Onmmn,"4- c The applicant is making a good faith effort to develop this site in a timely manner, There have been no changes in the -adjoining land s uses or in city code to justify denial of this request. Recommendation 10 Approval of a one -year time extension for the Cave's Century Addition planned unit development, on the basis that the applicant r ppl scant is making satisfactory p rogress in the phased development of this site. Approval is subject to the condition of the June 14 1982 amendment the PUD, to 2. Approval of a one -year time extension for the ' prellmina ry plat to be designated as Cave's Century 5th Addition subject to ' � the original conditions, as amended on June 14, 19820 BACKGROUND Past Actions 2 -7 -80: Council conditionally approved Cave's Century Addition planned unit development and preliminary plat and vacated a portion of Hawthorne Street (page 6 ) . The original conditions for the PUD have been satisfied. Those conditions of the preliminary plat that are still in effect are as follows: 1. Footings for double or quad units shall be pinned by a registered surveyor before the foundation is laid to assure that party walls will be constructed exactly on common lot lines. 2. All building construction shall comply with the approved PUD. 3. Submission of a signed developer's agreement to be y approved b the city engineer. P 4. Approval of final utility and drainage plans ;by the city engineer. 50 Implementation of the recommendations of the Soil Conservation Service. 5 -15 -80 and 9 -4 -80: Time extensions were approved for the preliminary plat and planned unit development, subject to the original conditions. Council approved.a final plat for Cave's Century Addition. This plat was only for the quad units along the west-boundary of the s i t e (page 6 ) . ti_1 A-P ) 0 Council conditionally approved an amendment to the Cave's Century Addition PUD and preliminary plat, for the subject portion of the site. The amendment changed the site plan from 32 quad -style dwelling units (eight structures) to 32 town house -style dwelling units, consisting of four, eight -unit structures. The original conditions of the PUD were deleted and the following' condition was added: "No Parking" signs being placed on the P rivate drives - to maintain emergency vehicle access, The original conditions of the preliminary plat were reduced to those shown in the 2 -7 -80 Past Action, plus the following conditions were added: 1. Adding "town houses" to Condition #1. 2 20 Enlarge the utility easement for sanitary sewer and water main to thirty feet in width. 3. An easement from the adjacent property owner to the south must be submitted for off -site grading. 4. Revise the plat to provide twenty feet of separation between blocks three and four. 5. Revise the plat to provide fifty feet of separation between blocks two and three. 6. The homeowner's agreement shall restrict tenure to owner occupancy. 7— ld_Aq• Council approved the final plat for Cave's Century 2nd Addition (page 6 ) . 7_*?q-Qq. Council approved a two -year time extension for the undeveloped portions of the PUD and preliminary plat. 7 -1 I_QA . Council approved Cave's Century 3rd Addition final plat (page 6) . 9_1 l _QA . Council approved an amendment to the PUD site plan and gave preliminary approval for the replatting of a portion of the 3rd Addition as the 4th Addition. This amendment substituted fourteen single dwellings for 22 double dwellings. There were no changes to the 6 -14 -82 PUD or preliminary plat conditions. P-1 { _ X A • Council approved the final plat for Cave's Century 4th Addition. 8- 12 -85: Council approved a one -year time extension for the undeveloped portion of Cave's Century Addition PUD and preliminary plat to be designated as Cave's Century 5th Addition, 3- 31 -86: The applicant requested a plan amendment and an amendment of the PUD and preliminary plat to develop the 5th Addition with convenience ` ,shopping uses, including motor fuel sales. This request was withdrawn following a recommendation to deny from the planning commission. 3 P 1 ann i ng 1, Section 36- 4442(e) states that "all conditional use permits shall be reviewed by council within one year of the initial approval. At that time council may specify an indefinite term or specific term not to exceed five years for subsequent reviews." 2. Section 1005(e) of the subdivision code provides that for one year following preliminary approval and for two years following final plat approval, "unless the subdivider and the city agree otherwise, no amendment to a comprehensive plan or official control shall apply to or affect the use, development density, lot size, lot layout or dedication or platting required or permitted by the approved application. Thereafter, pursuant to its regulations, the city may_ extend the period by agreement with the subdivider and subject to all applicable performance conditions and requirements, or it may require submission of a new application, unless substantial physical activity and investment has occurred in reasonable reliance on the approved application and the subdivider w i l l suffer substantial financial damage as a consequence of a requirement to submit a new application. In connection with a subdivision involving planned and staged development, the city may by resolution and agreement grant the rights referred to herein for such periods of time longer than two ( 2 ) years which it determines to be reasonable and appropriate." Attachment 3 4 N Interstate 694 RESOLUTION A regular meeting of the City Council of the City of Maplewood, Minnesota was duly called and held in the council chambers in said city on the 11th day of August, 1986, at 7 p.m. The following members were present: The following members were absent: WHEREAS, on June 9, 1986 the council passed Resolution 86 -6 -101 vacating a utility easement located on Lot 5, Block 1, Tousley Commercial Park; and WHEREAS, Tousley Development Corporation has requested that said resolution be amended so as to provide a more definite legal description of the vacated easement and of the premises released from said easement. NOW, THEREFORE, be it resolved by the Maplewood City Council that Resolution 86 -6 -101 be amended as follows: 1. The description of the vacated easement contained in the resolution is deleted and the following is substituted: Utility easement (described on the plat as "sewer easement ") located on Lot 5, Block 1, of the plat of Tousley Commercial Park. 2. The public interest in the vacated easement shall accrue to: Lot 5 except the east 82 feet thereof, B l o c k 1, Tousley Commercial Park according to the recorded plat thereof. Carver Avenue is a count road desi as a minor collector street and is planned to handle the traffic from this plat, The Ramse Count traffic en states that the traffic from this development will not be inconsistent with Carver Avenue's planned traffic load, 29 Sewer and water are available in Carver Avenue, 3e This site is shown on the draina plan as part of the watershed to a three-acre foot storm water pond planned for the propert adjoinin the east. An easement is needed for the pond and an outlet to Fish Creek, Parks 10 A search area for a -mini-park is located in this vicinit (See park plan on pa 13.) 2* On June 16, 1986 the parks commission decided not to re dedication of an propert on this site for the planned park, 3* The parks director has recommended the location for the proposed mini-park as shown on the area street concept map (pa 12). Citizen Comments The owners of 23 properties within 350 feet of this site were surve Of the 12 responses received, 10 were opposed, one was in favor and one had no comments. Those opposed, raised the followin concerns (staff comment's in parenthesis) 19 Too much traffic on Carver Avenue. (Carver Avenue is a minor col lector, owned by the county and planned to handle the existing and future traffic in this area.) 2. The lots would be too small. (.The lots exceed the minimum code standard of 10,000 square feet, average 15,507 square feet.) 3. No second access for emergency vehicles. (See area street plan on page 12.) 4. There would be an increase in taxes or assessments. (Taxes would not increase because of this project. There ' would probably be area assessments for the properties to the east that drain into the proposed pond if a public storm water poj ect is needed.) 5. Wildlife habitat would be disturbed. 6. The Hillcrest Development Corporation has taken the position that if the cit will commit to orderin a trunk sanitar sewer project that would parallel the trunk water main alon the Sterlin Street ali to the railroad ri then Hillcrest will g rant the necessar easements or ri for this utilit corridor. The * subject has been studied and two alternatives were generally considered acceptable; the first, to add our antennas to the tower east of the new building. While this appeared to be a val al ternative, recent discussions with people exper.i enced is n this type of i nstal l ati�on has lead us to the concl us ion that this is no l onger . an acceptable alternative, The cable, needed to run f rom . the transmitter site to the tower, would be proh.i bid - ti'vely expensive. It i�s estimated to be i excess of $8,000. Even. with this cable, 1 the l osses would severely reduce our equi s performance and 1 i ampl i f iers or ng equi pment would be requ i .
