Following are rules of civility the City of Maplewood expects of everyone appearing at Council Meetings -
elected officials, staff and citizens. It is hoped that by following these simple rules, everyone’s opinions can be
heard and understood in a reasonable manner. We appreciate the fact that when appearing at Council meetings,
it is understood that everyone will follow these principles:
Speak only for yourself, not for other council members or citizens - unless specifically tasked by your
colleagues to speak for the group or for citizens in the form of a petition.
Show respect during comments and/or discussions, listen actively and do not interrupt or talk amongst
each other.
Be respectful of the process, keeping order and decorum. Do not be critical of council members, staff or
others in public.
Be respectful of each other’s time keeping remarks brief, to the point and non-repetitive.

City Manager Coleman gave an update to the council calendar and reviewed other
topics ofconcern or interest requested by councilmembers.

Violence Reduction Leadership Team
Mayor Abramsreported on the Violence Reduction Leadership Team meeting she
attended and that Maplewood is a recipient of a portion of the federal grant funds
to be used to fight violence and crime.
Snow Removal
Councilmember Villavicencio requested staff look into sidewalk snow removal and
a possible ordinance.
3.Resolution of Appreciation for Councilmember Bill Knutson
City ManagerColeman gave the staff report. Mayor Abrams read the resolution.

Bill Knutson.

RESOLUTION OF APPRECIATION
WHEREAS, Bill Knutson was appointed to serve on the City Council,
beginning his term in February 2019; and
WHEREAS, Councilmember Knutson has faithfully served as a policy
maker, providing a well-informed voice to critical issues, including health care and
business development; and

WHEREAS, Councilmember Knutson had served as a community member
on the Emergency Medical Services taskforce, whose work led to the
modernizationof our Fire/EMS Department; and

skills, wit, and abilities throughout his career with peers and mentees; and
WHEREAS, Councilmember Knutson had served a long career leading St.
John’s Hospital, ensuring our community had continuous access to high quality
health care from primary services to various specialties, including advanced
cardiac care;
NOW, THEREFORE, IT IS HEREBY RESOLVED for and on behalf of the
City of Maplewood, Minnesota, andits residents that Councilmember Bill Knutson,
is hereby extended our gratitude and appreciation for going above and beyond to
ensure Maplewood is a prosperous community with a high quality of life and
livability.

RESOLUTION OF APPRECIATION
WHEREAS, Ellen Paulseth was hired as the City of Maplewood’s Finance
Director, beginning her employment in May 2016; and
WHEREAS, Ms. Paulseth has faithfully served as the City’s top finance
leader, overseeing with great diligence, professionalism and transparency taxpayer
dollars; and
WHEREAS, Ms. Paulseth and her finance team have been repeatedly
recognized and awarded by the Government Finance Officers Association; and
WHEREAS, Ms. Paulseth has freelyshared her knowledge, skills, wit, and
abilities throughout her career in service to a variety of civic organizations; and
WHEREAS, Ms. Paulseth has served a variety of local governments as a
finance professional over a 41-year career;
NOW, THEREFORE, IT IS HEREBY RESOLVED for and on behalf of the
City of Maplewood, Minnesota, and its residents that Ellen Paulseth, Finance

AN ORDINANCE ESTABLISHING A FEE SCHEDULE FOR 2023
Section I. The Maplewood City Council adopts the following schedule to the
Maplewood Code of Ordinances:
Section II. The fees established in this ordinance supersede all fees established
by ordinance, resolution, or policy prior to this ordinance.
Section III. Any unpaid fees or charges constitute a service charge the City may
collect pursuant to its authority under Minnesota Statutes, Sections 415.01,
Subdivision 1 and Minnesota Statutes 366.012 by certifying the unpaid amount to
the County Auditor for collection together with the property taxes imposed on the
affected property or on any other property the person may own in the State.

When submittaldocuments are incomplete orchanged soasto requireadditionalplanrevieworwhen
Expiration of plan review: Applications forwhich no permit is issued within 180 days following the date of
application shall expire by limitation, and plans and other data submitted for review may thereafter be
returned to the applicant or destroyed by the building official.The building official may extend the time
for action by the applicant for a period not exceeding 180 dayson request by the applicant showing that
circumstances beyond the control of the applicant have prevented action from being taken. No
applicationshall beextendedmorethanonce.Inorder torenew actiononanapplicationafter
expiration, the applicant shall resubmit plans and pay a new plan review fee.
RefundFee
The building official may authorize refunding of any fee paid hereunder which was erroneously paid or
collected.The building official may authorize refunding of not more than 80 percent ofthe permit fee
paid when no work has been done under a permit issued in accordance with this code.The building
official may authorize refunding of not more than 80 percent of the plan review fee paid when an
application for a permit for which a plan review fee has paid is withdrawn or canceled before any plan
review is done.The building official shall not authorize refunding of any fee paid except on written
application filed by the original permittee not later than 180 days after the date of fee payment.
InvestigationFee
If work forwhich a permit is required by the code has been commenced without first obtaining a permit, a
special investigation shall be made before a permit may be issued for the work.An investigation fee, in
addition to the permit fee, shall be collected.The investigation fee shall be no more than the amount of
the permit fee required.The payment of such investigation fee shall not exempt any person from
compliance with all other provisions of the city code nor from any penalty prescribed by law.

2.01 The 2040 Comprehensive Plan states the document may require amending
due to a property owner request to change land use designation to allow a
proposed development or redevelopment.
2.02 The 2040 Comprehensive Plan amendment process follows the same City
identified public hearing process as the major update process used to develop
the 2040Comprehensive Plan. Amendments are required to submit and gain
approval from the Metropolitan Council.
Section 3. Findings
3.01The requested amendment would add additional housing units to the
Gladstone Neighborhood, creating additional demand for commercial services
that the City wants to see retained, expanded and established in this
neighborhood.
3.02The City has invested nearly $17 million in public infrastructure improvements
in the Gladstone Neighborhood to spur redevelopment and add additional
housing units.
3.03The request meets various amendment criteria outlined in the 2040
Comprehensive Guide Plan:
1.Enhance existing neighborhoods by encouraging residential neighborhood
development and redevelopment to address gaps in the housing mix,
ensuring the efficient use of city services and infrastructure, and strengthen
neighborhood vitality.
2.Increase development densities/intensities with quality design at
appropriate locations to support an increased mix of housing options,
viability of neighborhood commercial nodes, and regional transit
investments.
3.Ensure the City has a variety of housing types for ownership and rental for
people in all stages of their life cycle.
Section 4. City Review Process
4.01 The City conducted the following review when considering this amendment
request.
1.On September 20, 2022, the planning commission held a public hearing.
The city staff published a hearing notice in the Pioneer Press and sent
notices to the surrounding property owners. The planning commission gave
everyone at the hearing a chance to speak and present written statements.
On October 18, 2022, the planning commission continued its review and
recommended that the city council deny the comprehensive plan
amendment.
2.On December 12, 2022, the city council discussed the comprehensive plan
amendment. They considered reports and recommendations from the
planning commission and city staff.

drainage, water run-off, vibration, general unsightliness, electrical
interference or other nuisances.
5.The use would not exceed the design standards of any affected street.
6.The use would be served by adequate public facilities and services,
including streets, police and fire protection, drainage structures, water
and sewer systems, schools and parks.
7.The use would not create excessive additional costs for public facilities or
services.
8.The use would maximize the preservation of and incorporate the site’s
natural and scenic features into the development design.
9.The use would cause minimal adverse environmental effects.

8.Any identificationor monument signs for the project must meet the

PURCHASE AGREEMENT FOR 1160 FROST AVENUE
WHEREAS, the City of Maplewood (the “City”) is the owner of certain real property
located at 1160 Frost Avenue in Maplewood, Minnesota (the “Property”); and
WHEREAS, the legal description of the Property is:
Lots 1 through 20 inclusive, Block 1, Kavanagh and Dawson’s Addition to Gladstone, together
with the vacated alley in said Block 1, Ramsey County, Minnesota; and
WHEREAS, on July 8, 2021 the City entered into a purchase agreement with Reuter
Walton Development, LLC (the “Purchase Agreement”) regarding the Property; and
WHEREAS, on November 17, 2022 the parties executed the First Amendment to
Purchase Agreement to extend certain dates and deadlines; and
WHEREAS, the parties wish to amend the Purchase Agreement again.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

Depositories must meet strict criteria established in Minnesota law for the safekeeping of public
funds.
Background:
Designation of depositories is done on an annual basis. A financial institution not already
designated may be designated as a depository at any council meeting during the year. When city
investments are made, quotations are obtained only from securities dealers authorized in M.S.
118A.06. Broker-dealers are regulated through the SEC and FINRA. Investments are held for
safekeeping in designated depositories

BE IT RESOLVED, that the following be and hereby are selected as depositories for deposits and
investments of the City of Maplewood:

TD Ameritrade
BE IT FURTHER RESOLVED that the deposits in any of the above depositories shall not exceed
the amount of F.D.I.C. insurance covering such deposit unless collateral or a bond is furnished as
additional security, and
BE IT FURTHER RESOLVED that any funds in the above depositories may be withdrawn and
electronically transferred to any other depository of the city by the request of the finance director or
his/her designee.
BE IT FURTHER RESOLVED that these depository designations are effective until December 31,
2023.

The fire department is in need of replacing our cardiac monitors. The purchase of new cardiac
monitors is in the Capital Improvement Plan (CIP) for 2023. The department’s current cardiac
monitors are nearing the end of useful life and are due for replacement.

Ensuring the department’s cardiac monitoring equipment is reliable and that it meets the current
healthcare needs of the community.
Background:
As part of the EMS Department’s durable equipment replacement plan, this purchase will replace
six cardiac monitors that are seven years old. The American Hospital Association suggests a 5-
year useful life expectancy for these devices. We have been able to extend the life of these
devices through preventative maintenance, but the devices will be beyond the manufacturer’s
useful life expectancy by the end of 2023 and are in need of replacement.
New cardiac monitors will improve patient care through increased technology and enhanced data
integration. New cardiac monitors will enhance Quality Assurance/Quality Improvement reviews
and will ensure that Maplewood Fire/EMS providers are utilizing modern technology when providing
patient care in the community.

Background
Wayne Nuessmeier, who retired from the East County Line Fire Department after serving from 1969 to
th
1989, passed away on November 25, 2022. At his family’s request, fire department staff conducted
th
the bell ceremony at Nuessmeier’s burial on December 9, 2022. The bell ceremony is a fire service
tradition in which the ringing of a bell signifies the honor and respect of a firefighter’s service. In honor
of Firefighter Nuessmeier, his grandson Justin Lentz donated $500 to the Maplewood Fire Department.
The fire department plans to use the donation to enhance its Honor Guard capabilities in the future.
The Finance Department is to increase the expense and revenue accounts for allocation of funds as
requested.

Background
Automated external defibrillators improve cardiac arrest survival rates when applied during the first
minutes of cardiac arrest. In an effort to provide AEDs to first responders in Maplewood, staff has
secured a grant through the University of MN Medical School from the Leona M. and Harry B. Helmsley
Charitable Trust. The grant will fund the purchase of AEDs which will be distributed to first responders.
All public safety AED’s are ending near of life and would have been due for replacement in the coming
year. This grant replaces all first responder AED’s. The estimated value of this grant is $75,000.

and specialty training. The grant covers all work time and overtime associated with traffic
enforcement and mandatory department training.
