A regular meeting of the City Council of Maplewood, Minnesota, was held in the Council

Consent Agenda, Items E - 1 through 3 as recommended
1. Accounts Payable
Approved the accounts (Part I Fees, Services, Expenses Check Register dated
January 29, 1986, and January 30 , 1986 - $219,844.60: Part II - Payroll.
Payroll dated 1 -24 -86 - gross amount $132,266.11; Payroll dated 2 -7 -86 -
gross amount $140,260.62:) in the amount of $492,371.33.
2. Change Order - Lift Stations 6 and 8
Resolution No. 86- 2 - 20
WHEREAS, it is now necessary and expedient that said contract be modified
and designated as Improvement Project No. 85 -9 Change Order No 2,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,. MINNESOTA,
that the City Engineer is hereby authorized and directed to modify the existing
contract by executing said Change Order No. 2.
3. Final Plat: Soderberg Addition
Approved the final plat for the Soderberg Addition. to Maplewood for eight (8)
single dwelling lots located at Southlawn and Radatz .
E -A PRESENTATIONS
1. Arthur Meyer - Cancer Society ! 108[f fi.dol. Days"
a. Mr. Meyer requested Council proclaim March 20 to 23rd, 1986 as American Cancer
Society "Daffodil Days" and also requested Council sell daffodils at the Town and
Country Bank .Friday and Saturday, March 21 and 22nd, 1986.
b. Mayor Greavu in conjunction with Mayor Bill Sandberg of North St. Paul
proclaimed March 20 - 23, 1986, as Daffodil Days.
c. Mr. Meyer informed the Council that Ernest. Radatz, a lifelong resident of
Maplewood, will be celebrating his 100th birthday, March 23, 1986. There will
be an open house at Christ Luthe ran Church in North St. Paul.
20 Marvin Sigmunclik, M.A.A. President
a. Mr. Sigmundik stated M.A.A. is in need of volunteers He fears that if. help
is not received, M.A.A. will be .disbanded.
b. Council requested Mr. Sigmundik attend the joint meeting of School District
622, North St. Paul, Oakdale and Maplewood officials next Wednesday, February 12,
1986, to discuss some of the problems.

F. PUBLIC HEARINGS
1. 7:00 P.M. , Frost Avenue Project 83 -1
a. Mayor Greavu convened the meeting for a public hearing to rehear the
proposal to upgrade Frost Avenue from Birmingham Street to Adele Street.
The original hearing was held January 14 1985.
b Manager. Lai s presented the Staff report.
c. Assistant City Engineer, Chuck Ahl , presented the specifics of the
proposal.
d. Mayor Greavu called for proponents. None were heard.
e. Mayor Greavu called for opponents. The following expressed their views

g. Councilmember Anderson introduced the following resolution and moved its
adoption

WHEREAS, after due notice of public hearing on the construction of storm
sewer and street improvements on Frost Avenue from Adele Street to Birmingham
Street, City Project 83-1, a hearing on said improvement in accordance with the
notice duly given was duly held on February 10, 1986, and the Council has heard
all persons desiring to be heard on the matter and has fully considered the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
as follows:
1. That it is advisable, expedient, and necessary that the City of
Maplewood construct storm sewer and street improvements on Frost Ave-
nue from Adele Street to Birmingham Street, City Project 83 -1, as de-
scribed in the notice of hearing th6reon, and orders the same to be
made.
2. The City Engineer is designated engineer for this improvement and
is hereby directed to prepare final plans and specifications for the
making of said improvement.
Seconded by Councilmember Bastian. Ayes -all.

a. Mayor Greavu convened the meeting for a public hearing to rehear the
North Beaver Lake Storm Sewer Project 83 -70 The original hearings were
held on November 26, 1984, and again on February 4, 1985.

f. Councilmember Bastian moved first reading of two ordinances amending
Chapter 23 regarding establishing licensing for peddler-s, solicitors, and
vendors

H. UNFINISHED BUSINESS
1. Metropolitan Waste Control Proposed Rates
a. This item tabled to the Meeting of February 19 , 1986.
I. NEW BUSINESS
1. Century Avenue Trunk Water Main - and Elevated Tank
a. Manager Lais presented the Staff report.
b. Director of Public Works Ken Haider stated water pressure problems in
the area north of Conway Avenue and south of Ivy Avenue extended are in-
creasing. A solution to these problems is to construct a trunk water main
from Larpenteur Avenue to Maryland Avenue to connect the Beebe Road pumping
station and to construct an elevated tank The original water plan calls for
3 connections between Larpenteur and Maryland: one along McKnight Road, one
along Sterling Street through the Hillcrest Development, and one along Century
Avenue. The McKnight Road connection will be constructed as part of the McKnight
Road reconstruction by Ramsey County. Conversations with Ramsey County engineers
indicated, this construction will not begin until May 1987. at the earliest. The
Sterling Street connection is believed to be not feasible at this time due to
location problems in the Hillcrest Development. Therefore, it is recommended
that a feasibility. study be conducted on the Century Avenue connection and the
elevated water tank.
C. Councilmember Bastian introduced the following resolution and moved its
adoption

WHEREAS, the City Council . has proposed that the area described as:
Century Avenue from Larpenteur Avenue to Ivy Avenue and Water Service Dis-
trict No. 6 be improved by construction of a trunk water line and elevated
water tower;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, that the proposed improvement be referred to the City Engi-
neer, who is hereby instructed to report to the Council with all con-
venient speed advising the Council in a preliminary way as to whether
the proposed improvement is feasible and should best be made as proposed,.
and the estimated cost of the improvement as recommended.

2. Water Service Replacement - 1851 Clarence Street
a. Director of Public Works Haider presented a letter requesting the City
re- install a disconnected water service. The service was installed by
Maplewood in the early 1960 The property owner did not choose to con -
nect to the service at that time. Within a few years a leak developed some-
where in the service. The St. Paul Water Utility disconnected the service
at the main rather than charge Maplewood for the repair cost. The property
owner now wishes to.connect to City water. Since the homeowner had paid for
the service through an assessment, they have a reasonable expectation that. a
service should be available
It is recommended Maplewood pay to reconnect the service. The estimated cost
for this work is approximately $900.00.
b. Councilmember Bastian moved to authorize the payment of $900.00 to re-
install a water service at 1851 Clarence Street and that appropriate budget
changes also be approved

3. Personnel Policy Change - Sick . Leave
a. Manager Lais presented the Staff report.
b. Mayor Gre avu moved to approve the following that the City's . Personnel
Policy regarding sick leave be revised to (1) provide sick leave accumulation
at a constant rate of 1.25 days per month and (2) provide that on December 31st
of each year a full -time employee with 800 hours or more of accumulated sick
leave shall be eligible to convert sick leave accumulated in the previous 12
months to vacation or deferred compensation at the employee's current . pay rate
on the basis of 2 hours of sick leave - for 1 hour of vacation or deferred com-
pensation . Such. convey sion shall not exceed a total of 48 hours of vacation
and deferred compensation.

4. Ramsey County Solid Waste Master Plan
a. Director of Community Development Olson presented the current draft of
Ramsey County's solid waste master plan containing four areas of discussion
that are of interest to the City.
1. The County intends to license this year all garbage haulers that
operate in the County. This should not affect our existing City
license for garbage haulers

2. The County encourages individual cities to start organized collection
of garbage. Organized collection is a method . by which the city sets
up specific districts and contracts for the collection in these dis-
tricts with private companies. A free system as we have now, allows
the homeowner to select any private company they wish. The county may
request a change in state law in 1988 giving the county the authority
to initiate organized collection. Currently, only , . the city has the
authority.
3. The county may enact a mandatory recycling ordinance in 1988 if voluntary
recycling efforts do not meet the county's established goals.. The
county will take the lead in establishing a curb -side recycling program.
4. The county encourages the cities to initiate their own in -house recycling
programs, such as office paper. We should also continue to expand our
leaf composting program.
Any response relative to the master plan should be made to the county, in
writing no later than February 14, 1986

back in the Spring for consideration

5... Park and Recreation Activity Plan for 1986
a. Manager Lais presented the 1986 Park and Recreation Commission's Activity
Plan as submitted by the Park and Recreation Commission.
b: Councilmember Bastian moved to accept the 1986 Park and Recreation Commission's
Activity Plan as submitted by the . Park and Recreation Commission
Seconded by Councilmember Anderson. Ayes - all.
6. Winter Carnival Resolution
a. Manager Lais presented the resolution commending the St. Paul. Winter
Carnival Committee on a "job well done".
b. Councilmember Bastian introdu the following resolution and moved its
adoption

WHEREAS, The St. Paul Winter Carnival Association has celebrated the
100th Anniversary of the first Winter Carnival, and
WHEREAS the 1986 Ice - Palace has brought national acclaim and interest to
the community, therefore
BE IT RESOLVED by the Mayor and Council of the City of Maplewood that the
St. Paul Winter Carnival Association and all of its' volunteers are sincerely
congratulated upon their'success in overcoming many obstacles to construct and
display the extremely impressive ice palace,- and

BE IT FURTHER RESOLVED that a copy of this resolution be presented to the

Chairman of the Winter Carnival Association on behalf of the City of Maplewood
and its residents.

7. Time Extension: Gervais Overlook Plat
a. Councilmember Anderson moved to deny the time extension for the .Gervais
Overlook Plat

c. Councilmember Bastian moved to approve the one -year time extension for Block
one and Lots one through eleven, Block Two of the Gervais Overlook preliminary

Please find attached our annual recommendation for the 1986 Fee Schedule for
the Reservation of Park Facilities including athletic field reservations,
rinks, concession facilities, and the fee for special showings by the City
traveling Puppet Theatre.
The staff has analyzed our costs and recommends that for 1986 that the Fee
Schedule continue the same as in 1985. The Park and Recreation Commission
at their February 11, 1986, meeting reviewed the Fee Schedule and concurs
with the recommendation of staff.
Recommendation
It is requested that the attached 1986 Fee Schedule be placed on the City
Council Consent Agenda for their approval.

198b FEE SCHEDULE
RESERVATION OF -PARR FACILITIES.
1) Daylight Athletic field reservations including rinks and fields, are free.This does not include use for Tournaments or League gases.
2) Light charge for use of lights at Wakefieldg and Goodrich. Park will be13.50 per hour. Light charge for use of Tights at Hazelwood Park willbe $17.00 per hour. Chart* for use of rink lights will be $8.00 perhour /sink.
3) Tournaments bald in Maplewood:
A. All Tournaments
1. Motorized vehicles are not allowed outside of designated
parking areas.
2. All gases gust be completed by 10 :00 p.s with all people out
of the park by 10 p.s.
3. Rental fees suet be paid one week in advance of the first
scheduled date of the tournament.
4. Tournament flyer and rules suet be turned into Parks i Recreation
Department two weeks In advance of the tournament.
5. Maplewood larks & Recreation retains the right to cancel any
tournament due to field conditions or inappropriate conduct
of Tournament Director or participants.
6. Parking lots are to be cleaned along with the fields and
surrounding grounds.
D. Softball Tournaments:
1. Must be sanctioned by MRPA or USSSA.
2. Maple Leaf Officials Association will have exclusive rights
to work any tournaments held in Maplewood.
3. No gases say start at Wakefield 01 before 11:00 a .s. on Sundays.
C. Fee structure for State, Regional or National Tournaments will be
decided separately.

increase and structure as proposed b the Metropolitan Waste Control
Commission.
As you know, the proposed rates will appl to all communities and areas
in the metropolitan area and will not create a disparit between the various
communities.

I attended a public meeting on November. 1st reviewing the
recommended changes to the MWCC rate structure. Two items were
addressed. The first was recommended changes in Cost Allocation
Methodology and the recommended changes in the SAC charges.
The Cost Allocation Methodology is a complex issue and will be
addressed in another report.
The proposed changes in the SAC is as follows:

147% increase within six (6) years over the current rates.
MWCC claims these increases are necessary to maintain adequacy of
the SAC fund.
At the meeting, various communities, including Oakdale, expressed
a concern about the need for such a substantial increase and its
effects on development. A particular concern was expressed on
the impact such.increases will have on Commercial Industrial
Development. For example, in 1985 Zycad paid . $19,500,. If Zycad
were to build the same building in 1991 the cost for the SAC
would total 48,300 a substantial increase which could directly
impact the decision to locate in Minnesota versus another state"'
or in Oakdale or in another City outside the SAC area.
Residential development will also be affected the same. In 1984
we paid $102.170 for residential SAC's, the same development in
1991 would total $255,150 This % cost the builder must include
as part of the cost of a home. The end result is higher cost to
the future homeowner in the Metropolitian area.
As a developing City, this cost increase may a substantial
impact on any future development. We have objected, to any
increase in the SAC charge that will directly effect new
development in our growing City. In comparison to the minimal
effect felt in a developed city, there is little new construction
and often SAC demolishes credit to cover any new construction
charges. This is to inform you of the future increases in the
SAC charge to new development of the future.

THE CITY COUNCIL OF THE CITY OF MAPLEWOOD DOES ORDAIN AS FOLLOWS:
Section 1. That the Maplewood City Code of Ordinances hereby
amended by deleting therefrom in its present form and entirety
Article III of Chapter 23 thereof and by substituting, in .lieu
of same, the following:
ARTICLE III
SOLICITATIONS
Sec..23 -31, Prohibited; Exceptions.
It shall be unlawful for any person, except . an organization
organized for civic, patriotic, charitable or religious purposes
to solicit funds in any manner on the streets of the City.
Sec. 23 -32. Permits for Approved Organizations.
Any civic, patriotic, charitable or religious organization
may conduct a solicitation upon the streets of the City only
after having made application to do so to the City Clerk.
Solicitation, shall be granted by said City Clerk only to civic,
patriotic, charitable or.religious organizations located in
the City, or to a recognized fund committee composed of the
city citizens representing an organization of said type.
Sec. 23 -33. Permit Application.
Applicants for permits under the provisions of this Article
shall file with the City Clerk a sworn statement on a form
to be furnished by the said City Clerk at least thirty (30)
days in advance of the requested date for the solicitation.
Said application shall be executed by -at least two (2) duly
appointed officers of said organization or.the local fund com-
mittee conducting the campaign.
Sec. 23 -34. Limits on Time.
Permits for such solicitations shall not be given for longer
periods than thirty (30) consecutive days in any calendar year.
Only one (1) permit shall be issued to any one organization
at an time and shall be only for one (1) period of solicitation.Y
Permits granted shall designate the hours within which street
solicitation may be conducted.

Sec. 23 -35, Volunteer Credentials.

All solicitation made under the provisions of this Article
shall be conducted only by volunteer workers; and said workers
shall carry proper credentials prominently displayed, or a
container for the depositing of donations, which shall promi-

ARTICLE II
PEDDLERS, SOLICITORS AND VENDORS
Sec. 23 -16. Definition.
For the purposes of this chapter, the following words and phrases
shall have the meanings respectively ascribed to them by this
section:
Peddler: Any person with no fixed place of business within
the City, who goes f rom house to house carrying or transporting
goods, wares or merchandise and offers or exposes such merchan-
dise, exclusive of newspaper delivery persons.
Solicitor: Any person who goes from house to.house soliciting
or taking or attempting to take orders for the purchase of
any goods, wares or merchandise, including magazines, books,
periodicals or personal property of any nature, for delivery
in the future.
Vendor: Any person who makes sales of goods, wares or merchan-
dise from a stand or vehicle located upon public property or
right -of -way.
Sec. 23 -1 Permit Required;.Exception.
It shall be unlawful for any peddler, solicitor or vendor to
sell or attempt to sell any product upon any public property
or right -of -way in any area within the City or to engage in
door -to -door solicitation or sales within such areas without
first having obtained a permit for this purpose from the City
Clerk. Any peddler, solicitor or vendor who is subject to
regulation or licensing by agencies of the state or federal
government, and where such regulation or licensing pre -empts
local regulations, such peddler, solicitor or vendor shall
be exempt from conflicting provisions .of this section.
Sec. 23 -18. Permit Required For Each Company And /or Individual;
Contents of Application as to Vehiples.
A permit shall be obtained by each company and vendor, soli -
citor or peddler. The application.shall indicate both the
name of the individual vendor or solicitor and the firm or
corporation which he represents, if any.

If products are to be sold from a motor vehicle, the application
shall contain a description of the vehicle, including serial
number, license number, make and model, and-shall also contain
the name of the insurer providing liability coverage on the
vehicle.
Seca 23 -19, Permit Fee; Issuance.
Upon proper application and the payment of a fee of five dollars
5.00), the City, within ten (10) days of application therefor,
may issue permits to vend products upon the public right -of -way
in the areas designated in Section 23 -17, or to engage in door -to-
door solicitation of sales within such areas as is deemed to
be in the best interest of the inhabitants. Religious, chari-
table, P atriotic or philanthropic organizations shall be exempt
from the payment of the fee, providing the aforementioned organi-
zation shall provide a copy of current tax exempt status for
the applying organization and that shall be evidence of the
exemption from the payment of said fee..
Sec. 23 -20. Provisions of Chapter.
Provisions of this Chapter shall not apply to.any sale under
court order, nor shall it require a license for newspaper distri-
bution.
Seca 23 -21. Term of Permit; Revocation.
No permit shall be issued for any period of -time in excess
of one Y ear, and any permit may be revoked by the City Council
when it shall appear that the permittee has violated any of
the provisions of this Chapter or has engaged in activities
contradictory to the best interest of the citizens of the City.
Sec. 23 -22. Hours of Sale.
No eddler, solicitor or vendor shall engage in any peddling,P
soliciting or vending within the City bet ween the hours of
8:00.p.m. and 8:00.a.m.
No vendor shall sell or attempt to sell food products from
a motor vehicle in a residential zone.
Sec. 23 -239 Prohibition on Private Property.
An resi dent of the City who wishes to exclude peddlers or solicitors fromy.
premises occupied by him /her may place upon or near the usual entrance to
such premises a printed placard or sign bearing the following notice:
Peddlers and Solicitors Prohibited."
Such placard shall be at least three and three- fourths inches long and
three and three - fourths inches wide, and the printing thereon shall not
be smaller, than forty -eight point type.
No peddler, solicitor vendor shall enter in or upon any premises or
attempt to enter in or upon any premises where such placard or sign is
displayed.
No person other than the person occupying such premises shall remove,
injure or deface such placard or sign.
Sec. 23 -24. Application for Permit; Contents Enumerated.
Applications for a license required by the provisions of this Chapter
shall be made to the City Clerk on forms'supplied by the City.
Every license hol der shall promptly submit to the City any information
that would affect their licenses.
Sec. 23 -25.' Vehicle Liability Insurance; Safety Requirements.
Every applicant who intends to vend products from a motor vehicle shall
maintain liability insurance in the amount of at least One Hundred Thousand
100,000) Dollars for single injuries and Three Hundred Thousand ($300,000)
Dollars fvr each accident, as well as at least Ten Thousand ($10,000)
Dollars for property damage insurance.
Sec. 23 -26. Stationary Sales Locations.
No sales of goods, wares or merchandise may be made from a stationary
location, stand or vehicle on public rights -of -way without first obtaining
a permit therefor.
When applicant intends to make a sale from stationary locations within
the City, the license application shall contain a specific description
o proposedthe sale location. No more than one permit shall be issuedp
for a single stationary sales location*
Sec. 23 -27. Noise Prohibited.
No peddler, vendor or solicitor shall call attention to his business or
to his merchandise by crying out, blowing ahorn, ringing a- bell or. by any
loud or unusual noise. '
Sec. 23 -28. Non - Transferable Permit. '
All permits issued under the provisions of the Chapter ,shall be non-
transferable. No refund shall be made on unused portions of permit except
by resolution of the Council. Each peddler, solicitor or vendor shall
secure a separate permit.
Sec. 23 -28, Possession Display..
All ermi is issued under the. P rovi s i ons of the Chapter shall be carried byP
the permi tee conspicuously posted in its place of business and the permit
shall be exhibited to any officer or citizen upon request.

preliminary way as to whether the proposed improvement is
feasible and should best be made as proposed, and the estimated
cost of the improvement as recommended.
