A question was raised during a recent Council Meeting regarding the necessity of a background
investigation when an application is received for a temporary intoxicating liquor license.
Temporary liquor licenses can be acquired by nonprofit organizations that have been in existence for at
least three years. No organization may be granted more than two such licenses per calendar year and no
license shall be issued for a period exceeding four calendar days.
Per City Code Section 5.86 the application must contain the following information:
The name, address and purpose of the organization, together with the names and addresses of its
officers.
The purpose for which the temporary license is sought, together with the place, dates, and hours
during which intoxicating liquor will be sold.
Consent of the owner or manager of the premises, or person or group with lawful responsibility for
the premises.
The investigation for a regular intoxicating license includes an in -depth background investigation of the
applicant, including: a criminal history check with the BCA (Bureau of Criminal Apprehension), local
records check (Maplewood PD, St. Paul PD, Ramsey County, Hennepin County and the City the
applicant resides in). Warrant checks in Ramsey County, Hennepin County and a drivers license and
warrant check (QDP) are also done.
In the event that questions arise during the review of the financial status of the applicant, further
investigation may be done if the investigating officer deems it necessary.
When a temporary liquor license is requested, a limited investigation, including verification of criteria set
by the aforementioned city code, and the organizations non - profit status is verified.

Under the current system the Police Department is usually unaware of temporary 3.2 beer or
temporary on -sale liquor permits until the City Council packet is distributed. Record checks are
not completed on the applicants. The record check process would be ineffective because any
member of the organization could apply for the license. One consideration would be to have a
designated beverage manager for the event. This person would be the main contact and would be
responsible for the training of the servers, the hours of operation, monitoring of serving to
intoxicated people, age compliance and security.
The designated manager would also be responsible for contacting and meeting with the Chief of
Police or designee to discuss the following topics:
♦ Nature of the event.
♦ Location of the event.
♦ Time and date of the event.
♦ The ending time of time of the event.
♦ Expected crowd.
♦ Product to be dispensed to include estimated amounts.
♦ Who will be serving?
♦ How will the servers be trained?
♦ History of problems at past events.
♦ Any information that would suggest problems at the event.
Based on the above information the Chief of Police may require the presence of one or more off-
duty officer(s). The Chief of Police would make recommendations prior to the application being
approved by the City Council.

ON -SALE LIQUOR
(Use with Miscellaneous Permit)
Clubs or charitable, religious, or non -profit organizations in existence for at least three (3) years may be issued a
temporary on -sale permit to sell intoxicating liquor. No organization may be granted more than two (2) such
permits per year, and no permit shall be issued for a period exceeding four (4) days.
You can apply for a temporary liquor permit, you will need to provide the following:
1. Your name, address, phone number, and signature.
2. The name, address, phone number, and purpose of the organization, together with the names and addresses
of its officers.
3. The purpose for which the temporary permit is sought, together with the place, dates, and hours during
which intoxicating liquor will be sold.
4. Consent of the owners or manager of the premises, or person or group with lawful responsibility for the
premises where intoxicating liquor will be sold.
5. Liquor Liability Insurance:
- Minimum of $300,000.00 covering the date(s) for which the license(s) is requested. Proof of
insurance should be in the form of a Certificate of Insurance stating that it is for liquor liability and
showing the City of Maplewood as the Certificate Holder.
6. Payment of permit fee - $171.00 per day,
Guidelines
1. Temporary on -sale liquor sales should be conducted in accordance with the City of Maplewood Code of
Ordinances.
2. Good judgment should be used in sales and display of intoxicating liquor.
3. Individuals making sales are responsible for people the intoxicating liquor is sold to. A special effort must
be made to restrict all sales to people over 21 years of age. All sales persons must be 21 years of age.
4. Hours of sale must be stated on the permit. No sales may be made before noon on Sundays and before 8:00
a.m. or after 1:00 a.m. on other days. Permitted hours of sale on holidays may differ. please contact the
licensing clerk at 651- 770 -4521 for more information.

3.2 BEER SALES

Application for a temporary 3.2 beer permit should be made at least three days prior to the event.
When you apply for a temporary 3.2 permit, you will need to provide the following:
1. Your name, address, phone number, and signature.
2. The name, address, and phone number of the club or organization that is sponsoring the event.
3. The purpose for which the temporary permit is sought, together with the place, phone number, dates, and
hours during which the 3.2 beer will be sold.
4. Liquor Liability Insurance:
- Minimum of $300,000.00 covering the date(s) for which the permit(s) is requested. Proof of
insurance should be in the form of a Certificate of Insurance stating that it is for liquor liability and
showing the City of Maplewood as the Certificate Holder.
5. Payment of permit fee - $45.00 per day.
You must obtain a separate permit for each event (e.g., a ball tournament on one weekend would be one two -day
event; a tournament or series of tournaments on three consecutive weekends would be three two -day events and
require three permits.)
Guidelines
1. Temporary 3.2 beer sales should be conducted in accordance with the City of Maplewood Code of
Ordinances.
2. 3.2 beer sales only - NO STRONG BEER SALES PERMITTED.
3. Good judgment should be used in sales and display of 3.2 beer, especially at picnics, recreational areas, and
festivals.
4. Individuals making sales are responsible for people 3.2 beer is sold to. A special effort must be made to
restrict all sales to people over 21 years of age. All sales persons must be 21 years of age.
5. Hours of sale must be stated on the permit. No sales may be made before noon on Sundays and before 8:00

PENALTY FOR VIOLATION OF ANY OF THE CITY CODE OF ORDINANCES MAY BE A PETTY MISDEMEANOR OR A
MISDEMEANOR. FINES RANGE FROM $200.00 FOR A PETTY MISDEMEANOR TO $700.00 FOR A MISDEMEANOR
AND/OR 90 DAYS IN JAIL.
