1 i ampl i f iers or ng equi pment
would be requ i .
The second al ternative 1:s the instal lati on of a 64-n f oot freer,
standing mast i n the i;mmedi ate area outside of the.. Emergency Services
office's, located on th.e south. side of the buil ding The total cost
of thi instal 1 ation has been est . at $1,500'.. There are several
advantages to this alternative: reduced l i loss due to the shorter
cable runs, the cable itself may be sal from the ex ng i;nstal 1 ati ,
a second, independent, emergency trans-mi'tter for use by th.e Police
-
Department should theirs ail , and eas i modi ication and repair of the_
antenna system shoul i be necessary i the -future. The second antenna
system has been di with the P.oltce Department and they concur that
it i ° the best alternative..
Based on the ' above i f orrmati, on , the Department of Emergency
Services wishes to request the Cilty Cohn -ci`l to make funds ava l abl e
to install a free - standing 64- foot' antenna adjacent to the Emergency
